T\u00fcrkiye B\u00fcy\u00fck Millet Meclisi ve Cumhurba\u015fkan\u0131n\u0131n se\u00e7im d\u00f6nemi MADDE 77- T\u00fcrkiye B\u00fcy\u00fck Millet Meclisi ve Cumhurba\u015fkanl\u0131\u011f\u0131 se\u00e7imleri be\u015f y\u0131lda bir ayn\u0131 g\u00fcnde yap\u0131l\u0131r. S\u00fcresi biten Milletvekili yeniden se\u00e7ilebilir. Cumhurba\u015fkanl\u0131\u011f\u0131 se\u00e7iminde birinci oylamada gerekli \u00e7o\u011funlu\u011fun sa\u011flanamamas\u0131 halinde 101\u2019inci maddedeki usule g\u00f6re ikinci oylama yap\u0131l\u0131r.\u201d<\/span><\/strong><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; text-indent: 1cm; line-height: 16pt;\"><strong><span style=\"font-size: 12pt; font-family: 'Arial',sans-serif;\">MADDE 5:<\/span><\/strong><strong><span style=\"font-size: 12pt; font-family: 'Arial',sans-serif;\"> 2709 say\u0131l\u0131 Kanunun 87\u2019nci maddesi a\u015fa\u011f\u0131daki \u015fekilde de\u011fi\u015ftirilmi\u015ftir;<\/span><\/strong><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; text-indent: 1cm; line-height: 16pt;\"><strong><span style=\"font-size: 12pt; font-family: 'Arial',sans-serif;\">\u201cMADDE 87: T\u00fcrkiye B\u00fcy\u00fck Millet Meclisinin g\u00f6rev ve yetkileri, kanun koymak, de\u011fi\u015ftirmek ve kald\u0131rmak; b\u00fct\u00e7e ve kesin hesap kanun tekliflerini g\u00f6r\u00fc\u015fmek ve kabul etmek; para bas\u0131lmas\u0131na ve sava\u015f il\u00e2n\u0131na karar vermek; milletleraras\u0131 antla\u015fmalar\u0131n onaylanmas\u0131n\u0131 uygun bulmak, T\u00fcrkiye B\u00fcy\u00fck Millet Meclisi \u00fcye tamsay\u0131s\u0131n\u0131n be\u015fte \u00fc\u00e7 \u00e7o\u011funlu\u011funun karar\u0131 ile genel ve \u00f6zel af il\u00e2n\u0131na karar vermek ve Anayasan\u0131n di\u011fer maddelerinde \u00f6ng\u00f6r\u00fclen yetkileri kullanmak ve g\u00f6revleri yerine getirmektir.\u201d<\/span><\/strong><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; text-indent: 1cm; line-height: 16pt;\"><strong><em><span style=\"font-size: 14pt; font-family: 'Arial',sans-serif;\">\u2022 Bu madde ile Meclisin Bakanlar\u0131 denetleme ve gerekirse de\u011fi\u015ftirme yetkisi elinden al\u0131nm\u0131\u015ft\u0131r.<\/span><\/em><\/strong><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; text-indent: 1cm; line-height: 16pt;\"><strong><span style=\"font-size: 12pt; font-family: 'Arial',sans-serif;\">MADDE 6:<\/span><\/strong><strong><span style=\"font-size: 12pt; font-family: 'Arial',sans-serif;\"> 2709 say\u0131l\u0131 Kanunun 98\u2019inci maddesi a\u015fa\u011f\u0131daki \u015fekilde de\u011fi\u015ftirilmi\u015f ve kenar ba\u015fl\u0131\u011f\u0131 metinden \u00e7\u0131kar\u0131lm\u0131\u015ft\u0131r;<\/span><\/strong><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; text-indent: 1cm; line-height: 16pt;\"><strong><span style=\"font-size: 12pt; font-family: 'Arial',sans-serif;\">\u201cMADDE 98: T\u00fcrkiye B\u00fcy\u00fck Millet Meclisi; meclis ara\u015ft\u0131rmas\u0131, genel g\u00f6r\u00fc\u015fme, meclis soru\u015fturmas\u0131 ve yaz\u0131l\u0131 soru yollar\u0131yla bilgi edinme ve denetleme yetkisini kullan\u0131r. Meclis ara\u015ft\u0131rmas\u0131, belli bir konuda bilgi edinmek i\u00e7in yap\u0131lan incelemeden ibarettir. Genel g\u00f6r\u00fc\u015fme, toplumu ve Devlet faaliyetlerini ilgilendiren belli bir konunun T\u00fcrkiye B\u00fcy\u00fck Millet Meclisi Genel Kurulunda g\u00f6r\u00fc\u015f\u00fclmesidir. Meclis soru\u015fturmas\u0131, Cumhurba\u015fkan\u0131 yard\u0131mc\u0131lar\u0131 ve bakanlar hakk\u0131nda 106\u2019nc\u0131 maddenin be\u015finci, alt\u0131nc\u0131 ve yedinci f\u0131kralar\u0131 uyar\u0131nca yap\u0131lan soru\u015fturmadan ibarettir. Yaz\u0131l\u0131 soru; yaz\u0131l\u0131 olarak en ge\u00e7 on be\u015f g\u00fcn i\u00e7inde cevaplanmak \u00fczere milletvekillerinin, Cumhurba\u015fkan\u0131 yard\u0131mc\u0131lar\u0131 ve bakanlara yaz\u0131l\u0131 olarak soru sormalar\u0131ndan ibarettir. Meclis ara\u015ft\u0131rmas\u0131, genel g\u00f6r\u00fc\u015fme ve yaz\u0131l\u0131 soru \u00f6nergelerinin verilme \u015fekli, i\u00e7eri\u011fi ve kapsam\u0131 ile ara\u015ft\u0131rma usulleri Meclis \u0130\u00e7t\u00fcz\u00fc\u011f\u00fc ile d\u00fczenlenir.\u201d<\/span><\/strong><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; text-indent: 1cm; line-height: 16pt;\"><strong><em><span style=\"font-size: 14pt; font-family: 'Arial',sans-serif;\">\u2022 Bu madde ile Meclisin denetleme yetkisi budanm\u0131\u015ft\u0131r.<\/span><\/em><\/strong><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; text-indent: 1cm; line-height: 16pt;\"><strong><span style=\"font-size: 12pt; font-family: 'Arial',sans-serif;\">MADDE 7:<\/span><\/strong><strong><span style=\"font-size: 12pt; font-family: 'Arial',sans-serif;\"> 2709 say\u0131l\u0131 Kanunun 101\u2019inci maddesi ba\u015fl\u0131\u011f\u0131yla birlikte a\u015fa\u011f\u0131daki \u015fekilde de\u011fi\u015ftirilmi\u015ftir.<\/span><\/strong><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; text-indent: 1cm; line-height: 16pt;\"><strong><span style=\"font-size: 12pt; font-family: 'Arial',sans-serif;\">&#8220;A. Adayl\u0131k ve se\u00e7imi MADDE 101: Cumhurba\u015fkan\u0131, k\u0131rk ya\u015f\u0131n\u0131 doldurmu\u015f, y\u00fcksek\u00f6\u011frenim yapm\u0131\u015f, Milletvekili se\u00e7ilme yeterlili\u011fine sahip, T\u00fcrk vatanda\u015flar\u0131 aras\u0131ndan, do\u011frudan halk taraf\u0131ndan se\u00e7ilir. Cumhurba\u015fkan\u0131n\u0131n g\u00f6rev s\u00fcresi be\u015f y\u0131ld\u0131r. Bir kimse en fazla iki defa Cumhurba\u015fkan\u0131 se\u00e7ilebilir. Cumhurba\u015fkanl\u0131\u011f\u0131na, siyasi parti gruplar\u0131, en son yap\u0131lan genel se\u00e7imlerde toplam ge\u00e7erli oylar\u0131n tek ba\u015f\u0131na veya birlikte en az y\u00fczde be\u015fini alm\u0131\u015f olan siyasi partiler ile en az y\u00fcz bin se\u00e7men aday g\u00f6sterebilir. Cumhurba\u015fkan\u0131 se\u00e7ilen milletvekilinin T\u00fcrkiye B\u00fcy\u00fck Millet Meclisi \u00fcyeli\u011fi sona erer. Genel oyla yap\u0131lacak se\u00e7imde, ge\u00e7erli oylar\u0131n salt \u00e7o\u011funlu\u011funu alan aday Cumhurba\u015fkan\u0131 se\u00e7ilir. \u0130lk oylamada bu \u00e7o\u011funluk sa\u011flanamazsa, bu oylamay\u0131 izleyen ikinci pazar g\u00fcn\u00fc ikinci oylama yap\u0131l\u0131r. Bu oylamaya, ilk oylamada en \u00e7ok oy alm\u0131\u015f iki aday kat\u0131l\u0131r ve ge\u00e7erli oylar\u0131n \u00e7o\u011funlu\u011funu alan aday Cumhurba\u015fkan\u0131 se\u00e7ilir. \u0130kinci oylamaya kat\u0131lmaya hak kazanan adaylardan birinin herhangi bir nedenle se\u00e7ime kat\u0131lmamas\u0131 halinde; ikinci oylama, bo\u015falan adayl\u0131\u011f\u0131n birinci oylamadaki s\u0131raya g\u00f6re ikame edilmesi suretiyle yap\u0131l\u0131r. \u0130kinci oylamaya tek aday\u0131n kalmas\u0131 halinde, bu oylama referandum \u015feklinde yap\u0131l\u0131r. Aday, ge\u00e7erli oylar\u0131n salt \u00e7o\u011funlu\u011funu ald\u0131\u011f\u0131 takdirde Cumhurba\u015fkan\u0131 se\u00e7ilir. Oylamada, aday\u0131n ge\u00e7erli oylar\u0131n \u00e7o\u011funlu\u011funu alamamas\u0131 halinde, sadece Cumhurba\u015fkan\u0131 se\u00e7imi yenilenir. Se\u00e7imlerin tamamlanamamas\u0131 halinde, yenisi g\u00f6reve ba\u015flay\u0131ncaya kadar mevcut Cumhurba\u015fkan\u0131n\u0131n g\u00f6revi devam eder. Cumhurba\u015fkanl\u0131\u011f\u0131 se\u00e7imlerine ili\u015fkin di\u011fer usul ve esaslar kanunla d\u00fczenlenir.\u201d<\/span><\/strong><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; text-indent: 1cm; line-height: 16pt;\"><strong><span style=\"font-size: 12pt; font-family: 'Arial',sans-serif;\">MADDE 8:<\/span><\/strong><strong><span style=\"font-size: 12pt; font-family: 'Arial',sans-serif;\"> 2709 say\u0131l\u0131 Kanunun 104\u2019\u00fcnc\u00fc maddesi a\u015fa\u011f\u0131daki \u015fekilde de\u011fi\u015ftirilmi\u015ftir;<\/span><\/strong><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; text-indent: 1cm; line-height: 16pt;\"><strong><span style=\"font-size: 12pt; font-family: 'Arial',sans-serif;\">\u201cMADDE 104: Cumhurba\u015fkan\u0131 Devletin ba\u015f\u0131d\u0131r. Y\u00fcr\u00fctme yetkisi Cumhurba\u015fkan\u0131na aittir. Cumhurba\u015fkan\u0131, Devlet Ba\u015fkan\u0131 s\u0131fat\u0131yla T\u00fcrkiye Cumhuriyeti\u2019ni ve T\u00fcrk Milletinin birli\u011fini temsil eder; Anayasan\u0131n uygulanmas\u0131n\u0131, Devlet organlar\u0131n\u0131n d\u00fczenli ve uyumlu \u00e7al\u0131\u015fmas\u0131n\u0131 temin eder. Gerekli g\u00f6rd\u00fc\u011f\u00fc takdirde, yasama y\u0131l\u0131n\u0131n ilk g\u00fcn\u00fc T\u00fcrkiye B\u00fcy\u00fck Millet Meclisinde a\u00e7\u0131l\u0131\u015f konu\u015fmas\u0131n\u0131 yapar. \u00dclkenin i\u00e7 ve d\u0131\u015f siyaseti hakk\u0131nda Meclise mesaj verir. Kanunlar\u0131 yay\u0131mlar. Kanunlar\u0131 tekrar g\u00f6r\u00fc\u015f\u00fclmek \u00fczere T\u00fcrkiye B\u00fcy\u00fck Millet Meclisine geri g\u00f6nderir. Kanunlar\u0131n, T\u00fcrkiye B\u00fcy\u00fck Millet Meclisi \u0130\u00e7t\u00fcz\u00fc\u011f\u00fcn\u00fcn t\u00fcm\u00fcn\u00fcn veya belirli h\u00fck\u00fcmlerinin Anayasaya \u015fekil veya esas bak\u0131m\u0131ndan ayk\u0131r\u0131 olduklar\u0131 gerek\u00e7esiyle Anayasa Mahkemesinde iptal davas\u0131 a\u00e7ar. Cumhurba\u015fkan\u0131 Yard\u0131mc\u0131lar\u0131 ile Bakanlar\u0131 atar ve g\u00f6revlerine son verir. \u00dcst kademe kamu y\u00f6neticilerini atar, g\u00f6revlerine son verir ve bunlar\u0131n atanmalar\u0131na ili\u015fkin usul ve esaslar\u0131 Cumhurba\u015fkanl\u0131\u011f\u0131 kararnamesiyle d\u00fczenler. Yabanc\u0131 devletlere T\u00fcrkiye Cumhuriyeti\u2019nin temsilcilerini g\u00f6nderir, T\u00fcrkiye Cumhuriyeti\u2019ne g\u00f6nderilecek yabanc\u0131 devlet temsilcilerini kabul eder. Milletleraras\u0131 antla\u015fmalar\u0131 onaylar ve yay\u0131mlar. Anayasa de\u011fi\u015fikliklerine ili\u015fkin kanunlar\u0131 gerekli g\u00f6rd\u00fc\u011f\u00fc takdirde halkoyuna sunar. Milli g\u00fcvenlik politikalar\u0131n\u0131 belirler ve gerekli tedbirleri al\u0131r.<\/span><\/strong><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; text-indent: 1cm; line-height: 16pt;\"><strong><span style=\"font-size: 12pt; font-family: 'Arial',sans-serif;\">T\u00fcrkiye B\u00fcy\u00fck Millet Meclisi ad\u0131na T\u00fcrk Silahl\u0131 Kuvvetlerinin Ba\u015fkomutanl\u0131\u011f\u0131n\u0131 temsil eder. T\u00fcrk Silahl\u0131 Kuvvetlerinin kullan\u0131lmas\u0131na karar verir. S\u00fcrekli hastal\u0131k, sakatl\u0131k ve kocama sebebiyle ki\u015filerin cezalar\u0131n\u0131 hafifletir veya kald\u0131r\u0131r. Cumhurba\u015fkan\u0131, y\u00fcr\u00fctme yetkisine ili\u015fkin konularda Cumhurba\u015fkanl\u0131\u011f\u0131 kararnamesi \u00e7\u0131karabilir. Anayasan\u0131n ikinci k\u0131sm\u0131n\u0131n birinci ve ikinci b\u00f6l\u00fcmlerinde yer alan temel haklar, ki\u015fi haklar\u0131 ve \u00f6devleriyle d\u00f6rd\u00fcnc\u00fc b\u00f6l\u00fcmde yer alan siyasi haklar ve \u00f6devler Cumhurba\u015fkanl\u0131\u011f\u0131 kararnamesiyle d\u00fczenlenemez. Anayasada m\u00fcnhas\u0131ran kanunla d\u00fczenlenmesi \u00f6ng\u00f6r\u00fclen konularda Cumhurba\u015fkanl\u0131\u011f\u0131 kararnamesi \u00e7\u0131kar\u0131lamaz. Kanunda a\u00e7\u0131k\u00e7a d\u00fczenlenen konularda Cumhurba\u015fkanl\u0131\u011f\u0131 kararnamesi \u00e7\u0131kar\u0131lamaz. Cumhurba\u015fkanl\u0131\u011f\u0131 kararnamesiyle kanunlarda farkl\u0131 h\u00fck\u00fcmler bulunmas\u0131 halinde, kanun h\u00fck\u00fcmleri uygulan\u0131r. T\u00fcrkiye B\u00fcy\u00fck Millet Meclisinin ayn\u0131 konuda kanun \u00e7\u0131karmas\u0131 durumunda, Cumhurba\u015fkanl\u0131\u011f\u0131 kararnamesi h\u00fck\u00fcms\u00fcz hale gelir. Cumhurba\u015fkan\u0131, kanunlar\u0131n uygulanmas\u0131n\u0131 sa\u011flamak \u00fczere ve bunlara ayk\u0131r\u0131 olmamak \u015fart\u0131yla, y\u00f6netmelikler \u00e7\u0131karabilir. Kararnameler ve y\u00f6netmelikler, yay\u0131mdan sonraki bir tarih belirlenmemi\u015fse, Resm\u00ee Gazetede yay\u0131mland\u0131klar\u0131 g\u00fcn y\u00fcr\u00fcrl\u00fc\u011fe girer. Cumhurba\u015fkan\u0131, ayr\u0131ca Anayasada ve kanunlarda verilen se\u00e7me ve atama g\u00f6revleri ile di\u011fer g\u00f6revleri yerine getirir ve yetkileri kullan\u0131r.\u201d<\/span><\/strong><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; text-indent: 1cm; line-height: 16pt;\"><strong><em><span style=\"font-size: 14pt; font-family: 'Arial',sans-serif;\">\u2022 Bu madde y\u00fcr\u00fctmeyi tamamen Cumhurba\u015fkan\u0131na vermekle Meclisi g\u00f6stermelik, hatta sembolik konuma ta\u015f\u0131maktad\u0131r.<\/span><\/em><\/strong><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; text-indent: 1cm; line-height: 16pt;\"><strong><span style=\"font-size: 12pt; font-family: 'Arial',sans-serif;\">MADDE 9:<\/span><\/strong><strong><span style=\"font-size: 12pt; font-family: 'Arial',sans-serif;\"> 2709 say\u0131l\u0131 Kanunun 105\u2019inci maddesi ba\u015fl\u0131\u011f\u0131yla birlikte a\u015fa\u011f\u0131daki \u015fekilde de\u011fi\u015ftirilmi\u015ftir.<\/span><\/strong><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; text-indent: 1cm; line-height: 16pt;\"><strong><span style=\"font-size: 12pt; font-family: 'Arial',sans-serif;\">\u201cE. Cumhurba\u015fkan\u0131n\u0131n cezai sorumlulu\u011fu MADDE 105- Cumhurba\u015fkan\u0131 hakk\u0131nda, bir su\u00e7 i\u015fledi\u011fi iddias\u0131yla T\u00fcrkiye B\u00fcy\u00fck Millet Meclisi \u00fcye tamsay\u0131s\u0131n\u0131n salt \u00e7o\u011funlu\u011funun verece\u011fi \u00f6nergeyle soru\u015fturma a\u00e7\u0131lmas\u0131 istenebilir. Meclis, \u00f6nergeyi en ge\u00e7 bir ay i\u00e7inde g\u00f6r\u00fc\u015f\u00fcr ve \u00fcye tamsay\u0131s\u0131n\u0131n be\u015fte \u00fc\u00e7\u00fcn\u00fcn gizli oyuyla soru\u015fturma a\u00e7\u0131lmas\u0131na karar verebilir. Cumhurba\u015fkan\u0131 yard\u0131mc\u0131lar\u0131, Cumhurba\u015fkan\u0131na vek\u00e2let ve bakanlar MADDE 106- Cumhurba\u015fkan\u0131, se\u00e7ildikten sonra bir veya daha fazla Cumhurba\u015fkan\u0131 yard\u0131mc\u0131s\u0131 atayabilir. Ola\u011fan\u00fcst\u00fc hal y\u00f6netimi MADDE 119: Cumhurba\u015fkan\u0131; sava\u015f, sava\u015f\u0131 gerektirecek bir durumun ba\u015f g\u00f6stermesi, seferberlik, ayaklanma, vatan veya Cumhuriyete kar\u015f\u0131 kuvvetli ve eylemli bir kalk\u0131\u015fma, \u00fclkenin ve milletin b\u00f6l\u00fcnmezli\u011fini i\u00e7ten veya d\u0131\u015ftan tehlikeye d\u00fc\u015f\u00fcren \u015fiddet hareketlerinin yayg\u0131nla\u015fmas\u0131, anayasal d\u00fczeni veya temel hak ve h\u00fcrriyetleri ortadan kald\u0131rmaya y\u00f6nelik yayg\u0131n \u015fiddet hareketlerinin ortaya \u00e7\u0131kmas\u0131, \u015fiddet olaylar\u0131 nedeniyle kamu d\u00fczeninin cidd\u00ee \u015fekilde bozulmas\u0131, tabi\u00ee afet veya tehlikeli salg\u0131n hastal\u0131k ya da a\u011f\u0131r ekonomik bunal\u0131m\u0131n ortaya \u00e7\u0131kmas\u0131 hallerinde yurdun tamam\u0131nda veya bir b\u00f6lgesinde, s\u00fcresi alt\u0131 ay\u0131 ge\u00e7memek \u00fczere ola\u011fan\u00fcst\u00fc hal ilan edebilir. Ola\u011fan\u00fcst\u00fc hal ilan\u0131 karar\u0131 verildi\u011fi g\u00fcn Resm\u00ee Gazetede yay\u0131mlan\u0131r ve ayn\u0131 g\u00fcn T\u00fcrkiye B\u00fcy\u00fck Millet Meclisinin onay\u0131na sunulur. T\u00fcrkiye B\u00fcy\u00fck Millet Meclisi tatilde ise derhal toplant\u0131ya \u00e7a\u011f\u0131r\u0131l\u0131r; Meclis gerekli g\u00f6rd\u00fc\u011f\u00fc takdirde ola\u011fan\u00fcst\u00fc halin s\u00fcresini k\u0131saltabilir, uzatabilir veya ola\u011fan\u00fcst\u00fc hali kald\u0131rabilir. Cumhurba\u015fkan\u0131n\u0131n talebiyle T\u00fcrkiye B\u00fcy\u00fck Millet Meclisi her defas\u0131nda d\u00f6rt ay\u0131 ge\u00e7memek \u00fczere s\u00fcreyi uzatabilir. Sava\u015f hallerinde bu d\u00f6rt ayl\u0131k s\u00fcre aranmaz. Ola\u011fan\u00fcst\u00fc hallerde vatanda\u015flar i\u00e7in getirilecek para, mal ve \u00e7al\u0131\u015fma y\u00fck\u00fcml\u00fcl\u00fckleri ile 15\u2019inci maddedeki ilkeler do\u011frultusunda temel hak ve h\u00fcrriyetlerin nas\u0131l s\u0131n\u0131rlanaca\u011f\u0131 veya ge\u00e7ici olarak durdurulaca\u011f\u0131, hangi h\u00fck\u00fcmlerin uygulanaca\u011f\u0131 ve i\u015flemlerin nas\u0131l y\u00fcr\u00fct\u00fclece\u011fi kanunla d\u00fczenlenir. Ola\u011fan\u00fcst\u00fc hallerde Cumhurba\u015fkan\u0131, ola\u011fan\u00fcst\u00fc halin gerekli k\u0131ld\u0131\u011f\u0131 konularda, 104\u2019\u00fcnc\u00fc maddenin on yedinci f\u0131kras\u0131n\u0131n ikinci c\u00fcmlesinde belirtilen s\u0131n\u0131rlamalara tabi olmaks\u0131z\u0131n Cumhurba\u015fkanl\u0131\u011f\u0131 kararnamesi \u00e7\u0131karabilir. Kurulun T\u00fcrkiye B\u00fcy\u00fck Millet Meclisi taraf\u0131ndan se\u00e7ilecek \u00fcyeliklerine ili\u015fkin ba\u015fvurular, Meclis Ba\u015fkanl\u0131\u011f\u0131na yap\u0131l\u0131r. Ba\u015fkanl\u0131k, ba\u015fvurular\u0131 Anayasa ve Adalet Komisyonlar\u0131 \u00dcyelerinden Kurulu Karma Komisyona g\u00f6nderir. Komisyon her bir \u00fcyelik i\u00e7in \u00fc\u00e7 aday\u0131, \u00fcye tamsay\u0131s\u0131n\u0131n \u00fc\u00e7te iki \u00e7o\u011funlu\u011fuyla belirler. Birinci oylamada aday belirleme i\u015fleminin sonu\u00e7land\u0131r\u0131lamamas\u0131 halinde ikinci oylamada \u00fcye tamsay\u0131s\u0131n\u0131n be\u015fte \u00fc\u00e7 \u00e7o\u011funlu\u011fu aran\u0131r. Ba\u015fvurular, bu maddenin y\u00fcr\u00fcrl\u00fc\u011fe girdi\u011fi tarihten itibaren be\u015f g\u00fcn i\u00e7inde T\u00fcrkiye B\u00fcy\u00fck Millet Meclisi Ba\u015fkanl\u0131\u011f\u0131na yap\u0131l\u0131r. Ba\u015fkanl\u0131k, ba\u015fvurular\u0131 Anayasa ve Adalet Komisyonlar\u0131 \u00dcyelerinden Kurulu Karma Komisyona g\u00f6nderir. Komisyon on g\u00fcn i\u00e7inde her bir \u00fcyelik i\u00e7in \u00fc\u00e7 aday\u0131 \u00fcye tamsay\u0131s\u0131n\u0131n \u00fc\u00e7te iki \u00e7o\u011funlu\u011fuyla belirler. Birinci oylamada \u00fc\u00e7te iki \u00e7o\u011funlukla se\u00e7imin sonu\u00e7land\u0131r\u0131lamamas\u0131 halinde, ikinci ve \u00fc\u00e7\u00fcnc\u00fc oylamalar yap\u0131l\u0131r; bu oylamalarda \u00fcye tamsay\u0131s\u0131n\u0131n be\u015fte \u00fc\u00e7 \u00e7o\u011funlu\u011funun oyunu alan aday se\u00e7ilmi\u015f olur. Be\u015fte \u00fc\u00e7 \u00e7o\u011funlu\u011fun sa\u011flanamamas\u0131 halinde \u00fc\u00e7\u00fcnc\u00fc oylamada en \u00e7ok oyu alm\u0131\u015f olan, se\u00e7ilecek \u00fcyelerin iki kat\u0131 aday aras\u0131ndan ad \u00e7ekme usul\u00fc ile \u00fcye belirleme i\u015flemi tamamlan\u0131r. T\u00fcrkiye B\u00fcy\u00fck Millet Meclisi Genel Kurulu ayn\u0131 usul ve nisaplar\u0131 g\u00f6zeterek on be\u015f g\u00fcn i\u00e7inde se\u00e7imi tamamlar. Mevcut H\u00e2kimler ve Savc\u0131lar Y\u00fcksek Kurulu \u00fcyeleri, yeni \u00fcyelerin g\u00f6reve ba\u015flayaca\u011f\u0131 tarihe kadar g\u00f6revlerine devam eder ve bu s\u00fcre i\u00e7inde y\u00fcr\u00fcrl\u00fckteki Kanun h\u00fck\u00fcmlerine g\u00f6re \u00e7al\u0131\u015f\u0131r. Yeni \u00fcyeler, ilgili kanunda de\u011fi\u015fiklik yap\u0131l\u0131ncaya kadar mevcut Kanunun Anayasaya ayk\u0131r\u0131 olmayan h\u00fck\u00fcmleri uyar\u0131nca \u00e7al\u0131\u015f\u0131r. G\u00f6revi sona eren ve H\u00e2kimler ve Savc\u0131lar Kuruluna yeniden se\u00e7ilmeyen \u00fcyelerden, talepleri halinde adli yarg\u0131 h\u00e2kim ve savc\u0131lar\u0131 aras\u0131ndan se\u00e7ilenler Yarg\u0131tay \u00fcyeli\u011fine, idari yarg\u0131 h\u00e2kim ve savc\u0131lar\u0131 aras\u0131ndan se\u00e7ilenler Dan\u0131\u015ftay \u00fcyeli\u011fine H\u00e2kimler ve Savc\u0131lar Kurulunca se\u00e7ilir; \u00f6\u011fretim \u00fcyeleri ve avukatlar aras\u0131ndan se\u00e7ilenler ise Dan\u0131\u015ftay \u00fcyeli\u011fine Cumhurba\u015fkan\u0131nca atan\u0131r. Bu \u015fekilde yap\u0131lan se\u00e7im ve atamalarda bo\u015f kadro olup olmad\u0131\u011f\u0131na bak\u0131lmaz, se\u00e7ilen ve atanan \u00fcye say\u0131s\u0131 kadar Yarg\u0131tay ve Dan\u0131\u015ftay kadrolar\u0131na \u00fcye kadrosu ilave edilir.<\/span><\/strong><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; text-indent: 1cm; line-height: 16pt;\"><strong><span style=\"font-size: 12pt; font-family: 'Arial',sans-serif;\">D) Asker\u00ee Yarg\u0131tay ve Asker\u00ee Y\u00fcksek \u0130dare Mahkemesinden Anayasa Mahkemesi \u00fcyeli\u011fine se\u00e7ilmi\u015f bulunan ki\u015filerin herhangi bir sebeple g\u00f6revleri sona erene kadar \u00fcyelikleri devam eder.<\/span><\/strong><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; text-indent: 1cm; line-height: 16pt;\"><strong><span style=\"font-size: 12pt; font-family: 'Arial',sans-serif;\">E) Bu Kanunun y\u00fcr\u00fcrl\u00fc\u011fe girdi\u011fi tarih itibar\u0131yla Asker\u00ee Yarg\u0131tay, Asker\u00ee Y\u00fcksek \u0130dare Mahkemesi ve asker\u00ee mahkemeler kald\u0131r\u0131lm\u0131\u015ft\u0131r. Bu Kanunun y\u00fcr\u00fcrl\u00fc\u011fe girdi\u011fi tarihten itibaren d\u00f6rt ay i\u00e7inde; Asker\u00ee Yarg\u0131tay ve Asker\u00ee Y\u00fcksek \u0130dare Mahkemesinin asker\u00ee h\u00e2kim s\u0131n\u0131f\u0131ndan Ba\u015fkan, Ba\u015fsavc\u0131, \u0130kinci Ba\u015fkan ve \u00fcyeleri ile di\u011fer asker\u00ee h\u00e2kimler (yedek subaylar hari\u00e7) tercihleri ve m\u00fcktesepleri dikkate al\u0131narak;<\/span><\/strong><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; text-indent: 1cm; line-height: 16pt;\"><strong><span style=\"font-size: 12pt; font-family: 'Arial',sans-serif;\">a) H\u00e2kimler ve Savc\u0131lar Kurulunca adli veya idari yarg\u0131da h\u00e2kim veya savc\u0131 olarak atanabilirler.<\/span><\/strong><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; text-indent: 1cm; line-height: 16pt;\"><strong><span style=\"font-size: 12pt; font-family: 'Arial',sans-serif;\">b) Ayl\u0131k, ek g\u00f6sterge, \u00f6denek, yarg\u0131 \u00f6dene\u011fi, ek \u00f6deme, mal\u00ee, sosyal hak ve yard\u0131mlar ile di\u011fer haklar\u0131 y\u00f6n\u00fcnden emsali adli veya idari yarg\u0131ya mensup h\u00e2kim ve savc\u0131lar, bunlar\u0131n d\u0131\u015f\u0131ndaki hak ve y\u00fck\u00fcml\u00fcl\u00fckler y\u00f6n\u00fcnden ise bu Kanunun y\u00fcr\u00fcrl\u00fc\u011fe girdi\u011fi tarihteki mevzuat h\u00fck\u00fcmleri uygulanmaya devam edilmek suretiyle Mill\u00ee Savunma Bakanl\u0131\u011f\u0131nca mevcut s\u0131n\u0131flar\u0131nda, Bakanl\u0131k veya Genelkurmay Ba\u015fkanl\u0131\u011f\u0131n\u0131n hukuk hizmetleri kadrolar\u0131na atan\u0131rlar. Bunlardan, emeklilik hakk\u0131n\u0131 elde edenlerden ya\u015f haddinden \u00f6nce bu g\u00f6revlerden kendi istekleriyle ayr\u0131lacaklara \u00f6denecek tazminata ili\u015fkin usul ve esaslar kanunla d\u00fczenlenir. Kald\u0131r\u0131lan asker\u00ee yarg\u0131 mercilerinde g\u00f6r\u00fclmekte olan dosyalardan; kanun yolu incelemesi a\u015famas\u0131nda olanlar ilgisine g\u00f6re Yarg\u0131tay veya Dan\u0131\u015ftay\u2019a, di\u011fer dosyalar ise ilgisine g\u00f6re g\u00f6revli ve yetkili adli veya idari yarg\u0131 mercilerine d\u00f6rt ay i\u00e7inde g\u00f6nderilir.<\/span><\/strong><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; text-indent: 1cm; line-height: 16pt;\"><strong><span style=\"font-size: 12pt; font-family: 'Arial',sans-serif;\">F) Bu Kanunun y\u00fcr\u00fcrl\u00fc\u011fe girdi\u011fi tarihte y\u00fcr\u00fcrl\u00fckte bulunan kanun h\u00fckm\u00fcnde kararnameler, t\u00fcz\u00fckler, Ba\u015fbakanl\u0131k ve Bakanlar Kurulu taraf\u0131ndan \u00e7\u0131kar\u0131lan y\u00f6netmelikler ile di\u011fer d\u00fczenleyici i\u015flemler y\u00fcr\u00fcrl\u00fckten kald\u0131r\u0131lmad\u0131k\u00e7a ge\u00e7erlili\u011fini s\u00fcrd\u00fcr\u00fcr. Yani Anayasa h\u00fck\u00fcmleri; yasama, y\u00fcr\u00fctme ve yarg\u0131 organlar\u0131n\u0131, idare makamlar\u0131n\u0131 ve di\u011fer kurulu\u015f ve ki\u015fileri ba\u011flayan temel hukuk kurallar\u0131d\u0131r. Kanunlar Anayasaya ayk\u0131r\u0131 olamayacakt\u0131r. Buna g\u00f6re, \u201cAnayasan\u0131n \u00fcst\u00fcnl\u00fc\u011f\u00fc\u201d kavram\u0131, en ba\u015fta yasalar\u0131n Anayasa\u2019ya ayk\u0131r\u0131 olamayaca\u011f\u0131n\u0131 anlat\u0131r. Yani T\u00fcrkiye B\u00fcy\u00fck Millet Meclisi (TBMM) Anayasa\u2019ya uygun yasalar yapmak zorundad\u0131r. D\u00fcnyada bir\u00e7ok anayasal sistemde, yasalar\u0131n Anayasa\u2019ya uygun olup olmad\u0131\u011f\u0131 yarg\u0131 organ\u0131 taraf\u0131ndan denetlenir durumdad\u0131r. Bizim anayasal sistemimizde bu g\u00f6revi Anayasa Mahkemesi yapmaktad\u0131r. Anayasa Mahkemesi Anayasa\u2019ya ayk\u0131r\u0131 yasalar\u0131 iptal ederek \u201cAnayasan\u0131n \u00fcst\u00fcnl\u00fc\u011f\u00fc\u201d ilkesini korumaktad\u0131r. <\/span><\/strong><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; text-indent: 1cm; line-height: 16pt;\"><strong><span style=\"font-size: 12pt; font-family: 'Arial',sans-serif;\">Yasama organ\u0131 gibi, y\u00fcr\u00fctme organ\u0131 da Anayasa ile ba\u011fl\u0131d\u0131r. \u0130dari yarg\u0131, idarenin eylem ve i\u015flemlerinin hukuka uygunlu\u011funu denetlerken ayn\u0131 zamanda idarenin Anayasa\u2019ya uygun hareket etmesini sa\u011flamaktad\u0131r. <\/span><\/strong><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; text-indent: 1cm; line-height: 16pt;\"><strong><span style=\"font-size: 12pt; font-family: 'Arial',sans-serif;\">Yarg\u0131 organ\u0131 a\u00e7\u0131s\u0131ndan da hukuk sistemindeki en \u00fcst\u00fcn yasa Anayasa\u2019d\u0131r. Yarg\u0131\u00e7lar, \u00f6nlerine gelen davalarda yasalar\u0131 uygularken, uyu\u015fmazl\u0131klar\u0131 \u00e7\u00f6zerken veya \u201cT\u00fcrk Milleti\u201d ad\u0131na cezaland\u0131rma yetkisini kullan\u0131rken hep Anayasa\u2019n\u0131n \u00e7izdi\u011fi \u00e7er\u00e7eve i\u00e7inde davranacakt\u0131r. Devlet organlar\u0131 d\u0131\u015f\u0131nda t\u00fcm \u00f6zel ve t\u00fczel ki\u015filer de <\/span><\/strong><strong><em><span style=\"font-size: 14pt; font-family: 'Arial',sans-serif;\">\u201cAnayasan\u0131n \u00fcst\u00fcnl\u00fc\u011f\u00fc\u201d<\/span><\/em><\/strong> <strong><span style=\"font-size: 12pt; font-family: 'Arial',sans-serif;\">ilkesine sayg\u0131 g\u00f6stermek zorundad\u0131r. <\/span><\/strong><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; text-indent: 1cm; line-height: 16pt;\"><strong><span style=\"font-size: 12pt; font-family: 'Arial',sans-serif;\">Hukuk kurallar\u0131; toplumsal ili\u015fkileri d\u00fczenleyen esaslard\u0131r. Bireyler, hukuk kurallar\u0131n\u0131n sa\u011flad\u0131\u011f\u0131 net ve kesin yasalar sayesinde, toplumsal ili\u015fkilerde rahatl\u0131\u011fa ve g\u00fcven ortam\u0131na kavu\u015fmaktad\u0131r. Anayasa sadece bireyler i\u00e7in de\u011fil devlet i\u00e7in de \u00f6nemli bir dayanakt\u0131r ve devletin temel yap\u0131s\u0131n\u0131 kuran belge Anayasa\u2019d\u0131r. Devletin \u00fc\u00e7 temel organ\u0131n\u0131n, yani yasama, y\u00fcr\u00fctme ve yarg\u0131n\u0131n kurulu\u015f ve i\u015fleyi\u015fine ili\u015fkin esaslar Anayasa\u2019da yer al\u0131r. Bu organlar\u0131n birbirleriyle olan ili\u015fkileri de Anayasa\u2019ya g\u00f6re d\u00fczenlenip ayarlan\u0131r. B\u00fct\u00fcn bunlar\u0131n \u00f6tesinde, devletin kendisine y\u00fcklenen g\u00f6revleri yerine getirmesi i\u00e7in kullanmas\u0131 gereken yetkilerin kayna\u011f\u0131 da Anayasa\u2019d\u0131r. Bu y\u00fczden <\/span><\/strong><strong><em><span style=\"font-size: 14pt; font-family: 'Arial',sans-serif;\">\u201cHi\u00e7bir kimse veya organ kayna\u011f\u0131n\u0131 Anayasadan almayan bir Devlet yetkisi kullanamayacakt\u0131r.\u201d <\/span><\/em><\/strong><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; text-indent: 1cm; line-height: 16pt;\"><strong><span style=\"font-size: 14pt; font-family: 'Arial',sans-serif;\">\u0130\u015fte b\u00fct\u00fcn bunlardan dolay\u0131d\u0131r ki, anayasalar\u0131n \u201cD\u0130L\u2019\u0130\u201d, okuyan herkesin kolayl\u0131kla ayn\u0131 \u015feyi anlayaca\u011f\u0131 \u015fekilde <\/span><\/strong><strong><em><span style=\"font-size: 16pt; font-family: 'Arial',sans-serif;\">net, a\u00e7\u0131k ve kesin<\/span><\/em><\/strong> <strong><span style=\"font-size: 14pt; font-family: 'Arial',sans-serif;\">olmal\u0131 ve bu sadelikle yaz\u0131lmal\u0131d\u0131r. Oysa Referanduma sunulan yukar\u0131daki Yeni anayasa maddeleri de\u011fil vatanda\u015flar\u0131m\u0131z taraf\u0131ndan, hatta hukuk uzmanlar\u0131nca bile \u201cne dedi\u011fi ve neleri i\u00e7erdi\u011fi\u201d anla\u015f\u0131lmayan kapal\u0131 ve karma\u015f\u0131k ifadeler ta\u015f\u0131maktad\u0131r. Yetkililerin keyfi yorumlar\u0131na ve uygulamalar\u0131na m\u00fcsait c\u00fcmleler bar\u0131nd\u0131rmaktad\u0131r. Sanki, kimse bir \u015fey anlamas\u0131n diye haz\u0131rlanm\u0131\u015ft\u0131r. Bu yakla\u015f\u0131m da ku\u015fkular\u0131m\u0131z\u0131 artt\u0131rmaktad\u0131r. Acaba, \u00fclkemiz aleyhine hangi kas\u0131tl\u0131 planlar var ki b\u00f6ylesi sinsi ve tehlikeli de\u011fi\u015fimlere ihtiya\u00e7 duyulmaktad\u0131r? <\/span><\/strong><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; text-indent: 1cm; line-height: 16pt;\"><strong><span style=\"font-size: 12pt; font-family: 'Arial',sans-serif;\">AKP kurucular\u0131ndan ve \u00f6nemli kurmaylar\u0131ndan Cemil \u00c7i\u00e7ek bile referandumlar\u0131m\u0131zda \u201ci\u00e7eri\u011fin\u201d de\u011fil lider ve partilere sadakat ya da tepkilerin \u00f6n planda etkili oldu\u011fundan yak\u0131nmaktad\u0131r. Bu s\u00f6zler Anayasa de\u011fi\u015fikli\u011finin i\u00e7eri\u011finin bilinmedi\u011finin de dolayl\u0131 itiraf\u0131d\u0131r. Geli\u015fmi\u015f demokrasilerde de bunlar\u0131n da etkisi \u00f6nemlidir, ancak \u201ci\u00e7eri\u011fe\u201d \u00f6ncelik veren, \u201ci\u00e7eri\u011fe\u201d bakarak evet veya hay\u0131r y\u00f6n\u00fcnde davranan \u015fuurlu ve sorumlu Milli Duyarl\u0131 kesimler de vard\u0131r. Bizde ise maalesef lider ve parti sadakatlerinin \u00fcst\u00fcnde \u201ci\u00e7eri\u011fe\u201d bakarak ilkesel ve \u00fclkesel \u00f6nceliklerle tav\u0131r alan kesimler pek azd\u0131r ve daha beteri, bu Anayasa de\u011fi\u015fikli\u011fi metni, okunsa bile ne dedi\u011fi ve neleri hedefledi\u011fi anla\u015f\u0131lamamaktad\u0131r. <\/span><\/strong><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; text-indent: 1cm; line-height: 16pt;\"><strong><span style=\"font-size: 12pt; font-family: 'Arial',sans-serif;\">Oysa <\/span><\/strong><strong><span style=\"font-size: 16pt; font-family: 'Arial',sans-serif;\">Anayasa<\/span><\/strong><strong><span style=\"font-size: 12pt; font-family: 'Arial',sans-serif;\">, \u00fclke \u00fczerindeki egemenlik haklar\u0131n\u0131n kullan\u0131m yetkisinin i\u00e7eri\u011finde belirtildi\u011fi \u015fekliyle devlete verildi\u011fini g\u00f6steren toplumsal s\u00f6zle\u015fmeler (kar\u015f\u0131l\u0131kl\u0131 r\u0131zaya dayal\u0131 uzla\u015fma ve konsens\u00fcs metinleri) say\u0131lmaktad\u0131r. Toplumlar\u0131n \u00fclke \u00fczerindeki egemenlik haklar\u0131n\u0131n, bireylerin \u00f6zg\u00fcrl\u00fck alanlar\u0131n\u0131n hangi ko\u015fullar alt\u0131nda devlet taraf\u0131ndan kullan\u0131labilece\u011fini belirleyen temel kanunlard\u0131r. <\/span><\/strong><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; text-indent: 1cm; line-height: 16pt;\"><strong><span style=\"font-size: 14pt; font-family: 'Arial',sans-serif;\">Bu nedenle Anayasan\u0131n herkesi ba\u011flay\u0131c\u0131 olmas\u0131, gayet a\u00e7\u0131k ve anla\u015f\u0131l\u0131r olmas\u0131n\u0131 da gerekli k\u0131lmaktad\u0131r. Cumhurba\u015fkan\u0131 \u201ckararname\u201d \u00e7\u0131kararak do\u011frudan yasama yetkisi kullanacakt\u0131r. D\u00fczenlemede <em>\u201ctemel hak ve \u00f6zg\u00fcrl\u00fckler konusunda s\u0131n\u0131r getirilmesi, yasa ile kararnamenin \u00e7eli\u015fmesi durumunda yasaya \u00fcst\u00fcnl\u00fck tan\u0131nmas\u0131\u201d<\/em> hep laf\u0131 g\u00fczaft\u0131r. \u00c7\u00fcnk\u00fc bu s\u0131n\u0131rlar\u0131n a\u015f\u0131lmas\u0131 durumunda ne yap\u0131laca\u011f\u0131 belirsiz ve karanl\u0131kt\u0131r. Nitekim bug\u00fcn Cumhurba\u015fkan\u0131, \u00f6nleyici bir d\u00fczenek bulunmad\u0131\u011f\u0131, tek g\u00f6revli olan Anayasa Mahkemesi de \u201cayak ba\u011f\u0131\u201d olmaktan \u00e7ekindi\u011fi i\u00e7in Anayasa\u2019n\u0131n bir\u00e7ok kural\u0131n\u0131 ask\u0131ya almaktad\u0131r. Getirilen s\u0131n\u0131rlamalar\u0131n k\u00e2\u011f\u0131t \u00fczerinde kalaca\u011f\u0131 a\u00e7\u0131kt\u0131r.<\/span><\/strong><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; text-indent: 1cm; line-height: 16pt;\"><strong><span style=\"font-size: 12pt; font-family: 'Arial',sans-serif;\">\u00dcstelik Cumhurba\u015fkan\u0131na, kimi alanlar\u0131 kararnamelerle d\u00fczenleme yetkisi de tan\u0131nmaktad\u0131r. \u00d6rne\u011fin Cumhurba\u015fkan\u0131, kararnameler ile kamu kurum ve kurulu\u015flar\u0131n\u0131, yani Devleti yeniden yap\u0131land\u0131racakt\u0131r. \u00dcstelik Cumhurba\u015fkan\u0131 yasalar\u0131, bug\u00fcnk\u00fcnden farkl\u0131 olarak hi\u00e7bir gerek\u00e7e g\u00f6stermeden Meclis\u2019e geri yollayacakt\u0131r. Geri g\u00f6nderme durumunda, metnin yeniden yasala\u015fabilmesi i\u00e7in nitelikli \u00e7o\u011funlukla kabul\u00fc \u015fart ko\u015fulmaktad\u0131r. B\u00f6ylece Cumhurba\u015fkan\u0131na yasalar\u0131 geri \u00e7evirip ya da s\u00fcr\u00fcncemede b\u0131rakarak, o alanlar\u0131 kararnamelerle d\u00fczenleyip \u00fclkeyi y\u00f6netme olana\u011f\u0131 sunulmaktad\u0131r. Cumhurba\u015fkan\u0131na ayr\u0131ca, yasalar\u0131n uygulanmas\u0131n\u0131 sa\u011flamak \u00fczere <\/span><\/strong><strong><span style=\"font-size: 14pt; font-family: 'Arial',sans-serif;\">y\u00f6netmelik \u00e7\u0131karma <\/span><\/strong><strong><span style=\"font-size: 12pt; font-family: 'Arial',sans-serif;\">yetkisi de tan\u0131nmaktad\u0131r. Cumhurba\u015fkan\u0131 b\u00f6ylece yasalar\u0131 yorumlama, kendi anlay\u0131\u015f\u0131 do\u011frultusunda uygulanmalar\u0131n\u0131 sa\u011flama gibi bir yetkiye de kavu\u015fturulmaktad\u0131r.<\/span><\/strong><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; text-indent: 1cm; line-height: 16pt;\"><strong><span style=\"font-size: 14pt; font-family: 'Arial',sans-serif;\">Yarg\u0131 erki Cumhurba\u015fkan\u0131na ba\u011flanacakt\u0131r.<\/span><\/strong><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; text-indent: 1cm; line-height: 16pt;\"><strong><span style=\"font-size: 12pt; font-family: 'Arial',sans-serif;\">Bilindi\u011fi gibi 2010 y\u0131l\u0131 Anayasa de\u011fi\u015fikli\u011fi ile yarg\u0131n\u0131n \u00e7ok \u00f6nemli iki kurulu, Anayasa Mahkemesi ile H\u00e2kimler ve Savc\u0131lar Y\u00fcksek Kurulu (HSYK), verilen atama yetkileriyle siyasal iktidara ba\u011fl\u0131 konuma ta\u015f\u0131nm\u0131\u015ft\u0131r. Bug\u00fcnk\u00fc Anayasa de\u011fi\u015fikli\u011fiyle HSYK\u2019n\u0131n yap\u0131s\u0131 yeniden d\u00fczenlenmekte ve \u00e7ok daha ba\u011f\u0131ml\u0131 hale sokulmaktad\u0131r. Bir kez, neden gerek duyuldu ise HSYK <\/span><\/strong><strong><em><span style=\"font-size: 14pt; font-family: 'Arial',sans-serif;\">\u201cY\u00fcksek\u201d<\/span><\/em><\/strong><strong><span style=\"font-size: 12pt; font-family: 'Arial',sans-serif;\"> stat\u00fcs\u00fcnden \u00e7\u0131kar\u0131lmaktad\u0131r. Kurulun Ba\u015fkan\u0131 Adalet Bakan\u0131d\u0131r. Geri kalan 11 \u00fcyenin 5\u2019ini Cumhurba\u015fkan\u0131, 6\u2019s\u0131n\u0131 TBMM se\u00e7ip atayacakt\u0131r. Yani siyasal iktidar Kurula do\u011frudan sahip olacakt\u0131r. Yani Meclis\u2019e de egemen olan Cumhurba\u015fkan\u0131 HSK \u00fcyelerinin t\u00fcm\u00fcn\u00fc atama yetkisiyle donat\u0131lm\u0131\u015f durumdad\u0131r. Se\u00e7imlerin belli mesleki kontenjanlar i\u00e7inden yap\u0131lacak olmas\u0131 sonuca etkili de\u011fildir. \u00c7\u00fcnk\u00fc \u201cisteklere\u201d uygun adaylar her zaman bulunabilecektir. \u00dclkemiz bu y\u00f6nden olduk\u00e7a zengin bir kayna\u011fa sahiptir.<\/span><\/strong><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; text-indent: 1cm; line-height: 16pt;\"><strong><span style=\"font-size: 14pt; font-family: 'Arial',sans-serif;\">Y\u00fcr\u00fctmenin de ba\u015f\u0131 Cumhurba\u015fkan\u0131d\u0131r!<\/span><\/strong><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; text-indent: 1cm; line-height: 16pt;\"><strong><span style=\"font-size: 12pt; font-family: 'Arial',sans-serif;\">Cumhurba\u015fkan\u0131 hem Devletin hem de y\u00fcr\u00fctmenin ba\u015f\u0131d\u0131r.
