Erdo\u011fan da kat\u0131lm\u0131\u015ft\u0131. Yarg\u0131tay&#8217;\u0131n T\u0130P Milletvekili Can Atalay&#8217;\u0131n tahliye edilmesi y\u00f6n\u00fcndeki AYM karar\u0131na uymamas\u0131n\u0131n ve Atalay&#8217;\u0131n Milletvekilli\u011finin d\u00fc\u015f\u00fcr\u00fclmesinin yank\u0131lar\u0131 s\u00fcrerken, AYM Ba\u015fkan\u0131 Z\u00fcht\u00fc Arslan, yemin t\u00f6reni s\u0131ras\u0131nda ve Sn. Erdo\u011fan\u2019\u0131n y\u00fcz\u00fcne kar\u015f\u0131 \u00e7ok net ifadeler kullanm\u0131\u015ft\u0131. <\/strong><\/span><\/p><p><span style=\"font-family: arial;\"><strong>Konu\u015fmas\u0131nda <em>&#8220;Bireysel ba\u015fvuru T\u00fcrk yarg\u0131 tarihinin en b\u00fcy\u00fck yarg\u0131 reformlar\u0131ndan biridir\u201d<\/em> vurgusu yapan Arslan, <em>&#8220;Kesinle\u015fen bir karara kar\u015f\u0131 bireysel ba\u015fvuru yap\u0131ld\u0131\u011f\u0131nda da art\u0131k Anayasa\u2019y\u0131 yorumlamak ve uygulamak konusunda nihai yetki Anayasa Mahkemesine verilmi\u015ftir. Bu ba\u011flamda temyizden ge\u00e7erek kesinle\u015fmi\u015f yarg\u0131 kararlar\u0131ndan sonra AYM\u2019nin verdi\u011fi karar ve yapt\u0131\u011f\u0131 yorumdan sonra \u2018<\/em><\/strong><strong>g<\/strong><strong>\u00f6r\u00fc\u015f farkl\u0131l\u0131klar\u0131n\u0131n bulundu\u011fu\u2019<\/strong><strong><em> gerek\u00e7esiyle AYM kararlar\u0131na uyulmamas\u0131n\u0131n hi\u00e7bir anayasal ve yasal zemini yoktur&#8221;<\/em><\/strong><strong> s\u00f6zleriyle kimi hedef ald\u0131\u011f\u0131 a\u00e7\u0131kt\u0131. <\/strong><\/span><\/p><p><span style=\"font-family: arial;\"><strong>Cumhurba\u015fkan\u0131 Recep T. Erdo\u011fan ise t\u00f6rende konu\u015fma yapmadan salondan ayr\u0131lm\u0131\u015f; <\/strong><strong>Cumhurba\u015fkanl\u0131\u011f\u0131 Hukuk Politikalar\u0131 Kurulu Ba\u015fkanvekili Mehmet U\u00e7um, Anayasa Mahkemesinin bireysel ba\u015fvurularda verdi\u011fi kararlar sonucu \u00e7\u0131kan sorunlar\u0131 hat\u0131rlatan yaz\u0131s\u0131n\u0131 al\u0131nt\u0131layarak, AYM Ba\u015fkan\u0131 Z\u00fcht\u00fc Arslan\u2019\u0131n konu\u015fmas\u0131n\u0131 yan\u0131tlamaya \u00e7al\u0131\u015fm\u0131\u015ft\u0131. U\u00e7um, yapt\u0131\u011f\u0131 payla\u015f\u0131mda: <em>\u201cAnayasa madde 153 h\u00fckm\u00fc bireysel ba\u015fvuru ihlal kararlar\u0131n\u0131 kapsamaz. Ayr\u0131ca usul hukukumuzda \u2018yeniden yarg\u0131lama\u2019 ba\u011f\u0131ms\u0131z bir kurum de\u011fildir. Yarg\u0131laman\u0131n yenilenmesi\/iadesi karar\u0131na ba\u011fl\u0131 yarg\u0131lama faaliyetine yeniden yarg\u0131lama denir. Yarg\u0131laman\u0131n yenilenmesi\/iadesi karar\u0131 verme yetkisi karar yeri mahkemelerine aittir. Ayr\u0131nt\u0131lar ve konunun di\u011fer t\u00fcm y\u00f6nleri ekli yaz\u0131da i\u015flenmi\u015ftir.\u201d <\/em>hat\u0131rlatmas\u0131n\u0131 yapm\u0131\u015ft\u0131.<\/strong><\/span><\/p><p><span style=\"font-family: arial;\"><strong>Devlet Bah\u00e7eli\u2019nin <em>\u201cAnayasa Mahkemesi Art\u0131k Milli G\u00fcvenlik Sorunudur!\u201d<\/em> \u00c7\u0131k\u0131\u015f\u0131!..<\/strong><\/span><\/p><p><span style=\"font-family: arial;\"><strong>MHP Genel Ba\u015fkan\u0131 Devlet Bah\u00e7eli, <em>&#8220;Anayasa Mahkemesi art\u0131k milli g\u00fcvenlik sorunudur. Mahkeme ba\u015fkan\u0131 ve mahut \u00fcyeler devletin \u00fclkesi ve milletiyle b\u00f6l\u00fcnmez b\u00fct\u00fcnl\u00fc\u011f\u00fcn\u00fcn, toplumsal huzur ve g\u00fcvenli\u011fin muar\u0131z\u0131 haline gelmi\u015flerdir. B\u00f6yle gidemez, b\u00f6yle bir mahkeme yap\u0131s\u0131 T\u00fcrkiye&#8217;de y\u00fcksek yarg\u0131 organlar\u0131 i\u00e7inde yer alamaz, almamal\u0131d\u0131r.&#8221;<\/em> diyerek sald\u0131rm\u0131\u015ft\u0131.<\/strong><\/span><\/p><p><span style=\"font-family: arial;\"><strong><em>&#8220;Anayasa Mahkemesi adalet ve hukuk ilkelerine sava\u015f a\u00e7m\u0131\u015ft\u0131r!&#8221; <\/em><\/strong><strong>iddias\u0131!?<\/strong><\/span><\/p><p><span style=\"font-family: arial;\"><strong><em>&#8220;Verdi\u011fi skandal hak ihlali kararlar\u0131yla i\u00e7 bar\u0131\u015f ve huzur ortam\u0131n\u0131 sarsan ve kaos \u00fcretim merkezi oldu\u011funu teyit eden Anayasa Mahkemesi, tekrar ifade ediyorum ki ya kapat\u0131lmal\u0131 ya da yeni ba\u015ftan yap\u0131land\u0131r\u0131lmal\u0131d\u0131r. DEM&#8217;cilerin, DEM&#8217;lenmi\u015f CHP&#8217;nin ve di\u011fer marjinalle\u015fmi\u015f yedeklerinin Anayasa Mahkemesini siyasi siper haline getirmeleri, T\u00fcrk hukuk sistemine s\u00fcr\u00fclm\u00fc\u015f kara bir lekedir. Ter\u00f6riste hak ihlali karar\u0131 veren bir mahkeme T\u00fcrk milletinin mahkemesi olamaz, bunun ad\u0131na da adalet denilemez. DEM&#8217;lenmi\u015f CHP\u2019nin Anayasa Mahkemesini mevzi yapmas\u0131n\u0131, b\u00f6l\u00fcc\u00fc ter\u00f6ristlerin dayanak haline getirmelerini d\u0131\u015f ba\u011flant\u0131l\u0131 bir operasyon olarak de\u011ferlendiriyoruz. Yeminli T\u00fcrkiye d\u00fc\u015fmanlar\u0131 faaldir. \u00dclkemize operasyon \u00e7ekilmektedir. 31 Mart&#8217;ta T\u00fcrk milleti operasyon ma\u015falar\u0131na hesap soracakt\u0131r. Merkezi y\u00f6netimle uyumlu yerel y\u00f6netimlerin tesis ve tecellisi T\u00fcrkiye&#8217;nin g\u00fcc\u00fcne g\u00fc\u00e7 katacakt\u0131r. CHP&#8217;nin yeni adresi Kandil&#8217;dir. DEM, CHP&#8217;yi kafa kola alm\u0131\u015f, tehditlerle zincire vurmu\u015ftur. \u00d6zg\u00fcr Bey erkenden havlu atm\u0131\u015f, nihayet \u00e7uvallam\u0131\u015ft\u0131r. Cumhur \u0130ttifak\u0131 devlete sahip \u00e7\u0131kacak, vatana sahip \u00e7\u0131kacak, bayra\u011fa sahip \u00e7\u0131kacak, demokrasiye sahip \u00e7\u0131kacak, milli kaynaklara sahip \u00e7\u0131kacak, istiklale sahip \u00e7\u0131kacak, T\u00fcrkiye Y\u00fczy\u0131l\u0131&#8217;n\u0131n mimar\u0131 olacakt\u0131r&#8221; <\/em><\/strong><strong>diyen Bah\u00e7eli\u2019nin bu tela\u015f ve tedirginli\u011finin alt\u0131nda acaba ne yatmaktayd\u0131?<\/strong><\/span><\/p><p><span style=\"font-family: arial;\"><strong>\u201cY\u00fcce Divan\u201d Kurumu ve Kurallar\u0131<\/strong><\/span><\/p><p><span style=\"font-family: arial;\"><strong>\u0131) Y\u00fcce Divan:<\/strong> <strong><em>Anayasan\u0131n 148\u2019inci maddesinin alt\u0131nc\u0131 ve yedinci f\u0131kralar\u0131nda belirtilen ki\u015filerin, g\u00f6revleri ile ilgili su\u00e7lar\u0131ndan dolay\u0131 yarg\u0131lamas\u0131n\u0131 yapmakla g\u00f6revli Mahkeme Genel Kurulunu, ifade eder.<\/em><\/strong><\/span><\/p><p><span style=\"font-family: arial;\"><strong>3. G\u00f6rev ve yetkileri:<\/strong><\/span><\/p><p><span style=\"font-family: arial;\"><strong>Madde 148\u2013 Anayasa Mahkemesi, kanunlar\u0131n, Cumhurba\u015fkanl\u0131\u011f\u0131 kararnamelerinin ve T\u00fcrkiye B\u00fcy\u00fck Millet Meclisi \u0130\u00e7t\u00fcz\u00fc\u011f\u00fcn\u00fcn Anayasaya \u015fekil ve esas bak\u0131mlar\u0131ndan uygunlu\u011funu denetler ve bireysel ba\u015fvurular\u0131 karara ba\u011flar. Anayasa de\u011fi\u015fikliklerini ise sadece \u015fekil bak\u0131m\u0131ndan inceler ve denetler. Ancak, ola\u011fan\u00fcst\u00fc hallerde (\u2026) ve sava\u015f hallerinde \u00e7\u0131kar\u0131lan Cumhurba\u015fkanl\u0131\u011f\u0131 kararnamelerinin \u015fekil ve esas bak\u0131m\u0131ndan Anayasaya ayk\u0131r\u0131l\u0131\u011f\u0131 iddias\u0131yla, Anayasa Mahkemesinde dava a\u00e7\u0131lamaz.<\/strong><\/span><\/p><p><span style=\"font-family: arial;\"><strong>Kanunlar\u0131n \u015fekil bak\u0131m\u0131ndan denetlenmesi, son oylaman\u0131n, \u00f6ng\u00f6r\u00fclen \u00e7o\u011funlukla yap\u0131l\u0131p yap\u0131lmad\u0131\u011f\u0131; Anayasa de\u011fi\u015fikliklerinde ise, teklif ve oylama \u00e7o\u011funlu\u011funa ve ivedilikle g\u00f6r\u00fc\u015f\u00fclemeyece\u011fi \u015fart\u0131na uyulup uyulmad\u0131\u011f\u0131 hususlar\u0131 ile s\u0131n\u0131rl\u0131d\u0131r. \u015eekil bak\u0131m\u0131ndan denetleme, Cumhurba\u015fkan\u0131nca veya T\u00fcrkiye B\u00fcy\u00fck Millet Meclisi \u00fcyelerinin be\u015fte biri taraf\u0131ndan istenebilir. Kanunun yay\u0131mland\u0131\u011f\u0131 tarihten itibaren on g\u00fcn ge\u00e7tikten sonra, \u015fekil bozuklu\u011funa dayal\u0131 iptal davas\u0131 a\u00e7\u0131lamaz; def&#8217;i yoluyla da ileri s\u00fcr\u00fclemez.<\/strong><\/span><\/p><p><span style=\"font-family: arial;\"><strong><em>(Ek f\u0131kra: 7\/5\/2010-5982\/18 md.) Herkes, Anayasada g\u00fcvence alt\u0131na al\u0131nm\u0131\u015f temel hak ve \u00f6zg\u00fcrl\u00fcklerinden, Avrupa \u0130nsan Haklar\u0131 S\u00f6zle\u015fmesi kapsam\u0131ndaki herhangi birinin kamu g\u00fcc\u00fc taraf\u0131ndan, ihlal edildi\u011fi iddias\u0131yla Anayasa Mahkemesine ba\u015fvurabilir. Ba\u015fvuruda bulunabilmek i\u00e7in ola\u011fan kanun yollar\u0131n\u0131n t\u00fcketilmi\u015f olmas\u0131 \u015fartt\u0131r.<\/em><\/strong><\/span><\/p><p><span style=\"font-family: arial;\"><strong><em>(Ek f\u0131kra: 7\/5\/2010-5982\/18 md.) Bireysel ba\u015fvuruda, kanun yolunda g\u00f6zetilmesi gereken hususlarda inceleme yap\u0131lamaz.<\/em><\/strong><\/span><\/p><p><span style=\"font-family: arial;\"><strong><em>(Ek f\u0131kra: 7\/5\/2010-5982\/18 md.) Bireysel ba\u015fvuruya ili\u015fkin usul ve esaslar kanunla d\u00fczenlenir.<\/em><\/strong><\/span><\/p><p><span style=\"font-family: arial;\"><strong>Anayasa Mahkemesi; Cumhurba\u015fkan\u0131n\u0131, T\u00fcrkiye B\u00fcy\u00fck Millet Meclisi Ba\u015fkan\u0131n\u0131, Cumhurba\u015fkan\u0131 Yard\u0131mc\u0131lar\u0131n\u0131, Bakanlar\u0131, Anayasa Mahkemesi, Yarg\u0131tay, Dan\u0131\u015ftay (\u2026) Ba\u015fkan ve \u00fcyelerini, Ba\u015fsavc\u0131lar\u0131n\u0131, Cumhuriyet Ba\u015fsavc\u0131vekilini, H\u00e2kimler ve Savc\u0131lar (\u2026) Kurulu ve Say\u0131\u015ftay Ba\u015fkan ve \u00fcyelerini g\u00f6revleriyle ilgili su\u00e7lardan dolay\u0131 Y\u00fcce Divan s\u0131fat\u0131yla yarg\u0131lar. <a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a><\/strong><\/span><\/p><p><span style=\"font-family: arial;\"><strong>Y\u00fcce Divan Yarg\u0131lamas\u0131<\/strong><\/span><\/p><p><span style=\"font-family: arial;\"><strong>MADDE 57-\u00a0(1) (AYM) Genel Kurul, Y\u00fcce Divan s\u0131fat\u0131yla \u00e7al\u0131\u015f\u0131rken y\u00fcr\u00fcrl\u00fckteki kanunlara g\u00f6re duru\u015fma yapar ve h\u00fck\u00fcm verir.<\/strong><\/span><\/p><p><span style=\"font-family: arial;\"><strong><em>(2)\u00a0(Ek: 2\/7\/2018 &#8211; KHK-703\/209 md.)\u00a0Cumhurba\u015fkan\u0131, Cumhurba\u015fkan\u0131 Yard\u0131mc\u0131lar\u0131 ve Bakanlar hakk\u0131ndaki Y\u00fcce Divan yarg\u0131lamalar\u0131 \u00fc\u00e7 ay i\u00e7inde tamamlan\u0131r. Yarg\u0131lama bu s\u00fcre i\u00e7inde tamamlanamad\u0131\u011f\u0131 takdirde, ilave \u00fc\u00e7 ayl\u0131k s\u00fcre i\u00e7inde kesin olarak tamamlan\u0131r.<\/em><\/strong><\/span><\/p><p><span style=\"font-family: arial;\"><strong>(3) Y\u00fcce Divan, 5271 say\u0131l\u0131 kanundaki iddianamenin iadesi sebeplerinden ba\u015fka esasl\u0131 hukuka ayk\u0131r\u0131 h\u00e2llerin bulunmas\u0131 h\u00e2linde de iddianamenin veya iddianame yerine ge\u00e7en belgelerin iadesine karar verebilir.<\/strong><\/span><\/p><p><span style=\"font-family: arial;\"><strong>(4) Y\u00fcce Divanda sorgusu yap\u0131lm\u0131\u015f olan san\u0131\u011f\u0131n, sonraki oturumlara gelmemesi ve Y\u00fcce Divan taraf\u0131ndan da duru\u015fmada haz\u0131r bulunmas\u0131na gerek g\u00f6r\u00fclmemesi h\u00e2llerinde, duru\u015fmadan v\u00e2reste tutulma talebi olmasa dahi yoklu\u011funda duru\u015fmaya devam edilerek kamu davas\u0131 sonu\u00e7land\u0131r\u0131labilir. M\u00fcdafi her zaman duru\u015fmada haz\u0131r bulunabilir.<\/strong><\/span><\/p><p><span style=\"font-family: arial;\"><strong>(5) Duru\u015fma s\u0131ras\u0131nda Ba\u015fkan\u0131n uygun g\u00f6rece\u011fi teknik ara\u00e7larla kay\u0131t yap\u0131l\u0131r. Bu kayda dayan\u0131larak d\u00fczenlenen duru\u015fma tutanaklar\u0131n\u0131n her sayfas\u0131 Ba\u015fkan ile tutana\u011f\u0131 d\u00fczenleyenler taraf\u0131ndan imzalan\u0131r.<\/strong><\/span><\/p><p><span style=\"font-family: arial;\"><strong>(6) Y\u00fcce Divanda savc\u0131l\u0131k g\u00f6revini, Yarg\u0131tay Cumhuriyet Ba\u015fsavc\u0131s\u0131 veya Yarg\u0131tay Cumhuriyet Ba\u015fsavc\u0131vekili yapar. Yarg\u0131tay Cumhuriyet savc\u0131lar\u0131ndan g\u00f6revlendirilenler de Yarg\u0131tay Cumhuriyet Ba\u015fsavc\u0131s\u0131 veya Yarg\u0131tay Cumhuriyet Ba\u015fsavc\u0131vekiliyle birlikte duru\u015fmaya kat\u0131labilir.<\/strong><\/span><\/p><p><span style=\"font-family: arial;\"><strong>Yeniden inceleme<\/strong><\/span><\/p><p><span style=\"font-family: arial;\"><strong>MADDE 58-\u00a0(1) Y\u00fcce Divan taraf\u0131ndan verilen h\u00fckme kar\u015f\u0131 yeniden inceleme ba\u015fvurusu, Yarg\u0131tay Cumhuriyet Ba\u015fsavc\u0131s\u0131 veya Yarg\u0131tay Cumhuriyet Ba\u015fsavc\u0131vekili, san\u0131k, m\u00fcdafi, kat\u0131lan veya vekili taraf\u0131ndan yap\u0131labilir.<\/strong><\/span><\/p><p><span style=\"font-family: arial;\"><strong>(2) Yeniden inceleme ba\u015fvurusu h\u00fckm\u00fcn a\u00e7\u0131klanmas\u0131ndan itibaren on be\u015f g\u00fcn i\u00e7inde Y\u00fcce Divana bir dilek\u00e7e verilmesi suretiyle yap\u0131l\u0131r. H\u00fck\u00fcm, yeniden incelemeye ba\u015fvurma hakk\u0131 olanlar\u0131n yoklu\u011funda a\u00e7\u0131klanm\u0131\u015fsa, s\u00fcre tebli\u011f tarihinden ba\u015flar.<\/strong><\/span><\/p><p><span style=\"font-family: arial;\"><strong>(3) Y\u00fcce Divan yeniden incelemeyi dosya \u00fczerinden yapar. Yarg\u0131tay Cumhuriyet Ba\u015fsavc\u0131s\u0131n\u0131n veya Yarg\u0131tay Cumhuriyet Ba\u015fsavc\u0131vekilinin, san\u0131\u011f\u0131n veya kat\u0131lan\u0131n istemi \u00fczerine ya da resen incelemenin duru\u015fma a\u00e7\u0131larak yap\u0131lmas\u0131na da karar verilebilir.<\/strong><\/span><\/p><p><span style=\"font-family: arial;\"><strong>(4) \u0130ncelemenin duru\u015fma a\u00e7\u0131larak yap\u0131lmas\u0131na karar verilmesi h\u00e2linde Yarg\u0131tay Cumhuriyet Ba\u015fsavc\u0131s\u0131na veya Yarg\u0131tay Cumhuriyet Ba\u015fsavc\u0131vekiline, san\u0131\u011fa, kat\u0131lana, m\u00fcdafi ve vekile duru\u015fma g\u00fcn\u00fc tebli\u011f edilir. San\u0131k, duru\u015fmada haz\u0131r bulunabilece\u011fi gibi, kendisini bir m\u00fcdafi ile de temsil ettirebilir.<\/strong><\/span><\/p><p><span style=\"font-family: arial;\"><strong>(5) Duru\u015fmada Yarg\u0131tay Cumhuriyet Ba\u015fsavc\u0131s\u0131 veya Yarg\u0131tay Cumhuriyet Ba\u015fsavc\u0131vekili, haz\u0131r bulunmas\u0131 h\u00e2linde san\u0131k, m\u00fcdafi, kat\u0131lan ve vekili iddia ve savunmalar\u0131n\u0131 a\u00e7\u0131klar; yeniden inceleme ba\u015fvurusunda bulunan tarafa \u00f6nce s\u00f6z verilir. Her h\u00e2lde son s\u00f6z san\u0131\u011f\u0131nd\u0131r.<\/strong><\/span><\/p><p><span style=\"font-family: arial;\"><strong>(6) Yeniden inceleme, yaln\u0131zca ba\u015fvuruda belirtilen hususlarla s\u0131n\u0131rl\u0131 olarak yap\u0131l\u0131r. Ba\u015fvurunun yerinde g\u00f6r\u00fclmesi h\u00e2linde ayn\u0131 zamanda ba\u015fvuru konusu hakk\u0131nda da karar verilir. Yeniden inceleme ba\u015fvurusu \u00fczerine verilen kararlar kesindir.<a href=\"#_ftn2\" name=\"_ftnref2\">[2]<\/a><\/strong><\/span><\/p><p><span style=\"font-family: arial;\"><strong>Y\u00fcce Divan \u00fcyeleri:<\/strong><\/span><\/p><p><span style=\"font-family: arial;\"><strong>Y\u00fcce Divan \u00fcyeleri ayn\u0131 zamanda Anayasa Mahkemesinin \u00fcyeleridir. G\u00f6rev s\u00fcreleri 12 y\u0131ld\u0131r. Ayr\u0131ca 65 ya\u015f\u0131na gelen \u00fcyeler -on iki y\u0131l\u0131 tamamlamam\u0131\u015f olsa bile- ya\u015f haddinden emekliye ayr\u0131l\u0131r.<\/strong><\/span><\/p><p><span style=\"font-family: arial;\"><strong>Y\u00fcce Divan, T\u00fcrkiye&#8217;de Anayasa Mahkemesinin; Cumhurba\u015fkan\u0131n\u0131, TBMM Ba\u015fkan\u0131n\u0131, Cumhurba\u015fkan\u0131 Yard\u0131mc\u0131lar\u0131n\u0131, Bakanlar\u0131, Y\u00fcksek Yarg\u0131 mensuplar\u0131n\u0131, Genelkurmay Ba\u015fkan\u0131n\u0131 ve Kuvvet Komutanlar\u0131n\u0131 g\u00f6revleriyle ilgili su\u00e7lar\u0131ndan \u00f6t\u00fcr\u00fc yarg\u0131larken kulland\u0131\u011f\u0131 s\u0131fatt\u0131r. Mahkemenin bu yetkisi Anayasa&#8217;n\u0131n 148. maddesinin 6. f\u0131kras\u0131na dayan\u0131r.<\/strong><\/span><\/p><p><span style=\"font-family: arial;\"><strong>Y\u00fcce Divan s\u0131fat\u0131yla y\u00fcr\u00fct\u00fclecek yarg\u0131lamalara Genel Kurulca bak\u0131l\u0131r. Divan\u0131n savc\u0131l\u0131k g\u00f6revini Yarg\u0131tay Cumhuriyet Ba\u015fsavc\u0131s\u0131 ya da vekili y\u00fcr\u00fct\u00fcr. 2010 y\u0131l\u0131nda yap\u0131lan Anayasa de\u011fi\u015fikli\u011fine g\u00f6re Y\u00fcce Divan kararlar\u0131na yeniden inceleme yolu a\u00e7\u0131lm\u0131\u015ft\u0131r. G\u00f6revde bulunan veya g\u00f6revden ayr\u0131lm\u0131\u015f olan Cumhurba\u015fkan\u0131n\u0131n vatana ihanetten su\u00e7land\u0131r\u0131lmas\u0131n\u0131 isteyen \u00f6nerge Meclis Ba\u015fkanl\u0131\u011f\u0131na verildikten sonra derhal Meclisin bilgisine sunulur ve ilgili Cumhurba\u015fkan\u0131na bildirilir. Cumhurba\u015fkan\u0131n\u0131n da dinlenece\u011fi bir g\u00f6r\u00fc\u015fmeden sonra Meclis, Cumhurba\u015fkan\u0131n\u0131n Y\u00fcce Divana sevkine karar verilebilir. Y\u00fcce Divana sevk karar\u0131nda, hangi ceza h\u00fckm\u00fcne dayan\u0131ld\u0131\u011f\u0131 ve Cumhurba\u015fkan\u0131nca i\u015flendi\u011fi ileri s\u00fcr\u00fclen su\u00e7un hangi gerek\u00e7eyle vatana ihanet say\u0131ld\u0131\u011f\u0131 da belirtilir.<\/strong><\/span><\/p><p><span style=\"font-family: arial;\"><strong><em>2017 de\u011fi\u015fikli\u011fi sonras\u0131 ise;<\/em><\/strong><strong><em> 105. Madde: 2017 de\u011fi\u015fikli\u011fiyle Cumhurba\u015fkan\u0131 y\u00fcr\u00fctme g\u00f6revini tek ba\u015f\u0131na \u00fcstlendi\u011finden yapt\u0131\u011f\u0131 i\u015flemlerden, eylemlerden ve ald\u0131\u011f\u0131 kararlardan sorumlulu\u011fu bulunmaktad\u0131r. Ger\u00e7ekten de Anayasam\u0131z\u0131n 105\u2019inci maddesinin yeni \u015feklinin ilk f\u0131kras\u0131nda isnat edilen su\u00e7un niteli\u011fine ili\u015fkin bir ayr\u0131m yap\u0131lmaks\u0131z\u0131n <em>\u201cCumhurba\u015fkan\u0131 hakk\u0131nda, bir su\u00e7 i\u015fledi\u011fi iddias\u0131yla T\u00fcrkiye B\u00fcy\u00fck Millet Meclisi \u00fcye tamsay\u0131s\u0131n\u0131n salt \u00e7o\u011funlu\u011funun verece\u011fi \u00f6nergeyle soru\u015fturma a\u00e7\u0131lmas\u0131 istenebilir\u201d<\/em> kayd\u0131 bulunmaktad\u0131r.<\/strong><\/span><\/p><p><span style=\"font-family: arial;\"><strong>Kanunun ayr\u0131m yapmad\u0131\u011f\u0131 yerde bizim de ayr\u0131m yapmamam\u0131z laz\u0131md\u0131r. Dolay\u0131s\u0131yla <em>yeni sistemde Cumhurba\u015fkan\u0131n\u0131n ceza\u00ee sorumlulu\u011funun g\u00f6reviyle ilgili su\u00e7lar ile ki\u015fisel su\u00e7lar\u0131 aras\u0131nda ayr\u0131m yap\u0131lmadan d\u00fczenlendi\u011fi<\/em> a\u00e7\u0131kt\u0131r. Zaten 105\u2019inci maddenin yeni \u015feklinin gerek\u00e7esinde de bu husus a\u00e7\u0131k\u00e7a vurgulanm\u0131\u015ft\u0131r.
