Adalet Divan\u0131\u2019n\u0131n g\u00f6revi, Avrupa anla\u015fmalar\u0131n\u0131n yasaya uygun bi\u00e7imde yorumlanmas\u0131 ve uygulanmas\u0131n\u0131 sa\u011flamakt\u0131r. \u00dcye devletlerin anla\u015fmalarda \u00f6ng\u00f6r\u00fclen y\u00fck\u00fcml\u00fcl\u00fckleri yerine getirip getirmediklerinin karara ba\u011flanmas\u0131, ulusal mahkemelerin ba\u015fvurusu \u00fczerine topluluk hukukuna ili\u015fkin \u00e7e\u015fitli konular\u0131n yorumlanmas\u0131 ya da ge\u00e7erlili\u011fi hakk\u0131nda \u00f6n kararlar al\u0131nmas\u0131 bu kurulu\u015fun yetkileri aras\u0131ndad\u0131r. Hukuki bir i\u015flemin tart\u0131\u015fmal\u0131 bir konu do\u011furmas\u0131 halinde ulusal mahkemelerden herhangi biri Avrupa Adalet Divan\u0131\u2019ndan \u00f6n karar isteyebiliyor. Ancak bunun yap\u0131labilmesi i\u00e7in \u00fcye devlette daha y\u00fcksek bir temyiz mercii bulunmamas\u0131 gerekiyor. Ve Divan karar\u0131 ba\u011flay\u0131c\u0131 oluyor.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial,helvetica,sans-serif;\">Avrupa Adalet Divan\u0131(AAD), merkezi Strazburg\u2019da olan ve Avrupa Konseyi\u2019nin bir kurumu olan Avrupa \u0130nsan Haklar\u0131 Mahkemesi (A\u0130HM) ve merkezi Lahey\u2019de olan Uluslararas\u0131 Adalet-UAD- ile kar\u0131\u015ft\u0131r\u0131lmamal\u0131d\u0131r<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial,helvetica,sans-serif;\">Avrupa \u0130nsan Haklar\u0131 Mahkemesi (A\u0130HM), uluslararas\u0131 bir te\u015fkilat olan Avrupa Konseyi\u2018ne ba\u011fl\u0131 olarak kurulmu\u015f uluslararas\u0131 bir mahkeme konumundad\u0131r. Mahkeme, Avrupa \u0130nsan Haklar\u0131 S\u00f6zle\u015fmesi ve ek protokolleriyle g\u00fcvence alt\u0131na al\u0131nm\u0131\u015f olan temel haklar\u0131n \u00e7i\u011fnenmesi durumunda bireylerin, birey gruplar\u0131n\u0131n, t\u00fczel ki\u015filiklerin ve di\u011fer devletlerin, belirli usul\u00ee kurallar d\u00e2hilinde ba\u015fvurabilece\u011fi bir yarg\u0131 organ\u0131d\u0131r. Avrupa Konseyi\u2018ne \u00fcye olan ve aralar\u0131nda T\u00fcrkiye, Rusya, S\u0131rbistan, G\u00fcrcistan ve Azerbaycan\u2019\u0131n da bulundu\u011fu 47 Avrupa devleti, Avrupa \u0130nsan Haklar\u0131 Mahkemesi\u2019nin yarg\u0131 yetkisini tan\u0131maktad\u0131r.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial,helvetica,sans-serif;\">Uluslararas\u0131 Adalet Divan\u0131-UAD- :Bu ise, BM\u2019nin ba\u015fl\u0131ca yarg\u0131 organ\u0131d\u0131r. Uluslararas\u0131 Adalet Divan\u0131\u2019n\u0131n merkezi Hollanda\u2019n\u0131n Lahey kentinde bulunmaktad\u0131r. Genel Kurul ve G\u00fcvenlik Konseyi\u2019nden se\u00e7ilen 15 yarg\u0131\u00e7tan olu\u015fmaktad\u0131r. Yarg\u0131\u00e7lar de\u011fi\u015fik \u00fclkelerden se\u00e7ilir, b\u00f6ylece d\u00fcnyadaki de\u011fi\u015fik hukuk sistemlerinin temsil edilmesi sa\u011flanmaya \u00e7al\u0131\u015f\u0131l\u0131r.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial,helvetica,sans-serif;\">Divan\u0131n yetki alan\u0131, bir uluslararas\u0131 uyu\u015fmazl\u0131kta taraf olan \u00fclkelerin kendisine getirdikleri davalar ile BM Antla\u015fmas\u0131\u2019nda, ya da y\u00fcr\u00fcrl\u00fckteki uluslararas\u0131 antla\u015fmalarda \u00f6zellikle \u00f6ng\u00f6r\u00fclm\u00fc\u015f konular\u0131 i\u00e7ine al\u0131r. Uluslararas\u0131 Adalet Divan\u0131 Stat\u00fcs\u00fc, BM Antla\u015fmas\u0131\u2019n\u0131n (BM \u015eart\u0131) ayr\u0131lmaz bir par\u00e7as\u0131d\u0131r ve Adalet Divan\u0131\u2019n\u0131n \u00e7al\u0131\u015fma esaslar\u0131n\u0131 belirleme yetkisiyle \u00e7al\u0131\u015fmaktad\u0131r.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial,helvetica,sans-serif;\">Ancak bu, g\u00f6r\u00fcn\u00fc\u015f\u00fcyle temel insan haklar\u0131n\u0131 ve evrensel hukuk kurallar\u0131n\u0131 koruyan ve yery\u00fcz\u00fcnde adaleti sa\u011flayan bu kurulu\u015flar ger\u00e7ekte, Siyonist ve emperyalist odaklar\u0131n g\u00fcd\u00fcm\u00fcnde ve hizmetinde bulunmaktad\u0131r.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial,helvetica,sans-serif;\"><b>Konuya giri\u015f <\/b><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial,helvetica,sans-serif;\">A\u015fa\u011f\u0131da T\u00fcrk\u00e7e \u00e7evirisini yapt\u0131\u011f\u0131m\u0131z AAD-nihai karar\u0131, T\u00fcrkiye\u2019mizde; \u201cErmenilerden \u00f6z\u00fcr diliyoruz\u201d kampanyas\u0131n\u0131 y\u00fcr\u00fctenlerin ve AKP\u2019nin sahtek\u00e2rl\u0131\u011f\u0131n\u0131n belgesidir.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial,helvetica,sans-serif;\">Avrupa\u2019n\u0131n en y\u00fcksek yarg\u0131 organlar\u0131ndan olan ve milli parlamentolarda siyasi olarak al\u0131nan s\u00f6zde Ermeni soyk\u0131r\u0131m\u0131 karar\u0131 veya kararlar\u0131, en y\u00fcksek nihai hukuki bu karar kar\u015f\u0131s\u0131nda ge\u00e7erlili\u011fini art\u0131k tamamen kaybetmi\u015ftir.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial,helvetica,sans-serif;\">Sivil toplum \u00f6rg\u00fctlerinin, partilerin hukuki temsilcilerinin, bu karar\u0131 Federal Almanya\u2019n\u0131n di\u011fer meclis \u00fcyelerine ve bas\u0131na zaman kaybetmeden ula\u015ft\u0131rmalar\u0131 beklenir. T\u00fcrkiye Cumhuriyeti D\u0131\u015fi\u015fleri Bakanl\u0131\u011f\u0131ndaki hukuk uzmanlar\u0131n\u0131n da bu konuda art\u0131k harekete ge\u00e7meleri ve bu meclislerin ald\u0131klar\u0131 siyasi karar\u0131n hukuken art\u0131k hi\u00e7 bir de\u011feri olmad\u0131\u011f\u0131n\u0131n bildirilmesi gerekmektedir.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial,helvetica,sans-serif;\">Bu Karar\u0131n \u00e7evirisi AB \u00fclkelerinin t\u00fcm dillerine zaten yap\u0131lm\u0131\u015f vaziyettedir ve \u0130htiya\u00e7 halinde a\u015fa\u011f\u0131daki adresten temin edilebilir.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial,helvetica,sans-serif;\"><a href=\"http:\/\/curia.europa.eu\/jurisp\/cgi-bin\/form.pl?lang=de\">http:\/\/curia.europa.eu\/jurisp\/cgi-bin\/form.pl?lang=de<\/a><\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"font-family: arial,helvetica,sans-serif;\">Bundan sonra da herhangi bir Avrupa \u00fclkesi, s\u00f6zde Ermeni soyk\u0131r\u0131m\u0131 hakk\u0131nda karar ald\u0131\u011f\u0131nda, yine T\u00fcrkiye Cumhuriyeti D\u0131\u015fi\u015fleri Bakanl\u0131\u011f\u0131 hukuk\u00e7ular\u0131 taraf\u0131ndan o \u00fclke hakk\u0131nda, AAD\u2019n\u0131n bu konudaki karar\u0131n\u0131 ihlal etti\u011finden dolay\u0131 giri\u015fimde bulunabilir. <\/span><\/li>\n<\/ul>\n<div style=\"text-align: justify;\">\n<p><span style=\"font-family: arial,helvetica,sans-serif;\">Demokrasinin olmazsa olmaz\u0131 olan a\u015fa\u011f\u0131da s\u0131ralad\u0131\u011f\u0131m\u0131z \u00fc\u00e7aya\u011f\u0131 vard\u0131r (Medya\u2019y\u0131 \u015fu an saymayal\u0131m)<\/span><\/p>\n<ul>\n<li><span style=\"font-family: arial,helvetica,sans-serif;\">Yasama -kanun koyucu-(legislative) <\/span><\/li>\n<li><span style=\"font-family: arial,helvetica,sans-serif;\">Yarg\u0131 -mahkemeler- (Judikative) <\/span><\/li>\n<li><span style=\"font-family: arial,helvetica,sans-serif;\">Y\u00fcr\u00fctme \u2013Polis, Jandarma, asker v.s.kolluk kuvvetleri -(Exikutive) <\/span><\/li>\n<\/ul><\/div>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial,helvetica,sans-serif;\">Bu anlamda, AAD\u2019n\u0131n bu nihai karar\u0131n\u0131-yarg\u0131y\u0131- kabul etmeyenin hukukun \u00fcst\u00fcnl\u00fc\u011f\u00fc konusunda haz\u0131ms\u0131zl\u0131\u011f\u0131 oldu\u011fu, b\u00f6yle ki\u015filerin de asla demokrat olamayaca\u011f\u0131 belirtilmelidir.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial,helvetica,sans-serif;\">S\u00f6z konusu davada, Avrupa Adalet Divan\u0131 Ermenilere \u015funlar\u0131 s\u00f6ylemi\u015ftir:<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial,helvetica,sans-serif;\">\u201cS\u00f6zde soyk\u0131r\u0131m\u0131 \u00f6nce ispatlay\u0131n, ondan sonra tazminat isteyin\u201d olmu\u015ftur. Her ne kadar Ermeni diasporas\u0131 taraf\u0131ndan bu dava; \u201cakit d\u0131\u015f\u0131 sorumluluktan kaynaklanan maddi ve manevi tazminat davas\u0131\u201d olarak lanse edilse de, mahkemede bunu hak etmek i\u00e7in de, s\u00f6zde soyk\u0131r\u0131m\u0131n ve bu soyk\u0131r\u0131mdan kaynaklanan zarar\u0131n ispatlanmas\u0131, davan\u0131n ana damar\u0131n\u0131 \u2013esas\u0131n\u0131- te\u015fkil etmi\u015ftir.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial,helvetica,sans-serif;\">Baz\u0131 hukuk\u00e7ular bu gibi subjektif konularda, dolay\u0131s\u0131yla t\u00fcm siyasi alanda do\u011fan problemlerin mahkemelerin yetkilerinin i\u00e7ine girmedi\u011fi (doctrine of political question) iddialar\u0131na kar\u015f\u0131: \u2018AAD\u2019\u0131 bu davay\u0131 neden kabul etti?\u2019 diye sormak gerekir. T\u00fcm medeni ceza kanunlar\u0131n\u0131n mihenk ta\u015f\u0131-\u00e7o\u011fu zaman birinci maddesi- i\u00e7erik olarak hemen hemen a\u015fa\u011f\u0131daki gibidir.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial,helvetica,sans-serif;\">\u201cNulla poena sine lege, nullum crimen sine lege\u201d<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial,helvetica,sans-serif;\">\u201cKanunsuz ceza kesilmez, kanunsuz su\u00e7 olmaz\u201d<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial,helvetica,sans-serif;\">\u201cKeine Strafe ohne Gesetz, kein Verbrechen ohne Gesetz\u201d<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial,helvetica,sans-serif;\">Kanunsuz ceza kesilmez. Bir eylemin cezaland\u0131r\u0131labilmesi ise, bu eylemin yap\u0131lmas\u0131ndan \u00f6nce kesinle\u015fmi\u015f bir kanunla ancak m\u00fcmk\u00fcnd\u00fcr. Yani, \u00f6rne\u011fin 2000 y\u0131l\u0131nda kesinle\u015fmi\u015f bir kanunla, kalk\u0131p ta 1999 y\u0131l\u0131nda i\u015flenen bir su\u00e7u yarg\u0131layamazs\u0131n\u0131z, demektir.<\/span><\/p>\n<div style=\"text-align: justify;\">\n<p><span style=\"font-family: arial,helvetica,sans-serif;\">Bu anlamda, Ermeni\u2019lerin \u015fu andaki soyk\u0131r\u0131m hukukunu, siyasi zorlamalarla ge\u00e7mi\u015fe uygulamaya kalkmalar\u0131, abesle i\u015ftigaldir. B\u00f6yle hallerde, kanunun makabline \u015f\u00fcmul yasa\u011f\u0131 veya yeni T\u00fcrk\u00e7e ile s\u00f6yleyecek olursak: Ge\u00e7mi\u015fe uygulama yasa\u011f\u0131 vard\u0131r. (R\u00fcckwirkungsverbot).<\/span><\/p>\n<p><span style=\"font-family: arial,helvetica,sans-serif;\">Ger\u00e7i baz\u0131 hukuk\u00e7ular insanl\u0131\u011fa kar\u015f\u0131 i\u015flenen su\u00e7larda hukukun ge\u00e7mi\u015fe uygulama yasa\u011f\u0131n\u0131n ge\u00e7erli olamayaca\u011f\u0131n\u0131 v.s. savunuyorlarsa da, \u015fu anda hen\u00fcz bu konuda herkesin bir noktada birle\u015fti\u011fi kesinle\u015fmi\u015f uluslararas\u0131 bir karar mevcut de\u011fildir.<\/span><\/p>\n<p><span style=\"font-family: arial,helvetica,sans-serif;\">\u0130spat y\u00fck\u00fcn\u00fcn davac\u0131da oldu\u011fu bu davada, s\u00f6zde Ermeni diasporas\u0131, kendilerinden istenilen \u2018s\u00f6zde ermeni soyk\u0131r\u0131m\u0131\u2019n\u0131 ispatlama konusunda, siyasi s\u00f6ylem ve iddiadan ba\u015fka hi\u00e7bir varl\u0131k g\u00f6sterememi\u015flerdir.<\/span><\/p>\n<p><span style=\"font-family: arial,helvetica,sans-serif;\">Bu dava kazan\u0131lsa idi, an\u0131nda EMSAL dava olarak k\u00e2inata ilan edilirdi ve sonucunda ise:<\/span><\/p>\n<ul>\n<li><span style=\"font-family: arial,helvetica,sans-serif;\">T\u00fcrkiye Cumhuriyeti AB\u2019ne \u00fcye olmas\u0131 i\u00e7in, \u00f6nceden Ermeni soyk\u0131r\u0131m\u0131n\u0131 kabul etmek mecburiyetine girecekti.<\/span><\/li>\n<li><span style=\"font-family: arial,helvetica,sans-serif;\">AAD\u2019n\u0131n bu nihai karar\u0131 EMSAL karar olarak g\u00f6sterilip, Ermenilerin ard\u0131 arkas\u0131 kesilmeyen isteklerinin yan\u0131 s\u0131ra, T\u00fcrkiye\u2019den bir \u015feyler koparmak isteyen baz\u0131 devletlerin siyasi \u015fantajlar\u0131..v.s ile kar\u015f\u0131 kar\u015f\u0131ya gelinecekti. <\/span><\/li>\n<\/ul>\n<p><span style=\"font-family: arial,helvetica,sans-serif;\">AAD\u2019n\u0131n reddetti\u011fi T-346\/03, C-18\/04 P Esas say\u0131l\u0131 davan\u0131n 25 nolu gerek\u00e7esinde, hakim aynen s\u00f6yle demektedir:<\/span><\/p>\n<p><span style=\"font-family: arial,helvetica,sans-serif;\">25.((H\u00fck\u00fcm vermenin)) \u015fart\u0131na gelince; davac\u0131lar\u0131n ger\u00e7ekten somut olarak zarara u\u011fram\u0131\u015f olmalar\u0131n\u0131n tespit edilmesi gerekir. Davac\u0131lar\u0131n dava dilek\u00e7esinde talep ettikleri, \u015fah\u0131slar\u0131n\u0131n ve Ermeni cemaatinin u\u011frad\u0131\u011f\u0131, genel tarifi ile yetindikleri s\u00f6zde manevi zarar\u0131n ispat\u0131 konusunda ki davac\u0131lar bu konuda ne kapsam\u0131, ne de varl\u0131\u011f\u0131 hususunda zerre kadar somut bilgi sunulmu\u015f de\u011fildir. Davac\u0131lar bununla, kendilerinin ger\u00e7ekte, somut olarak zarar g\u00f6r\u00fcp g\u00f6rmedikleri hakk\u0131nda mahkemenin h\u00fck\u00fcm verebilmesi i\u00e7in yeterli bilgi verememi\u015flerdir. (AAD\u2019n\u0131n bu konuda 2 Temmuz 2003 tarihli T-99\/98, Hameico Stutgart \/konsey ve komisyon davas\u0131 karar\u0131 ve komisyonun no.68 ve 69, Slg.2003, II-0000 emsal kararlar\u0131)\u201d Tabi bu karar, Ermenilere: \u201cHakl\u0131 \u00e7\u0131kmak i\u00e7in \u00f6nce soyk\u0131r\u0131ma dair daha ge\u00e7erli belgeler getirin\u201d anlam\u0131nda bir dolayl\u0131 destek uyar\u0131s\u0131 olarak ta okunabilir.<\/span><\/p>\n<p><span style=\"font-family: arial,helvetica,sans-serif;\">Yine, iddianamenin 10. numaras\u0131nda Davac\u0131lar:  ayr\u0131ca, bir\u00e7ok temel insan haklar\u0131n\u0131n, \u00f6zellikle 4.Kas\u0131m 1950 y\u0131l\u0131nda Roma\u2019da imzalanan insan haklar\u0131 ve temel \u00f6zg\u00fcrl\u00fckleri koruma alt\u0131na alan Avrupa s\u00f6zle\u015fmesinin 3. ve 8. maddesine dikkat \u00e7ekerek, burada s\u00f6z\u00fc edilen, \u00f6zel ya\u015fam hakk\u0131n\u0131n kutsall\u0131\u011f\u0131, a\u015fa\u011f\u0131lay\u0131c\u0131 veya insanl\u0131k d\u0131\u015f\u0131 Muameleye tabi tutulmama haklar\u0131n\u0131n ihlal edildi\u011fini, s\u00f6ylemektedir.<\/span><\/p>\n<p><span style=\"font-family: arial,helvetica,sans-serif;\">Hakim ise, bu iddiaya istinaden a\u015fa\u011f\u0131daki cevab\u0131 vermi\u015ftir. 21.Temel haklar\u0131n s\u00f6zde ihlali konusunda ise, (yukar\u0131daki 10. numaraya bak\u0131n\u0131z) davac\u0131lar\u0131n, b\u00f6yle temel insan haklar\u0131n\u0131n ihlali iddias\u0131 ile s\u0131n\u0131rl\u0131 kal\u0131p, bunun daval\u0131 organlara atfedilen su\u00e7 ile ne kadar ilgili oldu\u011funu a\u00e7\u0131klayamamas\u0131n\u0131 belirtmek yeterlidir.<\/span><\/p>\n<p><span style=\"font-family: arial,helvetica,sans-serif;\">Olaylar\u0131n geli\u015fimi:<\/span><\/p>\n<p><span style=\"font-family: arial,helvetica,sans-serif;\">Tarih 20 Temmuz 1987\u2019da Avrupa parlamentosu C-190 esas nolu karar\u0131 ile, Ermeni sorununun siyasi \u00e7\u00f6z\u00fcm\u00fc hakk\u0131nda bir karar al\u0131r ve bir dizi \u201c\u00e7\u00f6z\u00fcm\u201d \u00f6nerir.<\/span><\/p>\n<p><span style=\"font-family: arial,helvetica,sans-serif;\">Y\u0131l 1999. AB ve o s\u0131rada Ba\u015fbakan\u0131 Say\u0131n B\u00fclent Ecevit olan T\u00fcrkiye Cumhuriyeti, T\u00fcrkiye\u2019nin AB\u2019ne \u00fcyelik i\u00e7in aday olup olamayaca\u011f\u0131 konusunda restle\u015fmektedir. Ba\u015fbakan Ecevit Avrupal\u0131lar\u0131n restini g\u00f6r\u00fcr ve \u2018bizi istemeyeni biz hi\u00e7 istemeyiz\u2019 der ve nihayet, o hat\u0131rlayaca\u011f\u0131n\u0131z sahnelerle Ba\u015fbakan Say\u0131n Ecevit ertesi g\u00fcn apar topar Helsinki\u2019ye davet edilerek, T\u00fcrkiye\u2019nin AB \u00fcyeli\u011fine adayl\u0131k karar\u0131 verilir<\/span><\/p>\n<p><span style=\"font-family: arial,helvetica,sans-serif;\">Bunun \u00fczerine Ermeni diasporas\u0131:<\/span><\/p>\n<p><span style=\"font-family: arial,helvetica,sans-serif;\">20 Temmuz 1987 tarihli Avrupa parlamentosunun C-190 esas nolu karar\u0131na at\u0131fta bulunarak- \u2018\u2019T\u00fcrkiye \u00f6nce Ermenilere yapt\u0131\u011f\u0131 soyk\u0131r\u0131m\u0131 kabul etsin, ondan sonra \u00fcyeli\u011fe adayl\u0131k stat\u00fcs\u00fc verin, aksi takdirde AB akit d\u0131\u015f\u0131 sorumlulu\u011funu zedelemi\u015f olur\u2019\u2019 diyerek,<\/span><\/p>\n<ul>\n<li><span style=\"font-family: arial,helvetica,sans-serif;\">Avrupa Parlamentosu\u2019na, <\/span><\/li>\n<li><span style=\"font-family: arial,helvetica,sans-serif;\">Avrupa Birli\u011fi Konseyi\u2019ne ve <\/span><\/li>\n<li><span style=\"font-family: arial,helvetica,sans-serif;\">Avrupa Birli\u011fi Komisyonu\u2019na kar\u015f\u0131 <\/span><\/li>\n<\/ul>\n<p><span style=\"font-family: arial,helvetica,sans-serif;\">Avrupa Adalet Divan\u0131\u2019nda-AAD\u2019n\u0131nda- dava a\u00e7maya giri\u015fir.<\/span><\/p>\n<p><span style=\"font-family: arial,helvetica,sans-serif;\">Bu dava, AAD\u2019n\u0131n birinci dairesi taraf\u0131ndan 17 Aral\u0131k 2003 tarihinde Esas No: T-346\/03 karar\u0131 ile reddedilir. Ermeni diasporas\u0131 bunun \u00fczerine temyize gider ve AAD\u2019n\u0131n d\u00f6rd\u00fcnc\u00fc dairesinde g\u00f6r\u00fclen temyiz davas\u0131, 17.04.2004 tarihinde, C-18\/04 P Esas nolu nihai karar ile yeniden reddedilir ve bu nihai kararla Ermeniler ayr\u0131ca 30.bin Avro\u2019luk mahkeme masraf\u0131n\u0131 da \u00f6demeye mahkum edilirler.<\/span><\/p>\n<\/p><\/div>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial,helvetica,sans-serif;\"><b> <\/b><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial,helvetica,sans-serif;\"><b>Gere\u011fi d\u00fc\u015f\u00fcn\u00fcld\u00fc, mahkemenin takdiri:<\/b><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial,helvetica,sans-serif;\"><b>13. E\u011fer bir davan\u0131n, alenen, her t\u00fcrl\u00fc hukuki bir dayana\u011f\u0131 yok ise, Mahkeme, mahkemenin 111. yarg\u0131lama h\u00fckm\u00fcne g\u00f6re yarg\u0131lamay\u0131 devam ettirmeyerek, h\u00fck\u00fcm verip, gerek\u00e7eleri ile karara ba\u011flayabilir. Mahkeme, dava dilek\u00e7esini g\u00f6z \u00f6n\u00fcnde bulundurarak, daval\u0131 kurumlar\u0131 dinlemeden ve s\u00f6zl\u00fc duru\u015fmay\u0131 a\u00e7madan da, s\u00f6z konusu davan\u0131n gerek\u00e7elili\u011fi hakk\u0131nda karar verecek durumda oldu\u011fu kanaatindedir.<\/b><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial,helvetica,sans-serif;\"><b>14. Daha \u00f6nce verilen emsal kararlara g\u00f6re, Avrupa birli\u011finin akit d\u0131\u015f\u0131 sorumlulu\u011fu, birli\u011fin 288.maddesinin 2. paragraf\u0131nda belirlenmi\u015f olup, bir s\u00fcr\u00fc \u015fartlar\u0131n yerine getirilmi\u015f olmas\u0131na ba\u011fl\u0131d\u0131r. Yani buna g\u00f6re, kurumlara atfedilen kanun d\u0131\u015f\u0131 davran\u0131\u015f ile ger\u00e7ekte var olan ve telafisi istenen (maddi ve manevi) zarar aras\u0131nda sebep-sonu\u00e7 ili\u015fkisinin olmas\u0131 gerekmektedir. (Bu konudaki AAD\u2019n\u0131n:29 Eyl\u00fcl 1982, esas no.26\/81, Oleifici MediteraraneiEWG,Slg.1982, 3057, Randnr.16 ve yine 11 Temmuz 1996, esas no.T-175\/94, Internat\u0131onal Procurement Serv\u0131ces\/komm\u0131ss\u0131on, Slg.1996, II-729,II-1343, Randnr.30. ve yine 11 Temmuz 1997 esas no. T-267\/94,Oleifici \u0130taliani\/Kommission, Slg.1997,II- 1239, Randnr.20, emsal kararlar\u0131d\u0131r).<\/b><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial,helvetica,sans-serif;\"><b>15. Bu \u015fartlardan herhangi birisinin yerine getirilmemesi durumunda, birli\u011fin akit d\u0131\u015f\u0131 sorumlulu\u011funu belirleyen geriye kalan di\u011fer \u015fartlara bak\u0131lmaya gerek g\u00f6r\u00fclmeden, dava t\u00fcmden reddedilir.(Bu konuda AAD\u2019n\u0131n 14 Ekim 1999 tarihli esas no.C-104\/97 P, Atlanta\/Avrupa Birli\u011fi, Slg.1999,I-6983, Randnr.65 karar\u0131).<\/b><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial,helvetica,sans-serif;\"><b>16. Davac\u0131lar burada, birincisi, 10 ve 11 Aral\u0131k 1999 tarihinde Avrupa konseyinin T\u00fcrkiye Cumhuriyeti\u2019ne Helsinki\u2019de AB\u2019ne \u00fcye olabilme stat\u00fcs\u00fcn\u00fc vermi\u015f olmas\u0131 ve di\u011feri ise, T\u00fcrkiye Cumhuriyeti\u2019nin bu konumdan \u00e7\u0131kar elde etmi\u015f olmas\u0131 hususu olarak, birli\u011fin akit d\u0131\u015f\u0131 sorumlulu\u011funun devreye girmesi gerekti\u011fi, iki husus belirtmektedir.<\/b><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial,helvetica,sans-serif;\"><b>17. T\u00fcrkiye Cumhuriyeti\u2019nin Avrupa birli\u011fine \u00fcyeli\u011fe adayl\u0131k stat\u00fcs\u00fcn\u00fcn tan\u0131nmas\u0131na gelince; bu karar\u0131n, EG\u2019nin 7. maddesi gere\u011fi birli\u011fin organ\u0131 olmayan, Avrupa konseyinin tasarrufunun sonucu oldu\u011funu tespit etmek gerekir. Kald\u0131 ki, 14. numarada belirtildi\u011fi gibi, yaln\u0131z birli\u011fin organ\u0131 olan bir kurumun davran\u0131\u015f\u0131, akit d\u0131\u015f\u0131 sorumlulu\u011fu do\u011furabilir. Bundan dolay\u0131d\u0131r ki, T\u00fcrkiye Cumhuriyeti\u2019nin Avrupa birli\u011fine \u00fcyeli\u011fe adayl\u0131k stat\u00fcs\u00fcn\u00fcn tan\u0131nmas\u0131n\u0131n, birli\u011fin akit d\u0131\u015f\u0131 sorumlulu\u011funu do\u011furdu\u011fu gerek\u00e7esinin reddedilmesi gerekir.<\/b><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial,helvetica,sans-serif;\"><b>18. Davac\u0131lar burada, T\u00fcrkiye Cumhuriyeti\u2019nin Avrupa Birli\u011fi ile olan ortakl\u0131\u011f\u0131ndan yararlanmas\u0131n\u0131n, 1987 de al\u0131nan karara ters d\u00fc\u015ft\u00fc\u011f\u00fcn\u00fc ve daval\u0131 organ\u0131n davran\u0131\u015f\u0131n\u0131n hukuki ge\u00e7erlili\u011finin olmad\u0131\u011f\u0131n\u0131, savunmaktad\u0131r.<\/b><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial,helvetica,sans-serif;\"><b> 19. 1987 \u2018de al\u0131nan karar\u0131n, saf siyasi bir a\u00e7\u0131klama i\u00e7eren, her an parlamento taraf\u0131ndan tekrar de\u011fi\u015ftirilebilinecek bir d\u00f6k\u00fcman oldu\u011funun tespitini yapmak yeterlidir. Bu sebeplerden dolay\u0131d\u0131r ki, bu karar\u0131n, karar\u0131 alanlara kar\u015f\u0131 hukuki ba\u011flay\u0131c\u0131l\u0131\u011f\u0131 olmad\u0131\u011f\u0131 gibi, hele hele di\u011fer daval\u0131 organlara kar\u015f\u0131 da hi\u00e7 bir ba\u011flay\u0131c\u0131 hukuki sonu\u00e7lar inki\u015faf ettirmez.<\/b><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial,helvetica,sans-serif;\"><b>20. (yukar\u0131da 19\u201dda) yap\u0131lan bu tespit, davac\u0131larda hakl\u0131 olarak olu\u015fabilecek; \u201cbundan sonra art\u0131k AB-organlar\u0131, Avrupa Parlamentosu\u2019nun 1987 \u2018deki karar\u0131n\u0131n i\u00e7eri\u011fi do\u011frultusunda hareket edecekler\u201d hissini bertaraf etmek i\u00e7in yeterlidir. (Bu anlamdaki AAD\u2019n\u0131n 11 Temmuz 1985 tarihli 87\/77, 130\/77, 22\/83, 9\/84 ve 10\/84, salerno \/ Avrupa Komisyonu ve Avrupa konseyi davas\u0131 ve Slg.1985, 2523, no 59 ve 28 Kas\u0131m 1991 tarihli Esas no C-213\/88 ve C- 39\/89, L\u00fcxenburg\/Parlamento davalar\u0131, komisyonun Slg. 1991, I-5643, no.25 karar\u0131).<\/b><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial,helvetica,sans-serif;\">21.Temel haklar\u0131n s\u00f6zde ihlali konusunda ise, (yukar\u0131daki 10. numaraya bak\u0131n\u0131z) davac\u0131lar\u0131n, b\u00f6yle temel insan haklar\u0131n\u0131n ihlali iddias\u0131 ile s\u0131n\u0131rl\u0131 kal\u0131p, bunun daval\u0131 organlara atfedilen su\u00e7 ile ne kadar ilgili oldu\u011funu a\u00e7\u0131klayamamas\u0131n\u0131 belirtmek yeterlidir.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial,helvetica,sans-serif;\">22. Bu arada, bir \u015feyi de zikretmek gerekir ki, o da, davac\u0131lar\u0131n neden-sonu\u00e7- ili\u015fkisini belirleyen \u015fartlar\u0131n yerine getirildi\u011fini a\u00e7\u0131k\u00e7a ispatlayamad\u0131\u011f\u0131d\u0131r.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial,helvetica,sans-serif;\">23. S\u00fcrekli verilen yarg\u0131sal (emsal) kararlara g\u00f6re, s\u00f6z\u00fc edilen organlar\u0131n i\u015fledi\u011fi s\u00f6zde hata ile iddia edilen zarar aras\u0131nda, neden-sonu\u00e7-ili\u015fkisi olmas\u0131 mecburiyeti olup, bunun da ispat y\u00fck\u00fc davac\u0131ya aittir. (AAD\u2019n\u0131n 24 Nisan 2002 tarihli, esas no.T-220\/96,EVO\/Rat davas\u0131 karar\u0131 ve Komisyonun Slg.2002, II- 2265, no.41 ve orada yap\u0131lan karar al\u0131nt\u0131s\u0131) Ayr\u0131ca, s\u00f6z\u00fc edilen organ\u0131n hatal\u0131 davran\u0131\u015f\u0131, bu zarar\u0131n do\u011fmas\u0131na do\u011frudan ve tayin edici neden olmas\u0131 gerekmektedir. (AAD\u2019n\u0131n 15 Haziran 2000 tarihli, esas no.T-614\/97, Aduanas Pujol Rub\u0131o \/konsey davas\u0131 karar\u0131 ve Komisyonun Slg.200, II-2387,no.19 karar\u0131 ve AAD\u2019n\u0131n T-16 Haziran 2000 tarihli, esas no.T-611\/97, T-619\/97 Transfluvia\/konsey davas\u0131 karar\u0131 ve komisyonun Slg.2000, II-2405, no.17 ve AAD\u2019n\u0131n 12 Aral\u0131k 2000 tarihli esas no.T-201\/99 Royal Cru\u0131ses \/konsey davas\u0131 karar\u0131 ve komisyonun Slg. 2000, II-4005, no. 26 karar\u0131. Temyiz edilen bu karar da, ayr\u0131ca AAD\u2019n\u0131n 15 \u015eubat 2002 tarihinde verdi\u011fi, resmi gazetede yay\u0131nlanmam\u0131\u015f olan Royal Olymp\u0131c Cru\u0131ses\/Konsey ve Komisyon davas\u0131nda esas no.C-49\/01 nihai karar\u0131 ile tasdik edilmi\u015ftir.)<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial,helvetica,sans-serif;\">24. Davac\u0131lar\u0131n dava dilek\u00e7esindeki gerek\u00e7elerinden, iddia edilen manevi tazminat\u0131n, su\u00e7lanan organlar\u0131n davran\u0131\u015flar\u0131ndan de\u011fil de, T\u00fcrkiye Cumhuriyeti\u2019nin s\u00f6zde soyk\u0131r\u0131m\u0131 tan\u0131mad\u0131\u011f\u0131ndan kaynakland\u0131\u011f\u0131 anla\u015f\u0131lmaktad\u0131r. Davac\u0131lar bununla, daval\u0131 organlara atfedilen su\u00e7lu davran\u0131\u015f\u0131n, iddia edilen zarar\u0131n ortaya \u00e7\u0131kmas\u0131nda, do\u011frudan ve tayin edici bir unsur oldu\u011funa dair hi\u00e7 bir ispat ortaya koyamam\u0131\u015ft\u0131r.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: arial,helvetica,sans-serif;\">25. Davac\u0131lar\u0131n ger\u00e7ekten ve somut zarar g\u00f6rm\u00fc\u015f olduklar\u0131n\u0131 g\u00f6steren deliller konusuna gelince; davac\u0131lar, dava dilek\u00e7esinde genel ifadelerle Ermeni birli\u011finin u\u011frad\u0131\u011f\u0131 manevi zarar\u0131n talebi ile s\u0131n\u0131rl\u0131 kalm\u0131\u015f olup, ne bu konuda, ne de \u015fahsen kendilerinin u\u011frad\u0131\u011f\u0131 zarar\u0131n kapsam\u0131 hakk\u0131nda zerre kadar dahi delil g\u00f6sterememi\u015f olmalar\u0131d\u0131r. Davac\u0131lar bununla, kendilerinin ger\u00e7ekten ve somut olarak zarar g\u00f6r\u00fcp g\u00f6rmedikleri hakk\u0131nda mahkemenin h\u00fck\u00fcm verebilmesi i\u00e7in yeterli bilgi verememi\u015flerdir.
