Acaba kimlerden korkulmakta ve kimlere yaranmaya u\u011fra\u015f\u0131lmaktayd\u0131? Bu yanl\u0131\u015f ve haks\u0131z demeci d\u00fczeltecek ve Milli d\u00fc\u015f\u00fcnceye uygun d\u00fc\u015fecek yeni a\u00e7\u0131klamalar\u0131n\u0131 beklemek hakk\u0131m\u0131zd\u0131..<\/b><\/p>\n<p><b>\u015eimdi iz\u2019an ve insafla d\u00fc\u015f\u00fcnelim:<\/b><\/p>\n<p><b>\u201cT\u00fcrban Nazilerin fa\u015fist g\u00f6mle\u011fi ve Gamal\u0131 Ha\u00e7 i\u015fareti gibi bir simgedir\u201d (12.10.2010-H\u00fcrriyet) diye z\u0131rvalay\u0131p kinini kusan \u00d6zdemir \u0130nce ile Devlet Bah\u00e7eli\u2019nin bu yak\u0131\u015f\u0131ks\u0131z yakla\u015f\u0131m\u0131 aras\u0131nda ne fark vard\u0131?<\/b><\/p>\n<p><b>Ba\u015f\u00f6rt\u00fcs\u00fcn\u00fcn siyasi ve sosyal istismar\u0131na ve baz\u0131lar\u0131n\u0131n \u00fclkemize ve devletimize y\u00f6nelik h\u0131yanetlerini, gizli ve kirli melanetlerini t\u00fcrban taraftarl\u0131\u011f\u0131yla saklamaya \u00e7al\u0131\u015fmas\u0131na elbette kar\u015f\u0131 \u00e7\u0131k\u0131lmal\u0131 ve bunlar topluma tan\u0131t\u0131lmal\u0131yd\u0131. Ancak, temel bir insan hakk\u0131 olan ve do\u011fu\u015ftan kazan\u0131lm\u0131\u015f tabii haklardan say\u0131lan ve hi\u00e7bir yasa ile s\u0131n\u0131rland\u0131r\u0131lamayan bir inan\u00e7 \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn gere\u011fini, \u201c\u00fcniversitede yapars\u0131n, ama lisede, hastanede, devlet dairesinde ba\u015f\u0131n\u0131 kapatamazs\u0131n\u201d demek, hangi vicdanla, hangi hukukla, hangi milli duyarl\u0131l\u0131kla ba\u011fda\u015f\u0131rd\u0131? Yoksa Sn. Bah\u00e7eli bu s\u00f6zleriyle AKP\u2019ye halk nezdinde mazeret kazand\u0131rd\u0131\u011f\u0131n\u0131n ve i\u015fini kolayla\u015ft\u0131rd\u0131\u011f\u0131n\u0131n fark\u0131nda olmam\u0131\u015f m\u0131yd\u0131?<\/b><\/p>\n<p><b>Umar\u0131z ki Sn. Devlet Bah\u00e7eli bu s\u00f6zleri, \u201cAKP\u2019nin t\u00fcrban istismar\u0131yla toplumu germeye ve baz\u0131 kurumlar\u0131 \u00fcrk\u00fctmeye ve bu yolla siyasi rant dev\u015firmeye\u201d y\u00f6nelik tavr\u0131na bir tepki makam\u0131nda ve ele\u015ftiri maksad\u0131yla kullanm\u0131\u015ft\u0131r. Ve tabi baz\u0131 yazar-yorumcu tak\u0131m\u0131 ise, ba\u015f\u00f6rt\u00fcs\u00fcne derin bir h\u0131n\u00e7la sald\u0131rmaktad\u0131r. Onlara s\u00f6z\u00fcm\u00fcz: \u201c\u00d6fke ge\u00e7ici bir cinnet halidir ve sonu mutlaka nedamet ve h\u00fcsrand\u0131r.\u201d<\/b><\/p>\n<p><b>\u201cKamusal alan\u201d a\u00e7maz\u0131 ve ba\u015f\u00f6rt\u00fcs\u00fcne kar\u015f\u0131 yap\u0131lan itirazlar<\/b><\/p>\n<p>&#8220;\u0130ttihad ve Terakki&#8217;den beri \u015fahsi \u00e7\u0131karlar\u0131 i\u00e7in devlet kadrolar\u0131 \u00fczerinde tahakk\u00fcm olu\u015fturup \u00e7etele\u015fme y\u00f6n\u00fcne giden bir tak\u0131m zevat\u0131n kendilerini devletin efendisi olarak, halk\u0131 da iradesine de\u011fer verilmeyi gerektirmeyen g\u00fcd\u00fclmeye lay\u0131k k\u00f6leleri olarak g\u00f6rme zihniyeti yatmaktad\u0131r. B\u00fct\u00fcn m\u00fccadeleleri kendilerini halk\u0131n \u00fczerine \u00e7\u0131kar\u0131p her y\u00f6nden onlara tahakk\u00fcm etme imk\u00e2nlar\u0131 sunan stat\u00fckonun devam ettirilmesi ama\u00e7l\u0131d\u0131r.<\/p>\n<p>Oysa &#8220;Kamusal (common) olan bir \u015fey do\u011frudan devlete de\u011fil, halk\u0131n geneline ait oland\u0131r. Kamuoyundan (common sense) anla\u015f\u0131lan \u015fey devletin resmi g\u00f6r\u00fc\u015f\u00fc de\u011fil, halk\u0131n sa\u011fduyulu olarak sahip oldu\u011fu genel kanaattir. K\u00fcreselle\u015fen d\u00fcnyada kamusal alan \u00f6zellikle sivil toplum alan\u0131d\u0131r. Dini, inan\u00e7 ve de\u011ferleri kamusal alan\u0131n d\u0131\u015f\u0131na atma iddias\u0131, bilimsel ve sosyolojik hi\u00e7bir temeli olmayan bo\u015f iddialard\u0131r. \u0130nan\u00e7, din, tarih ve k\u00fclt\u00fcrle ba\u011flant\u0131l\u0131 ideal ve de\u011ferler bireysel boyuta sahip oldu\u011fu kadar ayn\u0131 zamanda sosyolojik boyutlar\u0131 vard\u0131r. \u00d6rne\u011fin namaz, oru\u00e7, kurban, zek\u00e2t gibi ibadetlerin ferdi boyutlar\u0131 yan\u0131nda sosyolojik boyutlar\u0131 oldu\u011fu da muhakkakt\u0131r. Bu nedenle ba\u015f\u00f6rt\u00fcs\u00fcne kar\u015f\u0131 yap\u0131lan itirazlar laikli\u011fi korumaktan \u00e7ok, devletin kamusal alan\u0131 do\u011frudan kendi alan\u0131 gibi g\u00f6rmesinden kaynaklan\u0131r. Toplumda ya\u015fayan bir \u015fahs\u0131n kimli\u011fi, sadece \u00f6zele de\u011fil kamusal alana da ait bulunmaktad\u0131r. Siville\u015fme ve demokratikle\u015fme iddias\u0131nda olan bir toplumda herkesin kendi k\u00fclt\u00fcr d\u00fcnyas\u0131nda ya\u015famas\u0131n\u0131n me\u015fru olmas\u0131 kadar, o kimsenin medeni hukuk zemininde ba\u015fkalar\u0131n\u0131n hak ve \u00f6zg\u00fcrl\u00fcklerini de g\u00f6zeterek kendi hayat tarz\u0131n\u0131 bir k\u00fclt\u00fcr d\u00fcnyas\u0131na d\u00f6n\u00fc\u015ft\u00fcrmek istemesi ola\u011fand\u0131r.<\/p>\n<p>&#8220;Ba\u015f\u00f6rt\u00fcs\u00fc ve t\u00fcrban etraf\u0131ndaki tart\u0131\u015fmalar, kamusal alan\u0131n kime ait olup olmad\u0131\u011f\u0131 konusundaki m\u00fccadelenin odak noktas\u0131n\u0131 olu\u015fturmaktad\u0131r. B\u00fct\u00fcn sivil alanlar\u0131 devlete ait k\u0131lmak isteyen laik\u00e7i jakoben zihniyetin M\u00fcsl\u00fcman kad\u0131nlar\u0131n ba\u015f\u00f6rt\u00fcs\u00fcne tahamm\u00fcls\u00fczl\u00fc\u011f\u00fc, ona zihniyetine g\u00f6re \u015fekil vermek istemesi veya onu rahip k\u0131l\u0131\u011f\u0131yla \u00f6zde\u015fle\u015ftirerek \u00f6rt\u00fcnmenin sanki \u0130sl\u00e2m&#8217;\u0131n bir emri \/ \u015fiar\u0131 olmay\u0131p H\u0131ristiyanl\u0131ktan \u0130sl\u00e2m d\u00fcnyas\u0131na intikal edip dev\u015firilen yabanc\u0131 bir unsur gibi g\u00f6sterme gayretlerinin alt\u0131nda bu m\u00fccadele yatmaktad\u0131r. Ne yaz\u0131k ki s\u00f6z konusu tart\u0131\u015fmalarda, do\u011frulu\u011fu Kur&#8217;an ve S\u00fcnnetle, Hz. Peygamber, Sahabe ve Tabiun d\u00f6neminden g\u00fcn\u00fcm\u00fcze kadar uzanan kesintisiz bir gelene\u011fin \u015fahitli\u011fi ile sabit olan konu, demokratikle\u015fmenin kar\u015f\u0131s\u0131nda yer alarak stat\u00fckonun yan\u0131nda taraf tutan bir tak\u0131m ilahiyat\u00e7\u0131 s\u0131fat\u0131n\u0131 ta\u015f\u0131yan zevat\u0131n indi ve keyfi yorumlar\u0131yla suland\u0131r\u0131l\u0131p de\u011fersizle\u015ftirilmeye \u00e7al\u0131\u015f\u0131lmaktad\u0131r.&#8221;<a href=\"#_ftn1\" name=\"_ftnref1\"><sup><sup>[1]<\/sup><\/sup><\/a><\/p>\n<p>\u201cBa\u015f\u00f6rt\u00fcl\u00fc kad\u0131nlar y\u00f6netime giremese de en az\u0131ndan &#8220;kocalar\u0131&#8221; y\u00f6netime girebiliyor\u201d diye h\u0131r\u00e7\u0131nla\u015fan CHP\u2019nin de, ordu i\u00e7indeki baz\u0131 beylerin de bu ger\u00e7e\u011fi art\u0131k i\u00e7ine sindirebilmesi laz\u0131md\u0131r.<\/p>\n<p>CHP\u2019nin, \u00c7ankaya&#8217;da verilen resepsiyona kat\u0131lmamas\u0131, generallerin &#8220;alternatif&#8221; bir resepsiyon yapmas\u0131, b\u00f6ylece &#8220;kamusal alanda&#8221; ba\u015f\u0131 \u00f6rt\u00fcl\u00fc bir kad\u0131n\u0131n elini s\u0131kmaktan kurtulmaya \u00e7al\u0131\u015fmalar\u0131, en az\u0131ndan ay\u0131pt\u0131r ve \u00fclkemiz i\u00e7in kay\u0131pt\u0131r. Halk\u0131n\u0131n \u00e7o\u011funlu\u011funun hayat tarz\u0131n\u0131 reddeden ordu nas\u0131l &#8220;milli ordu&#8221; olacak, halk\u0131n\u0131n yar\u0131s\u0131n\u0131 kamusal alanda g\u00f6rmek istemedi\u011fini a\u00e7\u0131klayan CHP o halktan nas\u0131l oy alacak da iktidara ta\u015f\u0131nacakt\u0131r?<\/p>\n<p><b>Diyanet\u2019in, 1980 ve 1993 tarihli fetvalar\u0131, \u201cba\u015f\u00f6rt\u00fcs\u00fc \u0130slam\u2019\u0131n emri\u201d do\u011frultusundayd\u0131<\/b><\/p>\n<p><b>CHP, fetva soracakm\u0131\u015f!<\/b><\/p>\n<p>Referandum \u00f6ncesi ba\u015f\u00f6rt\u00fcs\u00fc sorununu \u00e7\u00f6zmek i\u00e7in harekete ge\u00e7ti\u011fini a\u00e7\u0131klayan CHP\u2019nin, konuyu&#8217; Din adamlar\u0131na&#8217; sormaya haz\u0131rland\u0131\u011f\u0131 bas\u0131na yans\u0131m\u0131\u015ft\u0131. Bug\u00fcne kadar ba\u015f\u00f6rt\u00fcs\u00fcne ve inan\u00e7 h\u00fcrriyetine kar\u015f\u0131 ters bir tav\u0131r sergileyen CHP&#8217;nin yeni giri\u015fimi hi\u00e7 de samimi bulunmam\u0131\u015ft\u0131.<\/p>\n<p>Konuyu hukuk\u00e7ular\u0131n yan\u0131 s\u0131ra din adamlar\u0131na soracak olan CHP&#8217;ye Diyanet&#8217;in ba\u015f\u00f6rt\u00fcs\u00fc konusunda verdi\u011fi iki fetva hat\u0131rlat\u0131lm\u0131\u015ft\u0131. Din \u0130\u015fleri Y\u00fcksek Kurulu, 1980 ve 1993 y\u0131llar\u0131nda, kad\u0131n k\u0131yafeti ve tesett\u00fcr konusunda verdi\u011fi fetvalarda; kad\u0131nlar\u0131n ba\u015f\u0131n\u0131 \u00f6rtmesi Kur&#8217;an-\u0131 Kerim&#8217;in a\u00e7\u0131k ve tart\u0131\u015fmas\u0131z emri oldu\u011funu belirterek, karar\u0131n kayna\u011f\u0131n\u0131 ise, kitap, s\u00fcnnet ve \u0130slam \u00e2limlerinin ittifak\u0131na dayand\u0131rm\u0131\u015ft\u0131.<\/p>\n<p><b>Y\u0131l 1980: \u201cT\u00fcrban, \u0130slam dininin bir h\u00fckm\u00fc\u201d karar\u0131<\/b><\/p>\n<p>16 ki\u015filik uzman heyetten olu\u015fan Diyanet&#8217;e ba\u011fl\u0131 Din \u0130\u015fleri Y\u00fcksek Kurulu, tesett\u00fcr konusundaki ilk karar\u0131n\u0131 30.12.1980 tarihinde alm\u0131\u015ft\u0131.<\/p>\n<p>Mill\u00ee E\u011fitim Bakanl\u0131\u011f\u0131&#8217;n\u0131n \u0130mam Hatip Liselerinde okuyan k\u0131z \u00f6\u011frencilerin k\u0131yafetlerinin nas\u0131l olaca\u011f\u0131na karar vermek i\u00e7in g\u00f6r\u00fc\u015f sormas\u0131 \u00fczerine Kurul, cevabi yaz\u0131s\u0131nda M\u00fcsl\u00fcman kad\u0131n\u0131n Kur&#8217;an-\u0131 Kerim, hadis ve \u00e2limlerin g\u00f6r\u00fc\u015fleri do\u011frultusunda ba\u015flar\u0131n\u0131 \u00f6rtmesinin dini bir vecibe oldu\u011fu vurgulanm\u0131\u015ft\u0131.<\/p>\n<p>&#8220;M\u00fcsl\u00fcman han\u0131mlar\u0131n ba\u015flar\u0131n\u0131 kapatmalar\u0131, v\u00fccutlar\u0131n\u0131n el, y\u00fcz ve ayaklar d\u0131\u015f\u0131nda kalan k\u0131s\u0131mlar\u0131n\u0131, aralar\u0131nda dinen evlenme caiz olan yabanc\u0131 erkekler yan\u0131nda a\u00e7\u0131k bulundurmamalar\u0131, baz\u0131 \u00e7evrelerce san\u0131ld\u0131\u011f\u0131 gibi belli z\u00fcmrenin sonradan ortaya \u00e7\u0131kard\u0131\u011f\u0131 bir adet veya i\u015faret de\u011fil, \u0130sl\u00e2m Dini&#8217;nin bir h\u00fckm\u00fcd\u00fcr&#8221; denilen 1980 tarihli kararda, Atat\u00fcrk&#8217;\u00fcn tesett\u00fcre ili\u015fkin \u015fu s\u00f6zlerine at\u0131flar yap\u0131lm\u0131\u015ft\u0131.<\/p>\n<p><b><i>&#8220;E\u011fer kad\u0131nlar\u0131m\u0131z \u015eer&#8217;in tavsiye ve dinin emretti\u011fi bir k\u0131yafetle, faziletin icabetti\u011fi tavru hareketle i\u00e7imizde bulunur, milletin ilim sanat, ictimaiyyat hareketlerine i\u015ftirak ederse bu hali, emin olunuz, milletin en mutaass\u0131b\u0131 dahi men&#8217;-i nefs edemez&#8221;.<\/i><\/b><\/p>\n<p>Kurul, Atat\u00fcrk&#8217;\u00fcn M\u00fcsl\u00fcman T\u00fcrk kad\u0131n\u0131n\u0131n k\u0131yafeti konusunda benimsedi\u011fi bu fikirlerine ayk\u0131r\u0131 bir s\u00f6z\u00fcne rastlanmad\u0131\u011f\u0131 da hat\u0131rlat\u0131lm\u0131\u015ft\u0131.<\/p>\n<p>Kurul, &#8220;Atat\u00fcrk&#8217;\u00fc ve ilkelerini, -\u00e7o\u011fu zaman yap\u0131ld\u0131\u011f\u0131 gibi- dinimizin kad\u0131n k\u0131yafetiyle ilgili h\u00fck\u00fcmlerine kar\u015f\u0131 g\u00f6stermek, memleketimiz yararlar\u0131n\u0131n g\u00f6zetilmesi ve Atat\u00fcrk ilkelerinin benimsenmesi a\u00e7\u0131s\u0131ndan son derece sak\u0131ncal\u0131 bir tutumdur.
