Anayasalar\u0131n; adil, milli, ger\u00e7ek\u00e7i ve yeterli olmas\u0131 beklenir. Elbette bir \u00fclkede hukukun ve huzurun h\u00e2kim olmas\u0131 i\u00e7in, sadece anayasalar\u0131n do\u011fru ve doyurucu olmas\u0131 yetmeyecektir; ilgili kanunlar\u0131n ve bunlar\u0131 uygulayanlar\u0131n da vicdani d\u00fcr\u00fcstl\u00fc\u011fe ula\u015fmas\u0131 gerekir. Yani sadece metrenin ve terazinin d\u00fczg\u00fcn olmas\u0131 yetmez, onu kullanan elin de d\u00fcr\u00fcst olmas\u0131 laz\u0131m gelir.<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\"><strong>Haz\u0131rlanan yeni anayasa \u015fu \u00f6zellikleri ta\u015f\u0131mayacaksa, ondan hay\u0131rl\u0131 sonu\u00e7lar beklemek bo\u015funad\u0131r:<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\"><strong>1- Bu anayasa; temel insan haklar\u0131na, evrensel hukuk kurallar\u0131na ve \u00e7a\u011fda\u015f ya\u015fam standartlar\u0131na uygun haz\u0131rlanmal\u0131d\u0131r.<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\"><strong>2- Ancak <em>\u201cK\u00fcreselle\u015fme, d\u00fcnya ile b\u00fct\u00fcnle\u015fme, demokratik ve laik \u00e7\u0131talar\u0131 y\u00fckseltme\u201d<\/em> gibi jelatinli k\u0131l\u0131flar\u0131n arkas\u0131na s\u0131\u011f\u0131narak \u00fclkemizi; Emperyalist ve Siyonist Gizli D\u00fcnya Devleti\u2019nin g\u00fcd\u00fcm\u00fcne sokacak, Milli h\u00e2kimiyet ve h\u00fcrriyet d\u00fc\u015f\u00fcncesinden koparacak ve Ha\u00e7l\u0131 AB\u2019nin himayesine ta\u015f\u0131yacak <em>\u201ctuzak kavramlardan\u201d<\/em> mutlaka sak\u0131n\u0131lmal\u0131d\u0131r.<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\"><strong>3- Yeni anayasa; her t\u00fcrl\u00fc pe\u015fin \u00f6nyarg\u0131lardan ve ideolojik saplant\u0131lardan uzak, ilmi ve insani de\u011ferlere uygun yaz\u0131lmal\u0131d\u0131r.<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\"><strong>4- Toplumun; farkl\u0131 din ve d\u00fc\u015f\u00fcnceden her kesimin \u00f6zg\u00fcrl\u00fck ve beklentilerini kar\u015f\u0131lamak, herkesin \u00f6zg\u00fcvenini ve onurlu ya\u015fam garantisini sa\u011flayacak olmakla birlikte, milletimizin kahir ekseriyetini olu\u015fturan insanlar\u0131m\u0131z\u0131n inanc\u0131na, ihtiyac\u0131na ve ortak amac\u0131na uygun bir anayasa olmas\u0131 esast\u0131r; aksi halde Milli b\u00fcnyeye uyum sa\u011flayamad\u0131\u011f\u0131ndan, e\u011freti bir elbise gibi kalacakt\u0131r.<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\"><strong>5- Anayasa mutlaka \u201cMilli\u201d olmal\u0131d\u0131r. Yani toplumun ananevi ve ailevi miras\u0131na, dini ve ahl\u00e2ki yap\u0131s\u0131na, tarihi ve tabii dokusuna ve Lider \u00dclke olma arzusuna olumlu yan\u0131t verecek, yani do\u011fal ve sosyal kanunlara m\u00fcnasip d\u00fc\u015fecek bir i\u00e7erikte tasarlanmal\u0131d\u0131r.<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\"><strong>6- \u00dclkemiz ve Milletimiz \u00fczerindeki sinsi emelleri \u00f6teden beri bilinen Ha\u00e7l\u0131 zihniyetiyle \u015fekillenen; <em>\u201cAB\u2019ye uyum s\u00fcrecine\u201d<\/em> ve Siyonist s\u00f6m\u00fcr\u00fc sermayesinin d\u00fcnyay\u0131 ele ge\u00e7irme projesi olan; <em>\u201ck\u00fcreselle\u015fme ser\u00fcvenine\u201d <\/em>kolayl\u0131k sa\u011flamak ve me\u015fruiyet kazand\u0131rmak niyetiyle yap\u0131lacak bir anayasa, pe\u015finen bir \u201cana-tasa\u201d, yani huzursuzluk kayna\u011f\u0131 olacakt\u0131r.<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\"><strong>7- Haz\u0131rlanacak yeni anayasa, hassas dengeleri ve Cumhuriyet de\u011ferlerini g\u00f6zetip kollayacak bir duyarl\u0131l\u0131k ve tutarl\u0131l\u0131k ta\u015f\u0131mal\u0131d\u0131r.<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\"><strong>8- Anayasa metninde \u00e7ok farkl\u0131 ve ayk\u0131r\u0131 bi\u00e7imlerde yorumlanmaya m\u00fcsait, g\u00fc\u00e7 ve iktidar \u00e7evrelerince kendilerine g\u00f6re yozla\u015ft\u0131r\u0131lmaya m\u00fcnasip bulunan kapal\u0131 ve karma\u015f\u0131k ifadelerden uzak durulmal\u0131; a\u00e7\u0131k ve anla\u015f\u0131l\u0131r bir dil kullan\u0131lmal\u0131d\u0131r.<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\"><strong>9- T\u00fcrkiye Cumhuriyeti\u2019nin uluslararas\u0131 tapusu konumundaki Lozan Anla\u015fmas\u0131\u2019n\u0131n kazan\u0131mlar\u0131n\u0131 geri alacak, ertelenmi\u015f Sevr\u2019in dayatmalar\u0131n\u0131 hortlatacak ve Lozan\u2019\u0131n gizli maddelerine resmiyet kazand\u0131racak terim ve tavizlere asla yana\u015fmamal\u0131d\u0131r.<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\"><strong>De\u011fi\u015fim Anayasas\u0131 ve Genel Esaslar\u0131<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\"><strong>Adil ve \u00e7a\u011fda\u015f bir anayasan\u0131n en \u00f6nemli \u00f6zelli\u011fi: <em>Temel hak ve h\u00fcrriyetleri de\u011fil, \u00f6zel g\u00f6rev ve yetki alanlar\u0131n\u0131 ve genel sorumluluklar\u0131 saymas\u0131d\u0131r.<\/em> \u00c7\u00fcnk\u00fc hak ve h\u00fcrriyetler s\u0131n\u0131rs\u0131zd\u0131r ve do\u011fald\u0131r, yani do\u011fu\u015ftan kazan\u0131lm\u0131\u015ft\u0131r. Bu nedenle ayr\u0131ca ve kanunla say\u0131lmalar\u0131 anlams\u0131zd\u0131r. Yasalar; sadece vatanda\u015flar\u0131n g\u00f6rev taksimat\u0131n\u0131, y\u00fck\u00fcml\u00fcl\u00fck ve sorumluluk \u015fartlar\u0131n\u0131 ortaya koymal\u0131, \u00e7ok a\u00e7\u0131k ve net ifadeler kullan\u0131lmal\u0131d\u0131r.<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\"><strong>Milli \u015euur istikametinde daha \u00f6nce haz\u0131rlanan &#8220;Yeni Anayasa Tasar\u0131lar\u0131n\u0131n Temel Esaslar\u0131yla&#8221; ilgili \u00f6neri ve \u00f6rnekleri;<\/strong> <strong>\u2022Ciddi ve cesaretli, \u2022\u0130lmi ve asri, \u2022\u0130nsani ve \u0130slami olmakla beraber; yanl\u0131\u015f anla\u015f\u0131lmalara, haks\u0131z h\u00fccumlara ve kas\u0131tl\u0131 \u00e7arp\u0131t\u0131lmalara m\u00fcsait ifadeler i\u00e7ermekte, hatta bazen yersiz ve gereksiz teklifler getirmektedir. Bunlar\u0131 tek tek ele al\u0131p tenkit ve tahlil etmek \u00e7ok zaman alaca\u011f\u0131ndan ve uzun yer kaplayaca\u011f\u0131ndan, biz Milli \u00c7\u00f6z\u00fcm \u0130lmi Ara\u015ft\u0131rma Ekibi olarak sadece \u00f6nemli g\u00f6rd\u00fc\u011f\u00fcm\u00fcz baz\u0131 d\u00fczeltme ve eklemelerle ve \u00f6zet halinde bir d\u00fczenlemeyi okurlar\u0131m\u0131za, ilgili kurum ve \u015fah\u0131slara aktarmakla yetinece\u011fiz.<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\"><strong>A- T\u00fcrk Ulusu Tan\u0131mlanmal\u0131d\u0131r.<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\"><strong>Ulussuz devlet olmaz. T\u00fcrkiye devleti T\u00fcrk ulusunundur. Bu da tart\u0131\u015f\u0131lamaz. Yapaca\u011f\u0131m\u0131z tek \u015fey, T\u00fcrk ulusunun kimlerden olu\u015ftu\u011funu belirtmektir. Ama bu durum \u00f6zelde, \u00f6rne\u011fin &#8220;Ben K\u00fcrd\u00fcm&#8221; demeye engel say\u0131lmamak. \u00c7\u00fcnk\u00fc \u0131rk\u0131n de\u011fil, ulusun alt kimlikleri olabilir; olacakt\u0131r da.<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\"><strong>B- <\/strong><strong>Laiklik tan\u0131mlanmal\u0131 ve herkesin anlayaca\u011f\u0131 bir T\u00fcrk\u00e7e ile yaz\u0131lmal\u0131d\u0131r.<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\"><strong>Anayasam\u0131z\u0131n 24. maddesi laikli\u011fin temel esaslar\u0131n\u0131 ortaya koymaktad\u0131r. Ama &#8220;mu\u011fl\u00e2k-kapal\u0131&#8221;d\u0131r ve istismara m\u00fcsait durumdad\u0131r. Oysa Anayasa h\u00fck\u00fcmlerinin, okuyan herkesin ayn\u0131 \u015feyleri anlayaca\u011f\u0131 bi\u00e7imde a\u00e7\u0131k, net ve kesin bir dille ve T\u00fcrk\u00e7e yaz\u0131lmas\u0131 esast\u0131r. Bu nedenle \u201cLaiklik\u201din 24. maddedeki temel esaslara uygun olarak yeniden ve T\u00fcrk\u00e7e yaz\u0131lmas\u0131, farkl\u0131 kesim ve g\u00f6r\u00fc\u015flerden uzmanlar\u0131n ortak bir konsens\u00fcsle ortaya koyaca\u011f\u0131 bir tan\u0131m\u0131n haz\u0131rlanmas\u0131, art\u0131k zorunlu bir ihtiya\u00e7t\u0131r.<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">a- <strong>\u00c7\u00fcnk\u00fc 24. Burada; <strong>&#8220;veya&#8221; <\/strong>yerine <strong>&#8220;ve&#8221; <\/strong>kullan\u0131larak, <strong><em>\u201cistismar\u0131n, a\u00e7\u0131k\u00e7a k\u00f6t\u00fcye kullanmak\u201d <\/em><\/strong>oldu\u011fu belirtilmi\u015ftir. Oysa bug\u00fcn laiklik tamamen farkl\u0131 yorumlanmaktad\u0131r. Ve her t\u00fcrl\u00fc istismar ve suiistimale a\u00e7\u0131k bulunmaktad\u0131r. Hem din istismarc\u0131lar\u0131 hem devrim simsarlar\u0131, bu kapal\u0131 laiklik maddesini, kendilerine uydurmaya ve bask\u0131 unsuru olarak uygulamaya \u00e7al\u0131\u015fmaktad\u0131r.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\"><strong>C- H\u00e2kimlik sistemi uygulanmal\u0131, ama bunun yan\u0131nda, <em>\u201cHakemlik sistemi\u201d<\/em> de olu\u015fturulmal\u0131d\u0131r.<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">Yeterli hukuk tahsili yapm\u0131\u015f, kendi sahas\u0131nda uzmanla\u015fm\u0131\u015f kimselere, devlet taraf\u0131ndan, bug\u00fcnk\u00fc avukatl\u0131k ve h\u00e2kimlik kar\u015f\u0131l\u0131\u011f\u0131 HAKEM\u2019lik yetkisi verilecek ve maa\u015flar\u0131 b\u00fct\u00e7eden \u00f6denecektir. O zaman t\u00fcm dokunulmazl\u0131klar kald\u0131r\u0131labilir. Kas\u0131tl\u0131, yanl\u0131 ve hukuka ayk\u0131r\u0131 karar veren hakemlerin yetkilerine son verilmeli, her t\u00fcrl\u00fc devlet g\u00f6revlerinden ve \u015fahitlikten menedilmelidir.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\"><strong>\u00c7- \u015eu maddeler Anayasa\u2019da yer almal\u0131d\u0131r:<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\"><strong>1- <em>Faizin her t\u00fcrl\u00fcs\u00fc kald\u0131r\u0131lm\u0131\u015ft\u0131r<\/em>. Sava\u015f h\u00e2li, haklar\u0131n k\u0131smen veya tamamen ask\u0131ya al\u0131nmas\u0131n\u0131 gerektirebilir. <\/em><\/strong>Sava\u015f h\u00e2linde cephe komutan\u0131n\u0131n b\u00fct\u00fcn emirleri kanun h\u00fckm\u00fcndedir. Bu konularda da Meclis\u2019e kar\u015f\u0131 sorumlu tutulmaktad\u0131r. H\u00fck\u00fcmet, Ordunun Ba\u015fkomutan\u0131 olmad\u0131\u011f\u0131ndan, emretme yetkisi bulunmamaktad\u0131r. Ama Genelkurmay Ba\u015fkan\u0131 ona ba\u011fl\u0131d\u0131r. Yani sava\u015f ve savunmay\u0131 haz\u0131rlamakla y\u00fck\u00fcml\u00fc olan kurum, amir de\u011fildir. O halde onun emrinde haz\u0131rl\u0131k yapar demektir. Mill\u00ee G\u00fcvenlik Kurulu da bu emri verir demektir. Ama \u00f6b\u00fcr taraftan sorumluluk H\u00fck\u00fcmete aittir. B\u00fct\u00fcn bunlar \u00e7eli\u015fkidir, belirsizliktir ve giderilmesi gerekir. Savunman\u0131n \u00e7al\u0131\u015fmalar\u0131 ve b\u00fct\u00e7eleri ayr\u0131d\u0131r. Yasa ile d\u00fczenlenmi\u015ftir. Meclis sadece ona gelir sa\u011flayan kaynaklar\u0131 belirler. Ondan sonra genel b\u00fct\u00e7ede yer almaz. Planlamada asker-sivil uzla\u015ft\u0131r\u0131l\u0131r. T\u00fcm haz\u0131rl\u0131k ve e\u011fitim, ordu taraf\u0131ndan yap\u0131l\u0131r ve ordu komutanlar\u0131n\u0131n yetkisindedir. Sava\u015f, seferberlik ile ordular aras\u0131 veya ordularla sivil y\u00f6netim aras\u0131nda \u00e7\u0131kacak ihtilafl\u0131 kararlar\u0131 Devlet Ba\u015fkan\u0131 giderir. Bu nedenle, Genelkurmay Ba\u015fkan\u0131n\u0131n da do\u011frudan Devlet Ba\u015fkan\u0131na ba\u011flanmas\u0131 gerekir.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\"><strong>Silahl\u0131 G\u00fc\u00e7 Kullan\u0131lmas\u0131:<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\"><strong><em>Sava\u015f veya benzeri hallerde H\u00fck\u00fcmet Meclis\u2019ten izin almal\u0131d\u0131r.<\/em><\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">Bug\u00fcnk\u00fc sistemde, s\u00f6zde Ba\u015fkomutan Cumhurba\u015fkan\u0131d\u0131r; H\u00fck\u00fcmet Meclis\u2019ten onay alsa bile, Cumhurba\u015fkan\u0131 emir vermedik\u00e7e asker harek\u00e2t yapamaz. T\u00fcrkiye&#8217;de tezatlar ve \u00e7\u0131kmazlar vard\u0131r. \u00d6rne\u011fin 2006\u2019da, L\u00fcbnan&#8217;a asker g\u00f6ndermeye Cumhurba\u015fkan\u0131 kar\u015f\u0131 oldu\u011fu halde g\u00f6nderildi, bu yanl\u0131\u015ft\u0131r. H\u00fck\u00fcmet sava\u015fa veya benzer eyleme tek ba\u015f\u0131na karar veremez, bunu Meclis\u2019ten ge\u00e7irmekle yetinemez. Son kararda Devlet Ba\u015fkan\u0131n\u0131n onay\u0131 \u015fartt\u0131r. Meclis, isterse Cumhurba\u015fkan\u0131n\u0131 g\u00f6revden alabilir, ama Devlet Ba\u015fkan\u0131 ba\u015fta kald\u0131k\u00e7a t\u00fcm sava\u015f yetkisi onun emrindedir. \u00c7\u00fcnk\u00fc iktidar tecezzi (par\u00e7alanma) kabul etmez. <strong>Mustafa Kemal&#8217;in<\/strong> kuvvetler birli\u011fi ilkesi budur. Yoksa <strong><em>\u201cokullarda herkes \u015fu k\u0131yafeti giyecek, bunu giyemeyecek\u201d<\/em><\/strong> meselesi, kuvvetler birli\u011fi ile ili\u015fkisi olan bir \u015fey de\u011fildir. Bu tav\u0131rlar, devlete ve askere olan g\u00fcveni zedeleyecek ve zarar verecektir.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\"><strong>\u015eu andaki mevcut yasalarda:<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\"><strong><em>\u201cBakanlar Kurulu sava\u015fla ilgili her t\u00fcrl\u00fc haz\u0131rl\u0131\u011f\u0131 yapmak, Genelkurmay\u0131n talebi \u00fczerine, imk\u00e2nlar\u0131 onun <\/em><\/strong><strong><em>emrine vermek\u201d <\/em><\/strong>durumundad\u0131r. Burada belirsiz bir husus vard\u0131r. H\u00fck\u00fcmet mi Genelkurmay\u0131n emrindedir, yoksa Genelkurmay m\u0131 H\u00fck\u00fcmetin emrindedir, belli de\u011fildir. Sava\u015f veya seferberlik karar\u0131n\u0131 kim verecektir? Cumhurba\u015fkan\u0131 m\u0131, yoksa H\u00fck\u00fcmet mi, belli de\u011fildir. \u00d6nce H\u00fck\u00fcmet ile Genelkurmay Ba\u015fkanl\u0131\u011f\u0131; ikisi Devlet Ba\u015fkan\u0131na ba\u011fl\u0131 olacakt\u0131r. Sava\u015fla ilgili kararlar\u0131 H\u00fck\u00fcmet de\u011fil, Cumhurba\u015fkan\u0131 almal\u0131d\u0131r.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\"><strong>Ba\u015fkomutanl\u0131k makam\u0131 ve sorumluluklar\u0131:<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\"><strong><em>Sava\u015fta; yasama organ\u0131, (Meclis) H\u00fck\u00fcmet ve Cumhurba\u015fkan\u0131, hi\u00e7biri devre d\u0131\u015f\u0131 olmayacak birlikte sorumluluk alacaklard\u0131r. <\/em><\/strong>\u00c7\u00fcnk\u00fc sava\u015f\u0131n kazan\u0131lmas\u0131 i\u00e7in do\u011fal kanunlar vard\u0131r:<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">a) Erken davranan sava\u015f\u0131 kazan\u0131r. Kim teti\u011fi erken \u00e7ekerse o ya\u015fayacak, kar\u015f\u0131 taraf yok olacakt\u0131r.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">b) Birlikte hareket eden ordu galip gelip zafere ula\u015facakt\u0131r. Tek kuvvet olmayan ve ayn\u0131 merkezden emir almayan ordu, d\u00fc\u015fman kar\u015f\u0131s\u0131nda \u015fa\u015f\u0131racak ve bozguna u\u011frayacakt\u0131r.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">c) D\u00fc\u015fman\u0131n bilmedi\u011fi ve beklemedi\u011fi bir tarzda vurmak \u015fartt\u0131r. Yeni (stratejik ve teknolojik) silahlarla vurmak laz\u0131md\u0131r. Bu da gizlilikle ve ekonomik g\u00fc\u00e7le al\u00e2kal\u0131d\u0131r.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">d) Savunmada sab\u0131rl\u0131 olmak, uzun zaman dayanmak ve sebatl\u0131 davranmak sonucu belirleyecek en \u00f6nemli unsurlard\u0131r. Maneviyats\u0131z bir ordu \u00e7abuk da\u011f\u0131lacakt\u0131r.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\">Bu da Ordunun kendi ikmalini kendisinin yapmas\u0131 ile al\u00e2kal\u0131d\u0131r. Napolyon&#8217;un s\u00f6z\u00fc var; <strong><em>&#8220;Sava\u015f kendisini finanse etmekle kazan\u0131l\u0131r.&#8221; <\/em><\/strong>Sava\u015f ortam\u0131nda H\u00fck\u00fcmetler bir\u00e7ok konuda devre d\u0131\u015f\u0131 kalsa da genel takip ve strateji karar\u0131n\u0131 onlar almal\u0131d\u0131r. Peki, Meclis\u2019in durumu ne olacakt\u0131r? \u0130\u015fte sava\u015f h\u00e2li, Meclis\u2019in bile Cumhurba\u015fkan\u0131n\u0131n emrine girdi\u011fi bir durum ortaya \u00e7\u0131karmaktad\u0131r. Aksi halde sava\u015f\u0131n kaybedilmesi riski vard\u0131r. Ancak Meclis de yarg\u0131 denetimine girmelidir. Yoksa ger\u00e7ek bir hukuk devleti olmam\u0131z m\u00fcmk\u00fcn de\u011fildir. Meclis\u2019in i\u00e7inde hakemler se\u00e7ilmeli, y\u00fcce divan onlardan meydana gelmelidir. Bu <strong>Y\u00fcce Divan<\/strong> i\u00e7in partiler birer hakem se\u00e7meli, ba\u015fhakemi de sonradan hakemler kendi aras\u0131ndan se\u00e7melidir. Y\u00fcksek Yarg\u0131 Ba\u015fkanlar\u0131 da bu Y\u00fcce Divan\u0131n do\u011fal \u00fcyeleri kabul edilmelidir. Her konu i\u00e7in olu\u015fturulan y\u00fcce divan\u0131n kararlar\u0131 kesindir. Bu hem yarg\u0131 denetimini ger\u00e7ekle\u015ftirecek, hem de Meclis\u2019in h\u00e2kimiyetine zarar vermeyecektir.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\"><strong>b) Vahdet-i Kuvva&#8217;n\u0131n ikinci aya\u011f\u0131 tek ordudur, mill\u00ee silahl\u0131 kuvvetlerdir.<\/strong> Orduda birlik sa\u011flanmal\u0131d\u0131r. Bunun i\u00e7in Cumhurba\u015fkan\u0131 askerlerin de tasvibiyle se\u00e7ilip ordu komutanlar\u0131 do\u011frudan ona ba\u011flanmal\u0131d\u0131r. Fiilen <strong>Ba\u015fkomutan <\/strong>asker destekli Devlet Ba\u015fkan\u0131 olmal\u0131d\u0131r. T\u00fcrkiye&#8217;nin on iki b\u00f6lgesine on iki ordu yerle\u015ftirmek yararl\u0131d\u0131r. Bu ordular\u0131n askerleri o b\u00f6lgeden olmayan halktan olu\u015fmal\u0131d\u0131r. Herkese kendi b\u00f6lgesi d\u0131\u015f\u0131ndaki bir orduyu se\u00e7me hakk\u0131 tan\u0131nmal\u0131d\u0131r. B\u00f6ylece hem demokratik ordu olu\u015facak, hem de d\u00fczenli ve disiplinli silahl\u0131 kuvvetler g\u00fc\u00e7 kazanacakt\u0131r.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial, helvetica, sans-serif;\"><strong>c) Vahdet-i Kuvva&#8217;n\u0131n \u00fc\u00e7\u00fcnc\u00fc aya\u011f\u0131 ise merkezi y\u00f6netimdir.<\/strong> B\u00f6lgelerin y\u00f6netimi merkezi olmal\u0131d\u0131r. Ordular\u0131n konu\u015fland\u0131\u011f\u0131 illerin y\u00f6netiminde asker de s\u00f6z sahibi yap\u0131lmal\u0131d\u0131r. Ama ta\u015fra iller tamamen serbest siyasete b\u0131rak\u0131lmal\u0131d\u0131r. Kendi meclisleri olmal\u0131, kendi Ba\u015fkanlar\u0131 se\u00e7imle kazanmal\u0131d\u0131r. Ama \u00f6zel okullarda, T\u00fcrk\u00e7e esas olmak \u00fczere farkl\u0131 dilde \u00f6zel \u00f6\u011frenim serbest olabilir. Millete vaatlerini ve s\u00f6z verdikleri zaman i\u00e7erisinde yerine getirmeyen iktidar ve ortaklar\u0131, yap\u0131lacak bir iki uyar\u0131 da dikkate al\u0131nmay\u0131nca, iktidarlar\u0131 sonland\u0131r\u0131lacak, milletin 3-4 y\u0131l boyunca bunlara mecburen katlanmas\u0131na f\u0131rsat tan\u0131nmayacakt\u0131r.
