Ancak, baz\u0131 \u00e7evrelerin yo\u011fun bask\u0131lar\u0131 sonucu bu niyet ask\u0131ya al\u0131nm\u0131\u015ft\u0131!<\/strong><\/span><\/p><p><span style=\"font-family: arial, helvetica, sans-serif;\"><strong>Latin Alfabesine Ge\u00e7i\u015f A\u015famalar\u0131<\/strong><\/span><\/p><p><span style=\"font-family: arial, helvetica, sans-serif;\">B\u00e2b-\u0131 Ali denilen Sadrazam (Ba\u015fbakanl\u0131k) binalar\u0131 ve Bakanl\u0131k kadrolar\u0131 b\u00fcrokrasisi, dev\u015firme sisteminin sona ermesi \u00fczerine, 18. y\u00fczy\u0131lda (\u00f6zellikle Sultan Abd\u00fclhamid\u2019den sonra) Osmanl\u0131 Devleti&#8217;nin y\u00f6netici s\u0131n\u0131f\u0131 konumuna y\u00fckseldi. <strong><em>\u201cEfendilerin Pa\u015fa olmas\u0131\u201d<\/em><\/strong> s\u00f6zleriyle tan\u0131mlanan bu s\u00fcre\u00e7te, devletin \u00e7e\u015fitli b\u00fcrolar\u0131nda \u00e7al\u0131\u015fan ve <strong>\u201ckalemiyye\u201d<\/strong> diye an\u0131lan k\u00e2tip s\u0131n\u0131f\u0131, yava\u015f yava\u015f y\u00fcksek memurluklar\u0131 ele ge\u00e7irdi. \u0130lk olarak Amerikal\u0131 tarih\u00e7i Norman Itzkowitz\u2019in dikkat \u00e7ekti\u011fi bu d\u00f6n\u00fc\u015f\u00fcm sonucunda, 18. y\u00fczy\u0131ldaki 37 ba\u015f defterdar\u0131n 28&#8217;i maliye b\u00fcrokrasisinden, 26\u2019s\u0131 reis\u00fc\u2019l-k\u00fcttab\u0131n, 16&#8217;s\u0131 ise o zaman\u0131n \u201cd\u0131\u015fi\u015fleri bakanl\u0131\u011f\u0131\u201d diyebilece\u011fimiz reis\u00fc\u2019l-k\u00fcttapl\u0131k b\u00fcrosundan yeti\u015fip gelmi\u015ftir. Bu durumu, bi\u00e7imsel olarak II. Mahmut d\u00f6neminde ortaya \u00e7\u0131kacak olan nezaretlerin (bakanl\u0131klar\u0131n), i\u015flevsel olarak 18. y\u00fczy\u0131lda olu\u015ftuklar\u0131n\u0131 belirterek tan\u0131mlamak da uygun d\u00fc\u015fecektir.<\/span><\/p><p><span style=\"font-family: arial, helvetica, sans-serif;\"><strong>B\u00fcrokrasinin a\u011fdal\u0131, resmi dilini kullanan s\u0131n\u0131f\u0131n egemenli\u011fi ise, yaz\u0131 T\u00fcrk\u00e7esinin de a\u011fdal\u0131 bir \u00fcsluba do\u011fru kaymas\u0131na yol a\u00e7t\u0131. D\u00fczyaz\u0131n\u0131n t\u00fcm\u00fc ile devlet memurlar\u0131n\u0131n, ya da en az\u0131ndan devlet memurlu\u011funda yeti\u015fmi\u015flerin tekelinde oldu\u011fu bir d\u00f6nemde b\u00f6ylesi bir geli\u015fme gayet do\u011fald\u0131. Mahmut<\/strong> d\u00f6neminden itibaren T\u00fcrk\u00e7ede bir yal\u0131nla\u015fma ak\u0131m\u0131n\u0131n ba\u015flamas\u0131d\u0131r. Bu geli\u015fmenin k\u00f6keninde ise gazetenin ortaya \u00e7\u0131k\u0131\u015f\u0131 yatmaktad\u0131r. Nitekim Osmanl\u0131 Devleti&#8217;nin resmi gazetesi olan <strong><em>Takvim-i Vek\u00e2yi<\/em><\/strong>\u2019nin (1831), T\u00fcrk\u00e7enin yal\u0131nla\u015fma s\u00fcrecinde \u00e7ok \u00f6nemli bir rol\u00fc vard\u0131r. Ne var ki bunun \u201chalk\u0131n anlayabilmesi\u201d i\u00e7in yap\u0131ld\u0131\u011f\u0131 san\u0131lmamal\u0131yd\u0131. Takvim-i Vek\u00e2yi, halk okusun da \u00f6\u011frensin diye \u00e7\u0131kar\u0131lmam\u0131\u015ft\u0131. Amac\u0131, devlet memurlar\u0131n\u0131, \u00f6zellikle de gen\u00e7, hen\u00fcz yeterince bilgili ve deneyimli olmayanlar\u0131, bir de, merkezden uzak bulunanlar\u0131 bilgilendirmekti. Ama k\u0131sa bir s\u00fcre sonra halk\u0131n okumas\u0131 i\u00e7in de gazete \u00e7\u0131kar\u0131lmaya ba\u015flad\u0131. <strong><em>Cer\u00eede-i Hav\u00e2dis<\/em><\/strong> (1840) gazetesiyle ba\u015flayan bu yeni s\u00fcre\u00e7te ise, olan bitenin ortalama vatanda\u015fa yorumlu, yani siyasal ele\u015ftiri ile aktar\u0131lmas\u0131 \u00e7abas\u0131, dilde yal\u0131nla\u015fmay\u0131 h\u0131zland\u0131rd\u0131. S\u00f6z konusu yal\u0131nla\u015fmaya as\u0131l ivme kazand\u0131ran geli\u015fme ise, Osmanl\u0131 Devleti&#8217;nin Tanzimat\u2019la birlikte bir kamu e\u011fitimi politikas\u0131 ba\u015flatmas\u0131yd\u0131. Bilindi\u011fi gibi, s\u00f6z konusu d\u00f6neme kadar devletin verdi\u011fi e\u011fitim, eskiden oldu\u011fu gibi, yaln\u0131zca devlet i\u00e7in \u00e7al\u0131\u015facak olanlara hast\u0131. Dolay\u0131s\u0131yla, <strong>T\u0131bbiye\u2019yi<\/strong> ya da <strong>Harbiye&#8217;yi<\/strong> kuran devlet, ilk\u00f6\u011fretime eskisi gibi kar\u0131\u015fmam\u0131\u015f, bunu camilerin bir t\u00fcr yan kurulu\u015fu olan geleneksel mekteplere b\u0131rakm\u0131\u015ft\u0131. Bu geli\u015fme, 1857\u2019de Maarif Nezareti\u2019nin (E\u011fitim Bakanl\u0131\u011f\u0131) kurulmas\u0131yla sonu\u00e7land\u0131. Bu tarihten sonra Osmanl\u0131 Devleti daha kapsaml\u0131 e\u011fitim programlar\u0131 uygulayacak ve T\u00fcrk\u00e7enin yal\u0131nla\u015fmas\u0131na \u00e7ok b\u00fcy\u00fck bir katk\u0131 yapacakt\u0131.<\/span><\/p><p><span style=\"font-family: arial, helvetica, sans-serif;\"><strong>T\u00fcrk\u00e7enin<\/strong><strong> Arap harfleriyle yaz\u0131lmas\u0131n\u0131n bir sorun oldu\u011funa ve Latin Alfabesinin al\u0131nmas\u0131n\u0131n belki daha yararl\u0131 olaca\u011f\u0131na ili\u015fkin ilk tart\u0131\u015fmalar\u0131n hemen 1860&#8217;larda ba\u015flamas\u0131n\u0131n nedeni, e\u011fitimin yayg\u0131nla\u015fmas\u0131n\u0131n ka\u00e7\u0131n\u0131lmaz sonucu olan yal\u0131nla\u015fma s\u00fcreci olmaktayd\u0131. Bu son ko\u015ful \u0130stanbul\u2019daki h\u00fck\u00fcmetin istifas\u0131 demek oldu\u011fundan, Ankara H\u00fck\u00fcmeti\u2019nin de \u0130stanbul\u2019a bir vali tayin edece\u011fi a\u00e7\u0131kt\u0131r!\u201d<\/em><\/strong><\/span><\/p><p><span style=\"font-family: arial, helvetica, sans-serif;\">G\u00f6r\u00fcld\u00fc\u011f\u00fc gibi Ankara\u2019y\u0131 \u0130stanbul\u2019da temsil eden ki\u015fi, \u0130stanbul\u2019dakilere yepyeni bir devlet \u00f6rg\u00fctlenmesi sunmaktad\u0131r. \u201cHilafet Devleti\u201d diyebilece\u011fimiz bu \u00f6rg\u00fctlenmede ise devlet ba\u015fkan\u0131n\u0131n, 1909 Anayasa de\u011fi\u015fikliklerinden sonra ortaya \u00e7\u0131kan Saltanat kurumu kadar bile yetkisi kalmayacakt\u0131r. Tam bir y\u0131l sonra, Cumhuriyet ilan edildi\u011finde g\u00f6sterilen tepkiler, bunu atlatmaya y\u00f6neliktir. \u00d6rne\u011fin K\u00e2z\u0131m Karabekir Pa\u015fa, \u201cBize bu konuda bir \u015fey s\u00f6ylenmemi\u015fti\u201d demi\u015ftir. Fakat \u00e7a\u011fda\u015f ko\u015fullar\u0131n etkisi alt\u0131nda ayd\u0131n monark olarak bu h\u00fck\u00fcmdar\u0131n giri\u015fimlerinin kendisi, mutlak h\u00fck\u00fcmdar\u0131n g\u00fcc\u00fcn\u00fc k\u0131sma y\u00f6n\u00fcnde bir de\u011fi\u015fiklik yap\u0131lmas\u0131 sonucunu do\u011furdu ki, bu Tanzimat&#8217;t\u0131r.<\/span><\/p><p><span style=\"font-family: arial, helvetica, sans-serif;\">II. Mahmut\u2019un kurmaya \u00e7al\u0131\u015ft\u0131\u011f\u0131 rejim, <strong><em>merkez d\u0131\u015f\u0131 b\u00f6lgelerin temsilcisi say\u0131lan ta\u015fra g\u00fc\u00e7lerinin ortakl\u0131\u011f\u0131 ile s\u00f6zle\u015fmeye dayal\u0131 bir rejimin tersine, merkezi g\u00fcc\u00fcn \u00fcst\u00fcnl\u00fc\u011f\u00fc alt\u0131nda, onun g\u00f6revlendirece\u011fi Sadrazamlar, onlar\u0131n atayaca\u011f\u0131 Bakanlar ve Y\u00fcksek B\u00fcrokratlarla ve bunlar\u0131n haz\u0131rlayaca\u011f\u0131 kanun ve kurumlar\u0131yla \u00e7al\u0131\u015facak bir h\u00fck\u00fcmet<\/em><\/strong> bi\u00e7imindedir. Bu sistemde Padi\u015fah\u0131n yetkisi san\u0131ld\u0131\u011f\u0131n\u0131n aksine, \u00e7ok s\u0131n\u0131rl\u0131 d\u00fczeydedir. Bunlar\u0131n \u00e7al\u0131\u015fmalar\u0131yla yava\u015f yava\u015f bir <strong>&#8220;Nizamat-\u0131 Esasiyye&#8221; <\/strong>(temel kurallar) kavram\u0131 belirmeye ba\u015flad\u0131. Bu temel kurallar\u0131n konmas\u0131 i\u00e7in de h\u00fck\u00fcmdar\u0131n g\u00fcc\u00fcn\u00fc kanunlara ba\u011flama zorunlulu\u011funun yolu a\u00e7\u0131ld\u0131. Onun i\u00e7in Tanzimat d\u00f6neminden itibaren siyasal geli\u015fmelerin rotas\u0131 bu \u00fc\u00e7 \u00f6rg\u00fct\u00fcn davran\u0131\u015flar\u0131na g\u00f6re \u015fekil alacakt\u0131r. Y\u00f6netilenlerin yani halk kesiminin y\u00f6netme i\u015fine kat\u0131lmas\u0131, Osmanl\u0131 gelene\u011fine yabanc\u0131 bir davran\u0131\u015ft\u0131. Bu gelenekte, reaya ad\u0131na \u00e2yan ve hanedanlar\u0131 h\u00fck\u00fcmette s\u00f6z sahibi etmek bile Osmanl\u0131 egemenli\u011fini par\u00e7alamak anlam\u0131n\u0131 ta\u015f\u0131rd\u0131. Tanzimat d\u00f6neminin b\u00f6yle bir ili\u015fki kurmaya do\u011fru yapt\u0131\u011f\u0131 denemeler, Tanzimat&#8217;a kar\u015f\u0131 olan, ilk kez siyasal bir ideoloji rengini alm\u0131\u015f olan <strong><em>Yeni Osmanl\u0131lar<\/em><\/strong> ak\u0131m\u0131na yol a\u00e7t\u0131. Bu ak\u0131m\u0131n etkisi alt\u0131nda, devleti <strong>&#8220;Nizamat-\u0131 Esasiyye&#8221; <\/strong>kavram\u0131n\u0131n ald\u0131\u011f\u0131 yeni bi\u00e7imle &#8220;<strong>Kanun-\u0131 Esasi&#8221;<\/strong>ye dayama sorununun tart\u0131\u015fmalar\u0131, s\u00f6z\u00fcn\u00fc etti\u011fimiz ikinci e\u011filimin ger\u00e7ekle\u015fme g\u00fc\u00e7l\u00fcklerini yeniden meydana \u00e7\u0131kard\u0131. <strong><em>Yeni Osmanl\u0131lar<\/em><\/strong> ak\u0131m\u0131 ayan, esnaf ya da halk\u0131 temsil etmiyordu. Mithat Pa\u015fa&#8217;n\u0131n temsil etti\u011fi ta\u015fra \u00f6zerkli\u011fi (adem-i merkeziyet) tezi, <strong>&#8220;h\u00e2kim millet&#8221;<\/strong> terimi ile kastedilen Osmanl\u0131l\u0131k gelene\u011fine<strong><em>, M\u00fcsl\u00fcman halkla M\u00fcsl\u00fcman olmayan halklar\u0131n e\u015fitli\u011fi<\/em><\/strong> fikri, yozla\u015ft\u0131r\u0131lan din gelene\u011fine o kadar ayk\u0131r\u0131 idiler ki, ancak Abd\u00fclhamid gibi g\u00fc\u00e7l\u00fc bir h\u00fck\u00fcmdar\u0131n elinde Kanun-\u0131 Esasi rejimi <strong><em>merkeziyet\u00e7i, mutlakiyet\u00e7i, \u015feriats\u0131z<\/em><\/strong> karmas\u0131 bir rejim \u015feklinde uygulanm\u0131\u015ft\u0131. 1908&#8217;de bu rejimin devrilmesiyle \u00e7\u0131kan merkeziyet\u00e7ilik-ta\u015frac\u0131l\u0131k (merkeziyet-adem-i merkeziyet) \u00e7at\u0131\u015fmas\u0131nda \u00fcst\u00fcn \u00e7\u0131kan e\u011filim, Kanun-\u0131 Esasili me\u015frutiyet do\u011frultusunda <strong><em>merkeziyet\u00e7i bir monar\u015fi rejimini<\/em><\/strong> y\u00fcr\u00fctme oldu. Mahmut\u2019a \u201cG\u00c2VUR PAD\u0130\u015eAH!?\u201d demekten bile sak\u0131nm\u0131yordu.<\/strong><\/span><\/p><p><span style=\"font-family: arial, helvetica, sans-serif;\"><strong>Tanzimat&#8217;\u0131n ilan\u0131na kadar bunlar\u0131n hi\u00e7biri tamamen uygulanmam\u0131\u015ft\u0131r. Tanzimat, h\u00fck\u00fcmdar\u0131n yetkilerini k\u0131sma gibi bir de\u011fi\u015fiklikle b\u00f6yle bir rejimin uzant\u0131s\u0131d\u0131r. Kimi g\u00f6zlemciler bunu eski despotizme, kimileri istibdat y\u00f6netimine, kimileri de ilkel yasal\u0131 bir rejime benzetmeye kalk\u0131\u015fm\u0131\u015flard\u0131r. Ger\u00e7ekte bu, Avrupa&#8217;da Frans\u0131z Devrimi&#8217;nin y\u0131kt\u0131\u011f\u0131, Avrupa&#8217;n\u0131n ba\u015fka yerlerinde de y\u0131k\u0131lma halinde olan ve <em>Ancien Regime <\/em>terimi ile adland\u0131r\u0131lan devlet t\u00fcr\u00fcne \u00e7ok yak\u0131nd\u0131r. Bu modeli istibdat y\u00f6netimi olarak tan\u0131mlamak, bir y\u00fczy\u0131l kadar sonra kurulan Cumhuriyet rejiminin ilk a\u015famas\u0131n\u0131 diktat\u00f6rl\u00fck rejimi olarak nitelendirmek gibi eksik ve yan\u0131lt\u0131c\u0131d\u0131r.<\/strong><\/span><\/p><p><span style=\"font-family: arial, helvetica, sans-serif;\"><strong>Fakat II. Bu asl\u0131ndaki halinden \u00e7\u0131km\u0131\u015f, akla ve tabiat kanunlar\u0131na ayk\u0131r\u0131 inan\u00e7larla yozla\u015ft\u0131r\u0131lm\u0131\u015ft\u0131r. \u0130slaml\u0131k\u2019\u0131 bunlardan temizleyerek saf haline d\u00f6nd\u00fcrmek laz\u0131md\u0131r. En b\u00fcy\u00fck <strong>\u201cink\u0131lap\u201d<\/strong> bunu ba\u015farmak olacakt\u0131r.<\/span><\/p><p><span style=\"font-family: arial, helvetica, sans-serif;\">Fakat <strong><em>saf halindeki \u0130slaml\u0131k\u2019\u0131n niteli\u011fi, bunun d\u00fcnyasal hayat kurumlar\u0131 ile ili\u015fkisi, saf hale d\u00f6nd\u00fcr\u00fclmek \u00fczere ne gibi m\u00fcesseselerin kald\u0131r\u0131lmas\u0131 gerekti\u011fi<\/em><\/strong> noktalar\u0131 \u00fczerinde ayr\u0131l\u0131klar hemen ortaya \u00e7\u0131kt\u0131. Din reformu konusu, en ba\u015fta \u015eeyh\u00fclislaml\u0131k ve medreseyle al\u00e2kal\u0131yd\u0131. Devletin yar\u0131 g\u00fcc\u00fcn\u00fc elinde tutan din m\u00fcessesesi, bu reform konusu \u00fczerinde hareketsiz kalamazd\u0131. Din ad\u0131na y\u00f6neltilen ele\u015ftiriler en \u00e7ok medreseler ile tarikatlara \u00e7evrilmi\u015fti. <em>\u0130\u00e7tihat <\/em>dergisinde verilen rakamlara g\u00f6re 1914\u2019te yaln\u0131z \u0130stanbul&#8217;da 178 medrese vard\u0131. Bunlarda 7.000 \u00f6\u011frenci ya\u015f\u0131yordu. Buna kar\u015f\u0131l\u0131k \u00dcniversitenin \u0130lahiyat ve Edebiyat fak\u00fcltelerinde 348, Fen fak\u00fcltesinde 200, Hukuk fak\u00fcltesinde 2.119 \u00f6\u011frenci vard\u0131. \u00dcniversitenin bu en \u00f6nemli \u00fc\u00e7 fak\u00fcltesindeki \u00f6\u011frenci say\u0131s\u0131, medrese \u00f6\u011frencilerinin say\u0131s\u0131n\u0131n yar\u0131s\u0131 kadar bile de\u011fildi! Medrese \u00f6\u011frencilerinin \u00e7o\u011funlu\u011funun ortalama ya\u015f\u0131 35\u2019ti. Bir\u00e7ok da 40-45 ya\u015flar\u0131 aras\u0131nda olanlar vard\u0131. Medreseler b\u00fcy\u00fck bir i\u015fsiz ve asker ka\u00e7a\u011f\u0131 yuvas\u0131 olmu\u015flard\u0131. Medreseleri bu durumdan \u00e7\u0131karmak, \u00f6\u011fretim programlar\u0131na modern bilimleri sokmak \u015fartt\u0131. Ayr\u0131ca, \u00e7a\u011fda\u015f sorunlara duyarl\u0131 ve i\u00e7tihat kafal\u0131 din adamlar\u0131 yeti\u015ftirilmesi bir ihtiya\u00e7t\u0131. Bunlar \u0130slaml\u0131k\u2019\u0131n sanat, ticaret ve d\u00fcnya kazan\u00e7lar\u0131n\u0131 te\u015fvik eden akli yanlar\u0131n\u0131 \u00f6\u011frencilerine a\u015f\u0131lamal\u0131yd\u0131<em>. <\/em><\/span><\/p><p><span style=\"font-family: arial, helvetica, sans-serif;\">\u0130slam Dininde de\u011fil, Dini hizmet m\u00fcesseselerinde ve baz\u0131 yozla\u015ft\u0131r\u0131lm\u0131\u015f geleneklerde reform gerekti\u011fi hakk\u0131ndaki fikirleri, M\u0131s\u0131r\u2019da Muhammed Abduh\u2019un reformculu\u011fundan etkilenen Rusya M\u00fcsl\u00fcmanlar\u0131ndan Musa Carullah\u2019\u0131n (Bigiyef) yaz\u0131lar\u0131yla ray\u0131ndan sapt\u0131r\u0131lm\u0131\u015ft\u0131. \u0130stanbul\u2019da Abduh\u2019un art\u00e7\u0131s\u0131 olan Re\u015fid R\u0131za\u2019n\u0131n <strong><em>el-Manar<\/em><\/strong> dergisindeki fikirlerini yans\u0131tan T\u00fcrkiye \u0130slamc\u0131lar\u0131, Musa Carullah yoluyla gelen fikirlere kar\u015f\u0131 hi\u00e7bir ilgi g\u00f6stermedikleri halde, bu fikirleri <strong><em>\u0130\u00e7tihat<\/em><\/strong> gibi Bat\u0131c\u0131<strong>, <em>T\u00fcrk Yurdu<\/em><\/strong> gibi ulus\u00e7u dergilerin yans\u0131tmas\u0131 \u015fa\u015f\u0131rt\u0131c\u0131yd\u0131. Siyasal g\u00f6r\u00fc\u015fte de R\u0131za Arap hilafet\u00e7isi, Arap ulus\u00e7usu, \u0130tilaf\u00e7\u0131, \u0130ngilizci idi. Musa Carullah ise, ilahiyatta a\u00e7\u0131k\u00e7a Mutezile yanl\u0131s\u0131, siyasette T\u00fcrk ulus\u00e7usuydu. Geleneksel olarak E\u015f&#8217;ari ilahiyat\u0131n\u0131 benimsemi\u015f olan Osmanl\u0131 \u015feriat\u00e7\u0131 ulemas\u0131 i\u00e7in Mutezilecilik hemen hemen dinsizlik anlam\u0131n\u0131 ta\u015f\u0131rd\u0131.<\/span><\/p><p><span style=\"font-family: arial, helvetica, sans-serif;\">Yaz\u0131lar\u0131nda Hristiyanl\u0131k d\u00fcnyas\u0131yla \u0130slaml\u0131k d\u00fcnyas\u0131 aras\u0131nda her noktada kar\u015f\u0131tl\u0131klar g\u00f6ren <strong>Sait Halim Pa\u015fa<\/strong>, Avrupa\u2019da dinsizlik ak\u0131m\u0131yla \u0130slaml\u0131k&#8217;ta dinsizlik ak\u0131m\u0131n\u0131 da birbirinden farkl\u0131 sorunlar olarak ele almaktayd\u0131. Hristiyanl\u0131k, dinsizli\u011fe hakl\u0131l\u0131k kazand\u0131ran asl\u0131ndan sapt\u0131r\u0131lm\u0131\u015f bir din oldu\u011fu halde, \u0130slaml\u0131k\u2019ta dinden uzakla\u015fmak b\u00fct\u00fcn ahl\u00e2k kurallar\u0131n\u0131n \u00e7i\u011fnenmesi anlam\u0131n\u0131 ta\u015f\u0131rd\u0131. Ki\u015filerin ahl\u00e2ken bozulmas\u0131 ise toplumun da\u011f\u0131lmas\u0131na yol a\u00e7ard\u0131. Dinsizlik, bir M\u00fcsl\u00fcman toplumunun ba\u015f\u0131na gelebilecek felaketlerin en b\u00fcy\u00fc\u011f\u00fc olurdu. Bu y\u00fczden dinsizli\u011fe kar\u015f\u0131 sava\u015f, devletin \u00f6devi olmal\u0131yd\u0131. Arka arkaya gelen bu deneyler sonucunda Osmanl\u0131 rejiminin do\u011fas\u0131na uyan bir yolun a\u00e7\u0131laca\u011f\u0131 umulmaktad\u0131r.<\/em><\/strong><\/span><\/p><p><span style=\"font-family: arial, helvetica, sans-serif;\"><strong>Bu deneylerin birincisi, \u201c\u015eer\u2019\u00ee S\u00f6zle\u015fme\u201d olarak nitelendirilen bir antla\u015fma ile h\u00fck\u00fcmdar g\u00fcc\u00fcn\u00fc \u015feriata dayama \u00e7abas\u0131d\u0131r. Yeni Padi\u015fah IV. Mustafa\u2019n\u0131n iktidara geli\u015fi ile hem gelene\u011fe ayk\u0131r\u0131 hem \u015feriata ayk\u0131r\u0131 say\u0131lan Nizam-\u0131 Cedit reformunu kald\u0131rarak onun yerine Padi\u015fahla kullar\u0131 aras\u0131nda \u015fer\u2019\u00ee bir s\u00f6zle\u015fmeye dayanan bir denge kurulacakt\u0131. Yeni Padi\u015fah\u0131n geli\u015fi \u00fczerine haz\u0131rlanan bu \u015fer\u2019\u00ee s\u00f6zle\u015fmenin \u201c\u015eer\u2019\u00ee H\u00fcccet\u201d denen metnini anla\u015f\u0131lmas\u0131 g\u00fc\u00e7, \u00e7ok a\u011fdal\u0131 Osmanl\u0131cas\u0131ndan \u00e7\u0131kar\u0131rsak dayand\u0131\u011f\u0131 noktalar\u0131 \u015funlard\u0131:<\/strong><\/span><\/p><p><span style=\"font-family: arial, helvetica, sans-serif;\"><strong>1- Devlette saray ileri gelenleriyle devlet adamlar\u0131ndan uza\u011f\u0131 g\u00f6remeyen ki\u015filer, Nizam-\u0131 Cedit ad\u0131 alt\u0131nda g\u00f6r\u00fclmedik bir \u201cbid\u2019at\u201d \u00e7\u0131kard\u0131lar. \u0130rad-\u0131 Cedit ad\u0131 alt\u0131nda i\u015fledikleri zul\u00fcmlerle yaln\u0131z kendi \u00f6zel \u00e7\u0131karlar\u0131na yarayan i\u015flere kalk\u0131\u015ft\u0131lar. Bir\u00e7ok eylemlerinde k\u00e2firleri taklit ettikten ba\u015fka devleti de Hristiyan devletlerin kurallar\u0131na g\u00f6re y\u00fcr\u00fctmeye, M\u00fcsl\u00fcman halk\u0131n i\u015flerini ona g\u00f6re y\u00f6netmeye kalk\u0131\u015ft\u0131lar. Bu y\u00fczden ordu ocaklar\u0131nda devlete kar\u015f\u0131 nefret yaratt\u0131lar.<\/strong><\/span><\/p><p><span style=\"font-family: arial, helvetica, sans-serif;\"><strong>2- Padi\u015fah\u0131 aldatarak, amac\u0131 \u00f6zel \u00e7\u0131kar sa\u011flamaktan ba\u015fka bir \u015fey olmayan b\u00f6yle tedbirlere sapt\u0131klar\u0131ndan; ocak subay ve erleri i\u015flere d\u00fczen vermek gibi iyi bir niyetle isyan \u00e7\u0131kard\u0131lar. \u015eeriata ve kanuna uygun olarak eski h\u00fck\u00fcmdar\u0131 d\u00fc\u015f\u00fcr\u00fcp b\u00fct\u00fcn uleman\u0131n ve devlet adamlar\u0131n\u0131n iste\u011fiyle yeni Padi\u015fah\u0131 tahta getirerek ona biat ettiler. B\u00f6ylece, devlet uzakla\u015ft\u0131r\u0131ld\u0131\u011f\u0131 d\u00fczene kavu\u015fturuldu. Onun i\u00e7in oca\u011f\u0131n bu eyleminde bir su\u00e7 yoktur. Onu hem Padi\u015fah hem halk benimsemi\u015f durumdad\u0131r.<\/strong><\/span><\/p><p><span style=\"font-family: arial, helvetica, sans-serif;\"><strong>3- Ancak ulema aras\u0131nda dinimizin gere\u011fi olan<\/strong><strong><em> &#8220;iyili\u011fin uygulanmas\u0131, k\u00f6t\u00fcl\u00fc\u011fe engel olunmas\u0131&#8221; <\/em><\/strong><strong>(Emr bi&#8217;l-ma\u2019ruf ve nehy ani&#8217;l-m\u00fcnker) kural\u0131na ayk\u0131r\u0131 gelmek e\u011filimi, devlet adamlar\u0131 aras\u0131nda \u015feriat ve kanuna uymayan i\u015flere giri\u015fmeye kalkma gibi haller g\u00f6r\u00fcld\u00fc\u011f\u00fc i\u00e7in, bundan b\u00f6yle bunlar\u0131n ordu isteklerine uygun, do\u011fruya y\u00f6nelmi\u015f yolda gitmelerini sa\u011flamak laz\u0131md\u0131r.<\/strong><\/span><\/p><p><span style=\"font-family: arial, helvetica, sans-serif;\"><strong>4- Ordu subay ve erleri devlet i\u015flerine kar\u0131\u015fmayacaklard\u0131r. Sadece g\u00f6revlendirildikleri i\u015fleri sadakatle yapacaklar\u0131na dair s\u00f6zlerine ba\u011fl\u0131 kalacaklard\u0131r. Fakat e\u011fer ayk\u0131r\u0131 i\u015fler i\u015flenirse Padi\u015fah, vezirler, a\u011falar taraf\u0131ndan ocak erlerine ve subaylar\u0131na kar\u015f\u0131 su\u00e7lamaya ve cezaland\u0131rmaya giri\u015filmeyece\u011fine ba\u015fta Padi\u015fah, sonra devlet bakanlar\u0131 ve komutanlar s\u00f6z vermi\u015f durumdad\u0131r.<\/strong><\/span><\/p><p><span style=\"font-family: arial, helvetica, sans-serif;\"><strong>Bu s\u00f6zle\u015fmeyi yay\u0131mlayan Padi\u015fah bildirisinin ba\u015f\u0131na yeni Padi\u015fah\u0131n imzas\u0131yla \u015f\u00f6yle bir kay\u0131t konmu\u015ftur:<\/strong> <strong><em>&#8220;Bu \u015fer\u2019i h\u00fcccette yaz\u0131l\u0131 \u015fartlar\u0131n hepsi taraf\u0131m\u0131zdan g\u00f6r\u00fclm\u00fc\u015ft\u00fcr. Alt\u0131n\u0131 imzalayan \u015feyh\u00fclislam, sadrazam vekili ve uleman\u0131n imzalar\u0131n\u0131 ve m\u00fch\u00fcrlerini Padi\u015fah olarak tasdik ederim. Kullar\u0131m (Devlet emrindeki memurlar\u0131m olan ordu mensuplar\u0131m) bu s\u00f6zle\u015fmedeki \u015fartlara uyduklar\u0131 s\u00fcrece, verdikleri s\u00f6z gere\u011fi olarak devlet i\u015flerime kar\u0131\u015fmad\u0131k\u00e7a, dedelerimin zaman\u0131nda oldu\u011fu gibi benim emirlerime ve kendi subaylar\u0131na itaat ettik\u00e7e, ben de Tanr\u0131 ad\u0131na, Peygamber ruhuna s\u00f6z veririm ki halife olarak benim taraf\u0131mdan, bakanlar\u0131m ve komutanlar\u0131m taraf\u0131ndan (halk\u0131m\u0131n ve b\u00fcrokratlar\u0131n) hi\u00e7biri sorumlu ve su\u00e7lu say\u0131lmayacaklard\u0131r!&#8221;<\/em><\/strong><\/span><\/p><p><span style=\"font-family: arial, helvetica, sans-serif;\"><strong>Bu s\u00f6zle\u015fmenin kapsad\u0131\u011f\u0131 yenilikler \u015funlard\u0131: a) Devlet, dinin &#8220;bilinenin uygulanmas\u0131, istenmeyenin \u00f6nlenmesi&#8221; kural\u0131na dayanacak, b) Bunun g\u00fcvencesi ordu (Yeni\u00e7eri Oca\u011f\u0131) olacak, c) Bu ordu, halk iradesine ayk\u0131r\u0131, kanunsuz i\u015flemleri \u00f6nleme hakk\u0131na sahip bulunacakt\u0131r.<\/strong><\/span><\/p><p><span style=\"font-family: arial, helvetica, sans-serif;\"><strong>Buna &#8220;\u015fer\u2019i h\u00fcccet&#8221; niteli\u011fini veren taraf\u0131, imzalayanlar\u0131n ba\u015f\u0131nda \u015feyh\u00fclislam\u0131n bulunmas\u0131, \u015feriat mahkemesine tescil ettirilmesi, \u015feriat ad\u0131na yap\u0131ld\u0131\u011f\u0131n\u0131 g\u00f6stermek \u00fczere orduya bir \u015feriat h\u00fckm\u00fc olarak verilmi\u015f olmas\u0131d\u0131r.<\/strong><\/span><\/p><p><span style=\"font-family: arial, helvetica, sans-serif;\">Eski Osmanl\u0131 yasa rejimini bilenler kolayl\u0131kla g\u00f6r\u00fcrler ki bu s\u00f6zle\u015fme ve senet <strong>&#8220;\u015feriat&#8221;<\/strong> gere\u011fi olmad\u0131\u011f\u0131 gibi <strong>&#8220;kanun&#8221;<\/strong> gere\u011fi de de\u011fildir; ger\u00e7ekte ikisinden de farkl\u0131d\u0131r. \u015eeriatta bir h\u00fck\u00fcmdar\u0131n, bir halifenin ve devlet adamlar\u0131n\u0131n, <strong>&#8220;emir kulu&#8221;<\/strong> say\u0131lan askerlerin ko\u015ftu\u011fu \u015fartlara ba\u011fl\u0131 olmalar\u0131n\u0131 gerektiren a\u00e7\u0131k bir din kural\u0131 bulunmamaktad\u0131r. <strong>\u0130slam \u015feriat\u0131 devlet ve siyaset i\u015flerinde<\/strong> <strong><em>temel ve genel h\u00fck\u00fcmler koymaktad\u0131r.<\/em><\/strong> \u00c7e\u015fitli a\u015famalarda f\u0131k\u0131h bilginleri kendiliklerinden devlet \u00fczerine baz\u0131 d\u00fc\u015f\u00fcnceler aktarm\u0131\u015flar, bazen <strong>&#8220;imam&#8221;, <\/strong>bazen <strong>&#8220;halife&#8221;, <\/strong>bazen <strong>&#8220;sultan&#8221; <\/strong>olarak d\u00fc\u015f\u00fcnd\u00fckleri \u0130slam toplumunun siyasal \u00f6nderinde (&#8220;ul\u00fc\u2019l-emr&#8221;de) bulunmas\u0131 gereken nitelikleri tart\u0131\u015fm\u0131\u015flard\u0131r. Fakat bu d\u00fc\u015f\u00fcncelerin hi\u00e7biri \u015feriat hukukuna (\u00f6zel hukuk kesiminde oldu\u011fu gibi) belirli kurallar, emirler, yasaklar ya da m\u00fcsaadeler \u015feklinde yans\u0131mam\u0131\u015ft\u0131r. Bu d\u00fc\u015f\u00fcn\u00fcrlerin en b\u00fcy\u00fc\u011f\u00fc olan <strong>\u0130bn Haldun<\/strong>, kendisinden \u00e7ok \u00f6nce gelmi\u015f olan <strong>Gazali, Maverdi<\/strong> ve onlar\u0131n ard\u0131ndan gelenler gibi <strong><em>sultanl\u0131\u011f\u0131n halifelik olamayaca\u011f\u0131n\u0131, \u00e7\u00fcnk\u00fc onun, yani siyasal h\u00fck\u00fcmdarl\u0131\u011f\u0131n (&#8220;sultan&#8221; s\u00f6zc\u00fc\u011f\u00fcn\u00fcn as\u0131l Arap\u00e7a anlam\u0131 budur) g\u00fcce dayand\u0131\u011f\u0131n\u0131, ancak \u0130slam hukukunu uygulad\u0131\u011f\u0131 takdirde me\u015fru say\u0131laca\u011f\u0131n\u0131<\/em><\/strong> savunmu\u015flard\u0131r. <strong>Osmanl\u0131 Padi\u015fahl\u0131k rejiminin<\/strong> yasas\u0131 da bu g\u00f6r\u00fc\u015fe dayan\u0131rd\u0131.<\/span><\/p><p><span style=\"font-family: arial, helvetica, sans-serif;\"><strong><em>Bu \u015eer\u2019i S\u00f6zle\u015fme, g\u00fc\u00e7ler \u00e7at\u0131\u015fmas\u0131n\u0131n dengelenmesi \u00fczerine hi\u00e7bir etki yapmam\u0131\u015f, mevcut durumda bir de\u011fi\u015fiklik, bir yenilik olu\u015fturmam\u0131\u015ft\u0131. K\u0131sa bir s\u00fcre i\u00e7in, Padi\u015fah ve saray, \u015feyh\u00fclislam, sadrazam, derebeyler aras\u0131 \u00e7at\u0131\u015fmalar\u0131n bir dedektif roman\u0131n\u0131 and\u0131ran kar\u0131\u015f\u0131k komplolar halinde s\u00fcrmesine, III. Selim\u2019in \u00f6ld\u00fcr\u00fclmesine, IV. Mustafa\u2019n\u0131n da tahttan indirilmesine, nihayet Osmanl\u0131 soyunun son \u00fcyesi olarak kalan gen\u00e7 Mahmut\u2019un tahta ge\u00e7mesine varan bir dram\u0131n h\u0131zla oynanmas\u0131na yol a\u00e7m\u0131\u015ft\u0131. O zaman g\u00f6r\u00fcld\u00fc ki, h\u00fck\u00fcmdarl\u0131\u011f\u0131n kar\u015f\u0131s\u0131ndaki as\u0131l g\u00fc\u00e7 yeni\u00e7erilerde de\u011fil, \u00e2yan ve derebeylerde bulunmaktayd\u0131. Fakat nas\u0131l \u00f6teki geleneksel organlar belirli bir s\u0131n\u0131f\u0131 temsil etmiyorlarsa, nas\u0131l her biri i\u00e7lerinde sivrilen ki\u015finin ihtiraslar\u0131na ara\u00e7 oluyorsa, \u00e2yan ve derebeyler de birle\u015fik bir siyasal g\u00fc\u00e7 ya da s\u0131n\u0131f\u0131 temsil etmiyorlard\u0131.
