T&uuml;rkiye B&uuml;y&uuml;k Millet Meclisi ve Cumhurba\u015fkan\u0131n\u0131n se&ccedil;im d&ouml;nemi MADDE 77- T&uuml;rkiye B&uuml;y&uuml;k Millet Meclisi ve Cumhurba\u015fkanl\u0131\u011f\u0131 se&ccedil;imleri be\u015f y\u0131lda bir ayn\u0131 g&uuml;nde yap\u0131l\u0131r. S&uuml;resi biten Milletvekili yeniden se&ccedil;ilebilir. Cumhurba\u015fkanl\u0131\u011f\u0131 se&ccedil;iminde birinci oylamada gerekli &ccedil;o\u011funlu\u011fun sa\u011flanamamas\u0131 halinde 101&rsquo;inci maddedeki usule g&ouml;re ikinci oylama yap\u0131l\u0131r.&rdquo;<\/span><\/strong><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; text-indent: 1cm; line-height: 16pt;\"><strong><span style=\"font-size: 12pt; font-family: 'Arial',sans-serif;\">MADDE 5:<\/span><\/strong><strong><span style=\"font-size: 12pt; font-family: 'Arial',sans-serif;\"> 2709 say\u0131l\u0131 Kanunun 87&rsquo;nci maddesi a\u015fa\u011f\u0131daki \u015fekilde de\u011fi\u015ftirilmi\u015ftir;<\/span><\/strong><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; text-indent: 1cm; line-height: 16pt;\"><strong><span style=\"font-size: 12pt; font-family: 'Arial',sans-serif;\">&ldquo;MADDE 87: T&uuml;rkiye B&uuml;y&uuml;k Millet Meclisinin g&ouml;rev ve yetkileri, kanun koymak, de\u011fi\u015ftirmek ve kald\u0131rmak; b&uuml;t&ccedil;e ve kesin hesap kanun tekliflerini g&ouml;r&uuml;\u015fmek ve kabul etmek; para bas\u0131lmas\u0131na ve sava\u015f il&acirc;n\u0131na karar vermek; milletleraras\u0131 antla\u015fmalar\u0131n onaylanmas\u0131n\u0131 uygun bulmak, T&uuml;rkiye B&uuml;y&uuml;k Millet Meclisi &uuml;ye tamsay\u0131s\u0131n\u0131n be\u015fte &uuml;&ccedil; &ccedil;o\u011funlu\u011funun karar\u0131 ile genel ve &ouml;zel af il&acirc;n\u0131na karar vermek ve Anayasan\u0131n di\u011fer maddelerinde &ouml;ng&ouml;r&uuml;len yetkileri kullanmak ve g&ouml;revleri yerine getirmektir.&rdquo;<\/span><\/strong><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; text-indent: 1cm; line-height: 16pt;\"><strong><em><span style=\"font-size: 14pt; font-family: 'Arial',sans-serif;\">&bull; Bu madde ile Meclisin Bakanlar\u0131 denetleme ve gerekirse de\u011fi\u015ftirme yetkisi elinden al\u0131nm\u0131\u015ft\u0131r.<\/span><\/em><\/strong><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; text-indent: 1cm; line-height: 16pt;\"><strong><span style=\"font-size: 12pt; font-family: 'Arial',sans-serif;\">MADDE 6:<\/span><\/strong><strong><span style=\"font-size: 12pt; font-family: 'Arial',sans-serif;\"> 2709 say\u0131l\u0131 Kanunun 98&rsquo;inci maddesi a\u015fa\u011f\u0131daki \u015fekilde de\u011fi\u015ftirilmi\u015f ve kenar ba\u015fl\u0131\u011f\u0131 metinden &ccedil;\u0131kar\u0131lm\u0131\u015ft\u0131r;<\/span><\/strong><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; text-indent: 1cm; line-height: 16pt;\"><strong><span style=\"font-size: 12pt; font-family: 'Arial',sans-serif;\">&ldquo;MADDE 98: T&uuml;rkiye B&uuml;y&uuml;k Millet Meclisi; meclis ara\u015ft\u0131rmas\u0131, genel g&ouml;r&uuml;\u015fme, meclis soru\u015fturmas\u0131 ve yaz\u0131l\u0131 soru yollar\u0131yla bilgi edinme ve denetleme yetkisini kullan\u0131r. Meclis ara\u015ft\u0131rmas\u0131, belli bir konuda bilgi edinmek i&ccedil;in yap\u0131lan incelemeden ibarettir. Genel g&ouml;r&uuml;\u015fme, toplumu ve Devlet faaliyetlerini ilgilendiren belli bir konunun T&uuml;rkiye B&uuml;y&uuml;k Millet Meclisi Genel Kurulunda g&ouml;r&uuml;\u015f&uuml;lmesidir. Meclis soru\u015fturmas\u0131, Cumhurba\u015fkan\u0131 yard\u0131mc\u0131lar\u0131 ve bakanlar hakk\u0131nda 106&rsquo;nc\u0131 maddenin be\u015finci, alt\u0131nc\u0131 ve yedinci f\u0131kralar\u0131 uyar\u0131nca yap\u0131lan soru\u015fturmadan ibarettir. Yaz\u0131l\u0131 soru; yaz\u0131l\u0131 olarak en ge&ccedil; on be\u015f g&uuml;n i&ccedil;inde cevaplanmak &uuml;zere milletvekillerinin, Cumhurba\u015fkan\u0131 yard\u0131mc\u0131lar\u0131 ve bakanlara yaz\u0131l\u0131 olarak soru sormalar\u0131ndan ibarettir. Meclis ara\u015ft\u0131rmas\u0131, genel g&ouml;r&uuml;\u015fme ve yaz\u0131l\u0131 soru &ouml;nergelerinin verilme \u015fekli, i&ccedil;eri\u011fi ve kapsam\u0131 ile ara\u015ft\u0131rma usulleri Meclis \u0130&ccedil;t&uuml;z&uuml;\u011f&uuml; ile d&uuml;zenlenir.&rdquo;<\/span><\/strong><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; text-indent: 1cm; line-height: 16pt;\"><strong><em><span style=\"font-size: 14pt; font-family: 'Arial',sans-serif;\">&bull; Bu madde ile Meclisin denetleme yetkisi budanm\u0131\u015ft\u0131r.<\/span><\/em><\/strong><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; text-indent: 1cm; line-height: 16pt;\"><strong><span style=\"font-size: 12pt; font-family: 'Arial',sans-serif;\">MADDE 7:<\/span><\/strong><strong><span style=\"font-size: 12pt; font-family: 'Arial',sans-serif;\"> 2709 say\u0131l\u0131 Kanunun 101&rsquo;inci maddesi ba\u015fl\u0131\u011f\u0131yla birlikte a\u015fa\u011f\u0131daki \u015fekilde de\u011fi\u015ftirilmi\u015ftir.<\/span><\/strong><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; text-indent: 1cm; line-height: 16pt;\"><strong><span style=\"font-size: 12pt; font-family: 'Arial',sans-serif;\">&#8220;A. Adayl\u0131k ve se&ccedil;imi MADDE 101: Cumhurba\u015fkan\u0131, k\u0131rk ya\u015f\u0131n\u0131 doldurmu\u015f, y&uuml;ksek&ouml;\u011frenim yapm\u0131\u015f, Milletvekili se&ccedil;ilme yeterlili\u011fine sahip, T&uuml;rk vatanda\u015flar\u0131 aras\u0131ndan, do\u011frudan halk taraf\u0131ndan se&ccedil;ilir. Cumhurba\u015fkan\u0131n\u0131n g&ouml;rev s&uuml;resi be\u015f y\u0131ld\u0131r. Bir kimse en fazla iki defa Cumhurba\u015fkan\u0131 se&ccedil;ilebilir. Cumhurba\u015fkanl\u0131\u011f\u0131na, siyasi parti gruplar\u0131, en son yap\u0131lan genel se&ccedil;imlerde toplam ge&ccedil;erli oylar\u0131n tek ba\u015f\u0131na veya birlikte en az y&uuml;zde be\u015fini alm\u0131\u015f olan siyasi partiler ile en az y&uuml;z bin se&ccedil;men aday g&ouml;sterebilir. Cumhurba\u015fkan\u0131 se&ccedil;ilen milletvekilinin T&uuml;rkiye B&uuml;y&uuml;k Millet Meclisi &uuml;yeli\u011fi sona erer. Genel oyla yap\u0131lacak se&ccedil;imde, ge&ccedil;erli oylar\u0131n salt &ccedil;o\u011funlu\u011funu alan aday Cumhurba\u015fkan\u0131 se&ccedil;ilir. \u0130lk oylamada bu &ccedil;o\u011funluk sa\u011flanamazsa, bu oylamay\u0131 izleyen ikinci pazar g&uuml;n&uuml; ikinci oylama yap\u0131l\u0131r. Bu oylamaya, ilk oylamada en &ccedil;ok oy alm\u0131\u015f iki aday kat\u0131l\u0131r ve ge&ccedil;erli oylar\u0131n &ccedil;o\u011funlu\u011funu alan aday Cumhurba\u015fkan\u0131 se&ccedil;ilir. \u0130kinci oylamaya kat\u0131lmaya hak kazanan adaylardan birinin herhangi bir nedenle se&ccedil;ime kat\u0131lmamas\u0131 halinde; ikinci oylama, bo\u015falan adayl\u0131\u011f\u0131n birinci oylamadaki s\u0131raya g&ouml;re ikame edilmesi suretiyle yap\u0131l\u0131r. \u0130kinci oylamaya tek aday\u0131n kalmas\u0131 halinde, bu oylama referandum \u015feklinde yap\u0131l\u0131r. Aday, ge&ccedil;erli oylar\u0131n salt &ccedil;o\u011funlu\u011funu ald\u0131\u011f\u0131 takdirde Cumhurba\u015fkan\u0131 se&ccedil;ilir. Oylamada, aday\u0131n ge&ccedil;erli oylar\u0131n &ccedil;o\u011funlu\u011funu alamamas\u0131 halinde, sadece Cumhurba\u015fkan\u0131 se&ccedil;imi yenilenir. Se&ccedil;imlerin tamamlanamamas\u0131 halinde, yenisi g&ouml;reve ba\u015flay\u0131ncaya kadar mevcut Cumhurba\u015fkan\u0131n\u0131n g&ouml;revi devam eder. Cumhurba\u015fkanl\u0131\u011f\u0131 se&ccedil;imlerine ili\u015fkin di\u011fer usul ve esaslar kanunla d&uuml;zenlenir.&rdquo;<\/span><\/strong><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; text-indent: 1cm; line-height: 16pt;\"><strong><span style=\"font-size: 12pt; font-family: 'Arial',sans-serif;\">MADDE 8:<\/span><\/strong><strong><span style=\"font-size: 12pt; font-family: 'Arial',sans-serif;\"> 2709 say\u0131l\u0131 Kanunun 104&rsquo;&uuml;nc&uuml; maddesi a\u015fa\u011f\u0131daki \u015fekilde de\u011fi\u015ftirilmi\u015ftir;<\/span><\/strong><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; text-indent: 1cm; line-height: 16pt;\"><strong><span style=\"font-size: 12pt; font-family: 'Arial',sans-serif;\">&ldquo;MADDE 104: Cumhurba\u015fkan\u0131 Devletin ba\u015f\u0131d\u0131r. Y&uuml;r&uuml;tme yetkisi Cumhurba\u015fkan\u0131na aittir. Cumhurba\u015fkan\u0131, Devlet Ba\u015fkan\u0131 s\u0131fat\u0131yla T&uuml;rkiye Cumhuriyeti&rsquo;ni ve T&uuml;rk Milletinin birli\u011fini temsil eder; Anayasan\u0131n uygulanmas\u0131n\u0131, Devlet organlar\u0131n\u0131n d&uuml;zenli ve uyumlu &ccedil;al\u0131\u015fmas\u0131n\u0131 temin eder. Gerekli g&ouml;rd&uuml;\u011f&uuml; takdirde, yasama y\u0131l\u0131n\u0131n ilk g&uuml;n&uuml; T&uuml;rkiye B&uuml;y&uuml;k Millet Meclisinde a&ccedil;\u0131l\u0131\u015f konu\u015fmas\u0131n\u0131 yapar. &Uuml;lkenin i&ccedil; ve d\u0131\u015f siyaseti hakk\u0131nda Meclise mesaj verir. Kanunlar\u0131 yay\u0131mlar. Kanunlar\u0131 tekrar g&ouml;r&uuml;\u015f&uuml;lmek &uuml;zere T&uuml;rkiye B&uuml;y&uuml;k Millet Meclisine geri g&ouml;nderir. Kanunlar\u0131n, T&uuml;rkiye B&uuml;y&uuml;k Millet Meclisi \u0130&ccedil;t&uuml;z&uuml;\u011f&uuml;n&uuml;n t&uuml;m&uuml;n&uuml;n veya belirli h&uuml;k&uuml;mlerinin Anayasaya \u015fekil veya esas bak\u0131m\u0131ndan ayk\u0131r\u0131 olduklar\u0131 gerek&ccedil;esiyle Anayasa Mahkemesinde iptal davas\u0131 a&ccedil;ar. Cumhurba\u015fkan\u0131 Yard\u0131mc\u0131lar\u0131 ile Bakanlar\u0131 atar ve g&ouml;revlerine son verir. &Uuml;st kademe kamu y&ouml;neticilerini atar, g&ouml;revlerine son verir ve bunlar\u0131n atanmalar\u0131na ili\u015fkin usul ve esaslar\u0131 Cumhurba\u015fkanl\u0131\u011f\u0131 kararnamesiyle d&uuml;zenler. Yabanc\u0131 devletlere T&uuml;rkiye Cumhuriyeti&rsquo;nin temsilcilerini g&ouml;nderir, T&uuml;rkiye Cumhuriyeti&rsquo;ne g&ouml;nderilecek yabanc\u0131 devlet temsilcilerini kabul eder. Milletleraras\u0131 antla\u015fmalar\u0131 onaylar ve yay\u0131mlar. Anayasa de\u011fi\u015fikliklerine ili\u015fkin kanunlar\u0131 gerekli g&ouml;rd&uuml;\u011f&uuml; takdirde halkoyuna sunar. Milli g&uuml;venlik politikalar\u0131n\u0131 belirler ve gerekli tedbirleri al\u0131r.<\/span><\/strong><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; text-indent: 1cm; line-height: 16pt;\"><strong><span style=\"font-size: 12pt; font-family: 'Arial',sans-serif;\">T&uuml;rkiye B&uuml;y&uuml;k Millet Meclisi ad\u0131na T&uuml;rk Silahl\u0131 Kuvvetlerinin Ba\u015fkomutanl\u0131\u011f\u0131n\u0131 temsil eder. T&uuml;rk Silahl\u0131 Kuvvetlerinin kullan\u0131lmas\u0131na karar verir. S&uuml;rekli hastal\u0131k, sakatl\u0131k ve kocama sebebiyle ki\u015filerin cezalar\u0131n\u0131 hafifletir veya kald\u0131r\u0131r. Cumhurba\u015fkan\u0131, y&uuml;r&uuml;tme yetkisine ili\u015fkin konularda Cumhurba\u015fkanl\u0131\u011f\u0131 kararnamesi &ccedil;\u0131karabilir. Anayasan\u0131n ikinci k\u0131sm\u0131n\u0131n birinci ve ikinci b&ouml;l&uuml;mlerinde yer alan temel haklar, ki\u015fi haklar\u0131 ve &ouml;devleriyle d&ouml;rd&uuml;nc&uuml; b&ouml;l&uuml;mde yer alan siyasi haklar ve &ouml;devler Cumhurba\u015fkanl\u0131\u011f\u0131 kararnamesiyle d&uuml;zenlenemez. Anayasada m&uuml;nhas\u0131ran kanunla d&uuml;zenlenmesi &ouml;ng&ouml;r&uuml;len konularda Cumhurba\u015fkanl\u0131\u011f\u0131 kararnamesi &ccedil;\u0131kar\u0131lamaz. Kanunda a&ccedil;\u0131k&ccedil;a d&uuml;zenlenen konularda Cumhurba\u015fkanl\u0131\u011f\u0131 kararnamesi &ccedil;\u0131kar\u0131lamaz. Cumhurba\u015fkanl\u0131\u011f\u0131 kararnamesiyle kanunlarda farkl\u0131 h&uuml;k&uuml;mler bulunmas\u0131 halinde, kanun h&uuml;k&uuml;mleri uygulan\u0131r. T&uuml;rkiye B&uuml;y&uuml;k Millet Meclisinin ayn\u0131 konuda kanun &ccedil;\u0131karmas\u0131 durumunda, Cumhurba\u015fkanl\u0131\u011f\u0131 kararnamesi h&uuml;k&uuml;ms&uuml;z hale gelir. Cumhurba\u015fkan\u0131, kanunlar\u0131n uygulanmas\u0131n\u0131 sa\u011flamak &uuml;zere ve bunlara ayk\u0131r\u0131 olmamak \u015fart\u0131yla, y&ouml;netmelikler &ccedil;\u0131karabilir. Kararnameler ve y&ouml;netmelikler, yay\u0131mdan sonraki bir tarih belirlenmemi\u015fse, Resm&icirc; Gazetede yay\u0131mland\u0131klar\u0131 g&uuml;n y&uuml;r&uuml;rl&uuml;\u011fe girer. Cumhurba\u015fkan\u0131, ayr\u0131ca Anayasada ve kanunlarda verilen se&ccedil;me ve atama g&ouml;revleri ile di\u011fer g&ouml;revleri yerine getirir ve yetkileri kullan\u0131r.&rdquo;<\/span><\/strong><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; text-indent: 1cm; line-height: 16pt;\"><strong><em><span style=\"font-size: 14pt; font-family: 'Arial',sans-serif;\">&bull; Bu madde y&uuml;r&uuml;tmeyi tamamen Cumhurba\u015fkan\u0131na vermekle Meclisi g&ouml;stermelik, hatta sembolik konuma ta\u015f\u0131maktad\u0131r.<\/span><\/em><\/strong><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; text-indent: 1cm; line-height: 16pt;\"><strong><span style=\"font-size: 12pt; font-family: 'Arial',sans-serif;\">MADDE 9:<\/span><\/strong><strong><span style=\"font-size: 12pt; font-family: 'Arial',sans-serif;\"> 2709 say\u0131l\u0131 Kanunun 105&rsquo;inci maddesi ba\u015fl\u0131\u011f\u0131yla birlikte a\u015fa\u011f\u0131daki \u015fekilde de\u011fi\u015ftirilmi\u015ftir.<\/span><\/strong><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; text-indent: 1cm; line-height: 16pt;\"><strong><span style=\"font-size: 12pt; font-family: 'Arial',sans-serif;\">&ldquo;E. Cumhurba\u015fkan\u0131n\u0131n cezai sorumlulu\u011fu MADDE 105- Cumhurba\u015fkan\u0131 hakk\u0131nda, bir su&ccedil; i\u015fledi\u011fi iddias\u0131yla T&uuml;rkiye B&uuml;y&uuml;k Millet Meclisi &uuml;ye tamsay\u0131s\u0131n\u0131n salt &ccedil;o\u011funlu\u011funun verece\u011fi &ouml;nergeyle soru\u015fturma a&ccedil;\u0131lmas\u0131 istenebilir. Meclis, &ouml;nergeyi en ge&ccedil; bir ay i&ccedil;inde g&ouml;r&uuml;\u015f&uuml;r ve &uuml;ye tamsay\u0131s\u0131n\u0131n be\u015fte &uuml;&ccedil;&uuml;n&uuml;n gizli oyuyla soru\u015fturma a&ccedil;\u0131lmas\u0131na karar verebilir. Ola\u011fan&uuml;st&uuml; hal y&ouml;netimi MADDE 119: Cumhurba\u015fkan\u0131; sava\u015f, sava\u015f\u0131 gerektirecek bir durumun ba\u015f g&ouml;stermesi, seferberlik, ayaklanma, vatan veya Cumhuriyete kar\u015f\u0131 kuvvetli ve eylemli bir kalk\u0131\u015fma, &uuml;lkenin ve milletin b&ouml;l&uuml;nmezli\u011fini i&ccedil;ten veya d\u0131\u015ftan tehlikeye d&uuml;\u015f&uuml;ren \u015fiddet hareketlerinin yayg\u0131nla\u015fmas\u0131, anayasal d&uuml;zeni veya temel hak ve h&uuml;rriyetleri ortadan kald\u0131rmaya y&ouml;nelik yayg\u0131n \u015fiddet hareketlerinin ortaya &ccedil;\u0131kmas\u0131, \u015fiddet olaylar\u0131 nedeniyle kamu d&uuml;zeninin cidd&icirc; \u015fekilde bozulmas\u0131, tabi&icirc; afet veya tehlikeli salg\u0131n hastal\u0131k ya da a\u011f\u0131r ekonomik bunal\u0131m\u0131n ortaya &ccedil;\u0131kmas\u0131 hallerinde yurdun tamam\u0131nda veya bir b&ouml;lgesinde, s&uuml;resi alt\u0131 ay\u0131 ge&ccedil;memek &uuml;zere ola\u011fan&uuml;st&uuml; hal ilan edebilir. Ola\u011fan&uuml;st&uuml; hal ilan\u0131 karar\u0131 verildi\u011fi g&uuml;n Resm&icirc; Gazetede yay\u0131mlan\u0131r ve ayn\u0131 g&uuml;n T&uuml;rkiye B&uuml;y&uuml;k Millet Meclisinin onay\u0131na sunulur. T&uuml;rkiye B&uuml;y&uuml;k Millet Meclisi tatilde ise derhal toplant\u0131ya &ccedil;a\u011f\u0131r\u0131l\u0131r; Meclis gerekli g&ouml;rd&uuml;\u011f&uuml; takdirde ola\u011fan&uuml;st&uuml; halin s&uuml;resini k\u0131saltabilir, uzatabilir veya ola\u011fan&uuml;st&uuml; hali kald\u0131rabilir. Cumhurba\u015fkan\u0131n\u0131n talebiyle T&uuml;rkiye B&uuml;y&uuml;k Millet Meclisi her defas\u0131nda d&ouml;rt ay\u0131 ge&ccedil;memek &uuml;zere s&uuml;reyi uzatabilir. Sava\u015f hallerinde bu d&ouml;rt ayl\u0131k s&uuml;re aranmaz. Ola\u011fan&uuml;st&uuml; hallerde vatanda\u015flar i&ccedil;in getirilecek para, mal ve &ccedil;al\u0131\u015fma y&uuml;k&uuml;ml&uuml;l&uuml;kleri ile 15&rsquo;inci maddedeki ilkeler do\u011frultusunda temel hak ve h&uuml;rriyetlerin nas\u0131l s\u0131n\u0131rlanaca\u011f\u0131 veya ge&ccedil;ici olarak durdurulaca\u011f\u0131, hangi h&uuml;k&uuml;mlerin uygulanaca\u011f\u0131 ve i\u015flemlerin nas\u0131l y&uuml;r&uuml;t&uuml;lece\u011fi kanunla d&uuml;zenlenir. Ola\u011fan&uuml;st&uuml; hallerde Cumhurba\u015fkan\u0131, ola\u011fan&uuml;st&uuml; halin gerekli k\u0131ld\u0131\u011f\u0131 konularda, 104&rsquo;&uuml;nc&uuml; maddenin on yedinci f\u0131kras\u0131n\u0131n ikinci c&uuml;mlesinde belirtilen s\u0131n\u0131rlamalara tabi olmaks\u0131z\u0131n Cumhurba\u015fkanl\u0131\u011f\u0131 kararnamesi &ccedil;\u0131karabilir. Kanun h&uuml;km&uuml;ndeki bu kararnameler Resm&icirc; Gazetede yay\u0131mlan\u0131r, ayn\u0131 g&uuml;n Meclis onay\u0131na sunulur.<\/span><\/strong><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; text-indent: 1cm; line-height: 16pt;\"><strong><span style=\"font-size: 12pt; font-family: 'Arial',sans-serif;\">Sava\u015f ve m&uuml;cbir sebeplerle T&uuml;rkiye B&uuml;y&uuml;k Millet Meclisinin toplanamamas\u0131 h&acirc;li hari&ccedil; olmak &uuml;zere; ola\u011fan&uuml;st&uuml; hal s\u0131ras\u0131nda &ccedil;\u0131kar\u0131lan Cumhurba\u015fkanl\u0131\u011f\u0131 kararnameleri &uuml;&ccedil; ay i&ccedil;inde T&uuml;rkiye B&uuml;y&uuml;k Millet Meclisinde g&ouml;r&uuml;\u015f&uuml;l&uuml;r ve karara ba\u011flan\u0131r. Kurulun T&uuml;rkiye B&uuml;y&uuml;k Millet Meclisi taraf\u0131ndan se&ccedil;ilecek &uuml;yeliklerine ili\u015fkin ba\u015fvurular, Meclis Ba\u015fkanl\u0131\u011f\u0131na yap\u0131l\u0131r. Ba\u015fkanl\u0131k, ba\u015fvurular\u0131 Anayasa ve Adalet Komisyonlar\u0131 &Uuml;yelerinden Kurulu Karma Komisyona g&ouml;nderir. Komisyon her bir &uuml;yelik i&ccedil;in &uuml;&ccedil; aday\u0131, &uuml;ye tamsay\u0131s\u0131n\u0131n &uuml;&ccedil;te iki &ccedil;o\u011funlu\u011fuyla belirler. Birinci oylamada aday belirleme i\u015fleminin sonu&ccedil;land\u0131r\u0131lamamas\u0131 halinde ikinci oylamada &uuml;ye tamsay\u0131s\u0131n\u0131n be\u015fte &uuml;&ccedil; &ccedil;o\u011funlu\u011fu aran\u0131r. B&uuml;t&ccedil;e ve kesin hesap MADDE 161: Kamu idarelerinin ve kamu iktisad&icirc; te\u015febb&uuml;sleri d\u0131\u015f\u0131ndaki kamu t&uuml;zel ki\u015filerinin harcamalar\u0131 y\u0131ll\u0131k b&uuml;t&ccedil;elerle yap\u0131l\u0131r. Cumhurba\u015fkan\u0131 b&uuml;t&ccedil;e kanun teklifini, mal&icirc; y\u0131lba\u015f\u0131ndan en az yetmi\u015f be\u015f g&uuml;n &ouml;nce, T&uuml;rkiye B&uuml;y&uuml;k Millet Meclisine sunar. B&uuml;t&ccedil;e teklifi B&uuml;t&ccedil;e Komisyonunda g&ouml;r&uuml;\u015f&uuml;l&uuml;r. Komisyonun elli be\u015f g&uuml;n i&ccedil;inde kabul edece\u011fi metin Genel Kurulda g&ouml;r&uuml;\u015f&uuml;l&uuml;r ve mal&icirc; y\u0131lba\u015f\u0131na kadar karara ba\u011flan\u0131r. B&uuml;t&ccedil;e kanununun s&uuml;resinde y&uuml;r&uuml;rl&uuml;\u011fe konulamamas\u0131 halinde, ge&ccedil;ici b&uuml;t&ccedil;e kanunu &ccedil;\u0131kar\u0131l\u0131r. T&uuml;rkiye B&uuml;y&uuml;k Millet Meclisi &uuml;yeleri, Genel Kurulda kamu idare b&uuml;t&ccedil;eleri hakk\u0131nda d&uuml;\u015f&uuml;ncelerini her b&uuml;t&ccedil;enin g&ouml;r&uuml;\u015f&uuml;lmesi s\u0131ras\u0131nda a&ccedil;\u0131klarlar, gider art\u0131r\u0131c\u0131 veya gelirleri azalt\u0131c\u0131 &ouml;nerilerde bulunamazlar. Genel Kurulda kamu idare b&uuml;t&ccedil;eleri ile de\u011fi\u015fiklik &ouml;nergeleri, &uuml;zerinde ayr\u0131ca g&ouml;r&uuml;\u015fme yap\u0131lmaks\u0131z\u0131n okunur ve oylan\u0131r. Merkez&icirc; y&ouml;netim b&uuml;t&ccedil;esiyle verilen &ouml;denek, harcanabilecek tutar\u0131n s\u0131n\u0131r\u0131n\u0131 g&ouml;sterir. Harcanabilecek tutar\u0131n Cumhurba\u015fkanl\u0131\u011f\u0131 kararnamesiyle a\u015f\u0131labilece\u011fine dair b&uuml;t&ccedil;e kanununa h&uuml;k&uuml;m konulamaz. Car&icirc; y\u0131l b&uuml;t&ccedil;esindeki &ouml;denek art\u0131\u015f\u0131n\u0131 &ouml;ng&ouml;ren de\u011fi\u015fiklik teklifleri ile car&icirc; ve izleyen y\u0131llar\u0131n b&uuml;t&ccedil;elerine mal&icirc; y&uuml;k getiren tekliflerde, &ouml;ng&ouml;r&uuml;len giderleri kar\u015f\u0131layabilecek mal&icirc; kaynak g&ouml;sterilmesi zorunludur. Merkez&icirc; y&ouml;netim kesin hesap kanunu teklifi, ilgili oldu\u011fu mal&icirc; y\u0131l\u0131n sonundan ba\u015flayarak en ge&ccedil; alt\u0131 ay sonra Cumhurba\u015fkan\u0131 taraf\u0131ndan T&uuml;rkiye B&uuml;y&uuml;k Millet Meclisine sunulur. Ba\u015fkanl\u0131k, ba\u015fvurular\u0131 Anayasa ve Adalet Komisyonlar\u0131 &Uuml;yelerinden Kurulu Karma Komisyona g&ouml;nderir. Komisyon on g&uuml;n i&ccedil;inde her bir &uuml;yelik i&ccedil;in &uuml;&ccedil; aday\u0131 &uuml;ye tamsay\u0131s\u0131n\u0131n &uuml;&ccedil;te iki &ccedil;o\u011funlu\u011fuyla belirler. Birinci oylamada &uuml;&ccedil;te iki &ccedil;o\u011funlukla se&ccedil;imin sonu&ccedil;land\u0131r\u0131lamamas\u0131 halinde, ikinci ve &uuml;&ccedil;&uuml;nc&uuml; oylamalar yap\u0131l\u0131r; bu oylamalarda &uuml;ye tamsay\u0131s\u0131n\u0131n be\u015fte &uuml;&ccedil; &ccedil;o\u011funlu\u011funun oyunu alan aday se&ccedil;ilmi\u015f olur. Yeni &uuml;yeler, ilgili kanunda de\u011fi\u015fiklik yap\u0131l\u0131ncaya kadar mevcut Kanunun Anayasaya ayk\u0131r\u0131 olmayan h&uuml;k&uuml;mleri uyar\u0131nca &ccedil;al\u0131\u015f\u0131r. G&ouml;revi sona eren ve H&acirc;kimler ve Savc\u0131lar Kuruluna yeniden se&ccedil;ilmeyen &uuml;yelerden, talepleri halinde adli yarg\u0131 h&acirc;kim ve savc\u0131lar\u0131 aras\u0131ndan se&ccedil;ilenler Yarg\u0131tay &uuml;yeli\u011fine, idari yarg\u0131 h&acirc;kim ve savc\u0131lar\u0131 aras\u0131ndan se&ccedil;ilenler Dan\u0131\u015ftay &uuml;yeli\u011fine H&acirc;kimler ve Savc\u0131lar Kurulunca se&ccedil;ilir; &ouml;\u011fretim &uuml;yeleri ve avukatlar aras\u0131ndan se&ccedil;ilenler ise Dan\u0131\u015ftay &uuml;yeli\u011fine Cumhurba\u015fkan\u0131nca atan\u0131r. Bunlardan, emeklilik hakk\u0131n\u0131 elde edenlerden ya\u015f haddinden &ouml;nce bu g&ouml;revlerden kendi istekleriyle ayr\u0131lacaklara &ouml;denecek tazminata ili\u015fkin usul ve esaslar kanunla d&uuml;zenlenir. Kald\u0131r\u0131lan asker&icirc; yarg\u0131 mercilerinde g&ouml;r&uuml;lmekte olan dosyalardan; kanun yolu incelemesi a\u015famas\u0131nda olanlar ilgisine g&ouml;re Yarg\u0131tay veya Dan\u0131\u015ftay&rsquo;a, di\u011fer dosyalar ise ilgisine g&ouml;re g&ouml;revli ve yetkili adli veya idari yarg\u0131 mercilerine d&ouml;rt ay i&ccedil;inde g&ouml;nderilir.<\/span><\/strong><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; text-indent: 1cm; line-height: 16pt;\"><strong><span style=\"font-size: 12pt; font-family: 'Arial',sans-serif;\">F) Bu Kanunun y&uuml;r&uuml;rl&uuml;\u011fe girdi\u011fi tarihte y&uuml;r&uuml;rl&uuml;kte bulunan kanun h&uuml;km&uuml;nde kararnameler, t&uuml;z&uuml;kler, Ba\u015fbakanl\u0131k ve Bakanlar Kurulu taraf\u0131ndan &ccedil;\u0131kar\u0131lan y&ouml;netmelikler ile di\u011fer d&uuml;zenleyici i\u015flemler y&uuml;r&uuml;rl&uuml;kten kald\u0131r\u0131lmad\u0131k&ccedil;a ge&ccedil;erlili\u011fini s&uuml;rd&uuml;r&uuml;r. Yani Anayasa h&uuml;k&uuml;mleri; yasama, y&uuml;r&uuml;tme ve yarg\u0131 organlar\u0131n\u0131, idare makamlar\u0131n\u0131 ve di\u011fer kurulu\u015f ve ki\u015fileri ba\u011flayan temel hukuk kurallar\u0131d\u0131r. Kanunlar Anayasaya ayk\u0131r\u0131 olamayacakt\u0131r. Buna g&ouml;re, &ldquo;Anayasan\u0131n &uuml;st&uuml;nl&uuml;\u011f&uuml;&rdquo; kavram\u0131, en ba\u015fta yasalar\u0131n Anayasa&rsquo;ya ayk\u0131r\u0131 olamayaca\u011f\u0131n\u0131 anlat\u0131r. Yani T&uuml;rkiye B&uuml;y&uuml;k Millet Meclisi (TBMM) Anayasa&rsquo;ya uygun yasalar yapmak zorundad\u0131r. D&uuml;nyada bir&ccedil;ok anayasal sistemde, yasalar\u0131n Anayasa&rsquo;ya uygun olup olmad\u0131\u011f\u0131 yarg\u0131 organ\u0131 taraf\u0131ndan denetlenir durumdad\u0131r. Bizim anayasal sistemimizde bu g&ouml;revi Anayasa Mahkemesi yapmaktad\u0131r. Anayasa Mahkemesi Anayasa&rsquo;ya ayk\u0131r\u0131 yasalar\u0131 iptal ederek &ldquo;Anayasan\u0131n &uuml;st&uuml;nl&uuml;\u011f&uuml;&rdquo; ilkesini korumaktad\u0131r. <\/span><\/strong><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; text-indent: 1cm; line-height: 16pt;\"><strong><span style=\"font-size: 12pt; font-family: 'Arial',sans-serif;\">Yasama organ\u0131 gibi, y&uuml;r&uuml;tme organ\u0131 da Anayasa ile ba\u011fl\u0131d\u0131r. \u0130dari yarg\u0131, idarenin eylem ve i\u015flemlerinin hukuka uygunlu\u011funu denetlerken ayn\u0131 zamanda idarenin Anayasa&rsquo;ya uygun hareket etmesini sa\u011flamaktad\u0131r. <\/span><\/strong><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; text-indent: 1cm; line-height: 16pt;\"><strong><span style=\"font-size: 12pt; font-family: 'Arial',sans-serif;\">Yarg\u0131 organ\u0131 a&ccedil;\u0131s\u0131ndan da hukuk sistemindeki en &uuml;st&uuml;n yasa Anayasa&rsquo;d\u0131r. Yarg\u0131&ccedil;lar, &ouml;nlerine gelen davalarda yasalar\u0131 uygularken, uyu\u015fmazl\u0131klar\u0131 &ccedil;&ouml;zerken veya &ldquo;T&uuml;rk Milleti&rdquo; ad\u0131na cezaland\u0131rma yetkisini kullan\u0131rken hep Anayasa&rsquo;n\u0131n &ccedil;izdi\u011fi &ccedil;er&ccedil;eve i&ccedil;inde davranacakt\u0131r. Devlet organlar\u0131 d\u0131\u015f\u0131nda t&uuml;m &ouml;zel ve t&uuml;zel ki\u015filer de <\/span><\/strong><strong><em><span style=\"font-size: 14pt; font-family: 'Arial',sans-serif;\">&ldquo;Anayasan\u0131n &uuml;st&uuml;nl&uuml;\u011f&uuml;&rdquo;<\/span><\/em><\/strong><span style=\"font-size: 14pt; font-family: 'Arial',sans-serif;\"> <\/span><strong><span style=\"font-size: 12pt; font-family: 'Arial',sans-serif;\">ilkesine sayg\u0131 g&ouml;stermek zorundad\u0131r. <\/span><\/strong><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; text-indent: 1cm; line-height: 16pt;\"><strong><span style=\"font-size: 12pt; font-family: 'Arial',sans-serif;\">Hukuk kurallar\u0131; toplumsal ili\u015fkileri d&uuml;zenleyen esaslard\u0131r. Bireyler, hukuk kurallar\u0131n\u0131n sa\u011flad\u0131\u011f\u0131 net ve kesin yasalar sayesinde, toplumsal ili\u015fkilerde rahatl\u0131\u011fa ve g&uuml;ven ortam\u0131na kavu\u015fmaktad\u0131r. Anayasa sadece bireyler i&ccedil;in de\u011fil devlet i&ccedil;in de &ouml;nemli bir dayanakt\u0131r ve devletin temel yap\u0131s\u0131n\u0131 kuran belge Anayasa&rsquo;d\u0131r. Devletin &uuml;&ccedil; temel organ\u0131n\u0131n, yani yasama, y&uuml;r&uuml;tme ve yarg\u0131n\u0131n kurulu\u015f ve i\u015fleyi\u015fine ili\u015fkin esaslar Anayasa&rsquo;da yer al\u0131r. Bu organlar\u0131n birbirleriyle olan ili\u015fkileri de Anayasa&rsquo;ya g&ouml;re d&uuml;zenlenip ayarlan\u0131r. B&uuml;t&uuml;n bunlar\u0131n &ouml;tesinde, devletin kendisine y&uuml;klenen g&ouml;revleri yerine getirmesi i&ccedil;in kullanmas\u0131 gereken yetkilerin kayna\u011f\u0131 da Anayasa&rsquo;d\u0131r. Bu y&uuml;zden <\/span><\/strong><strong><em><span style=\"font-size: 14pt; font-family: 'Arial',sans-serif;\">&ldquo;Hi&ccedil;bir kimse veya organ kayna\u011f\u0131n\u0131 Anayasadan almayan bir Devlet yetkisi kullanamayacakt\u0131r.&rdquo; <\/span><\/em><\/strong><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; text-indent: 1cm; line-height: 16pt;\"><strong><span style=\"font-size: 14pt; font-family: 'Arial',sans-serif;\">\u0130\u015fte b&uuml;t&uuml;n bunlardan dolay\u0131d\u0131r ki, anayasalar\u0131n &ldquo;D\u0130L&rsquo;\u0130&rdquo;, okuyan herkesin kolayl\u0131kla ayn\u0131 \u015feyi anlayaca\u011f\u0131 \u015fekilde <\/span><\/strong><strong><em><span style=\"font-size: 16pt; font-family: 'Arial',sans-serif;\">net, a&ccedil;\u0131k ve kesin<\/span><\/em><\/strong><span style=\"font-size: 16pt; font-family: 'Arial',sans-serif;\"> <\/span><strong><span style=\"font-size: 14pt; font-family: 'Arial',sans-serif;\">olmal\u0131 ve bu sadelikle yaz\u0131lmal\u0131d\u0131r. Oysa Referanduma sunulan yukar\u0131daki Yeni anayasa maddeleri de\u011fil vatanda\u015flar\u0131m\u0131z taraf\u0131ndan, hatta hukuk uzmanlar\u0131nca bile &ldquo;ne dedi\u011fi ve neleri i&ccedil;erdi\u011fi&rdquo; anla\u015f\u0131lmayan kapal\u0131 ve karma\u015f\u0131k ifadeler ta\u015f\u0131maktad\u0131r. Yetkililerin keyfi yorumlar\u0131na ve uygulamalar\u0131na m&uuml;sait c&uuml;mleler bar\u0131nd\u0131rmaktad\u0131r. Sanki, kimse bir \u015fey anlamas\u0131n diye haz\u0131rlanm\u0131\u015ft\u0131r. Bu yakla\u015f\u0131m da ku\u015fkular\u0131m\u0131z\u0131 artt\u0131rmaktad\u0131r. Acaba, &uuml;lkemiz aleyhine hangi kas\u0131tl\u0131 planlar var ki b&ouml;ylesi sinsi ve tehlikeli de\u011fi\u015fimlere ihtiya&ccedil; duyulmaktad\u0131r? <\/span><\/strong><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; text-indent: 1cm; line-height: 16pt;\"><strong><span style=\"font-size: 12pt; font-family: 'Arial',sans-serif;\">AKP kurucular\u0131ndan ve &ouml;nemli kurmaylar\u0131ndan Cemil &Ccedil;i&ccedil;ek bile referandumlar\u0131m\u0131zda &ldquo;i&ccedil;eri\u011fin&rdquo; de\u011fil lider ve partilere sadakat ya da tepkilerin &ouml;n planda etkili oldu\u011fundan yak\u0131nmaktad\u0131r. Bu s&ouml;zler Anayasa de\u011fi\u015fikli\u011finin i&ccedil;eri\u011finin bilinmedi\u011finin de dolayl\u0131 itiraf\u0131d\u0131r. Geli\u015fmi\u015f demokrasilerde de bunlar\u0131n da etkisi &ouml;nemlidir, ancak &ldquo;i&ccedil;eri\u011fe&rdquo; &ouml;ncelik veren, &ldquo;i&ccedil;eri\u011fe&rdquo; bakarak evet veya hay\u0131r y&ouml;n&uuml;nde davranan \u015fuurlu ve sorumlu Milli Duyarl\u0131 kesimler de vard\u0131r. Bizde ise maalesef lider ve parti sadakatlerinin &uuml;st&uuml;nde &ldquo;i&ccedil;eri\u011fe&rdquo; bakarak ilkesel ve &uuml;lkesel &ouml;nceliklerle tav\u0131r alan kesimler pek azd\u0131r ve daha beteri, bu Anayasa de\u011fi\u015fikli\u011fi metni, okunsa bile ne dedi\u011fi ve neleri hedefledi\u011fi anla\u015f\u0131lamamaktad\u0131r. <\/span><\/strong><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; text-indent: 1cm; line-height: 16pt;\"><strong><span style=\"font-size: 12pt; font-family: 'Arial',sans-serif;\">Oysa <\/span><\/strong><strong><span style=\"font-size: 16pt; font-family: 'Arial',sans-serif;\">Anayasa<\/span><\/strong><strong><span style=\"font-size: 12pt; font-family: 'Arial',sans-serif;\">, &uuml;lke &uuml;zerindeki egemenlik haklar\u0131n\u0131n kullan\u0131m yetkisinin i&ccedil;eri\u011finde belirtildi\u011fi \u015fekliyle devlete verildi\u011fini g&ouml;steren toplumsal s&ouml;zle\u015fmeler (kar\u015f\u0131l\u0131kl\u0131 r\u0131zaya dayal\u0131 uzla\u015fma ve konsens&uuml;s metinleri) say\u0131lmaktad\u0131r. Yani devletle millet aras\u0131ndaki mutabakat esaslar\u0131d\u0131r. Bu nedenle di\u011fer b&uuml;t&uuml;n hukuki kurallardan ve yap\u0131lardan &uuml;st&uuml;nd&uuml;r ve hi&ccedil;bir kanun ve yap\u0131 anayasaya ayk\u0131r\u0131 olamayacakt\u0131r.<\/span><\/strong><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; text-indent: 1cm; line-height: 16pt;\"><strong><span style=\"font-size: 16pt; font-family: 'Arial',sans-serif;\">Anayasa<\/span><\/strong><strong><span style=\"font-size: 12pt; font-family: 'Arial',sans-serif;\">, bir devletin y&ouml;netim bi&ccedil;imini tan\u0131mlayan genel kurum ve kurallar\u0131 kapsamaktad\u0131r. Toplumlar\u0131n &uuml;lke &uuml;zerindeki egemenlik haklar\u0131n\u0131n, bireylerin &ouml;zg&uuml;rl&uuml;k alanlar\u0131n\u0131n hangi ko\u015fullar alt\u0131nda devlet taraf\u0131ndan kullan\u0131labilece\u011fini belirleyen temel kanunlard\u0131r. <\/span><\/strong><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; text-indent: 1cm; line-height: 16pt;\"><strong><span style=\"font-size: 14pt; font-family: 'Arial',sans-serif;\">Bu nedenle Anayasan\u0131n herkesi ba\u011flay\u0131c\u0131 olmas\u0131, gayet a&ccedil;\u0131k ve anla\u015f\u0131l\u0131r olmas\u0131n\u0131 da gerekli k\u0131lmaktad\u0131r. Cumhurba\u015fkan\u0131 &ldquo;kararname&rdquo; &ccedil;\u0131kararak do\u011frudan yasama yetkisi kullanacakt\u0131r. D&uuml;zenlemede <em>&ldquo;temel hak ve &ouml;zg&uuml;rl&uuml;kler konusunda s\u0131n\u0131r getirilmesi, yasa ile kararnamenin &ccedil;eli\u015fmesi durumunda yasaya &uuml;st&uuml;nl&uuml;k tan\u0131nmas\u0131&rdquo;<\/em> hep laf\u0131 g&uuml;zaft\u0131r. &Ccedil;&uuml;nk&uuml; bu s\u0131n\u0131rlar\u0131n a\u015f\u0131lmas\u0131 durumunda ne yap\u0131laca\u011f\u0131 belirsiz ve karanl\u0131kt\u0131r. Nitekim bug&uuml;n Cumhurba\u015fkan\u0131, &ouml;nleyici bir d&uuml;zenek bulunmad\u0131\u011f\u0131, tek g&ouml;revli olan Anayasa Mahkemesi de &ldquo;ayak ba\u011f\u0131&rdquo; olmaktan &ccedil;ekindi\u011fi i&ccedil;in Anayasa&rsquo;n\u0131n bir&ccedil;ok kural\u0131n\u0131 ask\u0131ya almaktad\u0131r. Getirilen s\u0131n\u0131rlamalar\u0131n k&acirc;\u011f\u0131t &uuml;zerinde kalaca\u011f\u0131 a&ccedil;\u0131kt\u0131r.<\/span><\/strong><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; text-indent: 1cm; line-height: 16pt;\"><strong><span style=\"font-size: 12pt; font-family: 'Arial',sans-serif;\">&Uuml;stelik Cumhurba\u015fkan\u0131na, kimi alanlar\u0131 kararnamelerle d&uuml;zenleme yetkisi de tan\u0131nmaktad\u0131r. &Ouml;rne\u011fin Cumhurba\u015fkan\u0131, kararnameler ile kamu kurum ve kurulu\u015flar\u0131n\u0131, yani Devleti yeniden yap\u0131land\u0131racakt\u0131r. &Uuml;stelik Cumhurba\u015fkan\u0131 yasalar\u0131, bug&uuml;nk&uuml;nden farkl\u0131 olarak hi&ccedil;bir gerek&ccedil;e g&ouml;stermeden Meclis&rsquo;e geri yollayacakt\u0131r. Geri g&ouml;nderme durumunda, metnin yeniden yasala\u015fabilmesi i&ccedil;in nitelikli &ccedil;o\u011funlukla kabul&uuml; \u015fart ko\u015fulmaktad\u0131r. Yani geri g&ouml;nderilen d&uuml;zenlemeler, ancak &uuml;ye tam say\u0131s\u0131n\u0131n salt &ccedil;o\u011funlu\u011fu ile (yeni mecliste bu say\u0131 301&rsquo;dir) aynen kabul edilirse yasala\u015fm\u0131\u015f olacakt\u0131r.<\/span><\/strong><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; text-indent: 1cm; line-height: 16pt;\"><strong><span style=\"font-size: 14pt; font-family: 'Arial',sans-serif;\">Cumhurba\u015fkan\u0131na yasalar\u0131n yay\u0131mlanmas\u0131n\u0131 s&uuml;r&uuml;ncemede b\u0131rakma yetkisi tan\u0131nm\u0131\u015ft\u0131r!<\/span><\/strong><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; text-indent: 1cm; line-height: 16pt;\"><strong><span style=\"font-size: 12pt; font-family: 'Arial',sans-serif;\">Yasalar\u0131 yay\u0131ma g&ouml;ndermede Cumhurba\u015fkan\u0131n\u0131n yetkisini ba\u011flayan 15 g&uuml;nl&uuml;k s&uuml;re s\u0131n\u0131r\u0131 da Anayasa&rsquo;dan &ccedil;\u0131kar\u0131lmaktad\u0131r. B&ouml;ylece Cumhurba\u015fkan\u0131na yasalar\u0131 geri &ccedil;evirip ya da s&uuml;r&uuml;ncemede b\u0131rakarak, o alanlar\u0131 kararnamelerle d&uuml;zenleyip &uuml;lkeyi y&ouml;netme olana\u011f\u0131 sunulmaktad\u0131r. Cumhurba\u015fkan\u0131na ayr\u0131ca, yasalar\u0131n uygulanmas\u0131n\u0131 sa\u011flamak &uuml;zere <\/span><\/strong><strong><span style=\"font-size: 14pt; font-family: 'Arial',sans-serif;\">y&ouml;netmelik &ccedil;\u0131karma <\/span><\/strong><strong><span style=\"font-size: 12pt; font-family: 'Arial',sans-serif;\">yetkisi de tan\u0131nmaktad\u0131r. Cumhurba\u015fkan\u0131 b&ouml;ylece yasalar\u0131 yorumlama, kendi anlay\u0131\u015f\u0131 do\u011frultusunda uygulanmalar\u0131n\u0131 sa\u011flama gibi bir yetkiye de kavu\u015fturulmaktad\u0131r.<\/span><\/strong><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; text-indent: 1cm; line-height: 16pt;\"><strong><span style=\"font-size: 14pt; font-family: 'Arial',sans-serif;\">Yarg\u0131 erki Cumhurba\u015fkan\u0131na ba\u011flanacakt\u0131r.<\/span><\/strong><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; text-indent: 1cm; line-height: 16pt;\"><strong><span style=\"font-size: 12pt; font-family: 'Arial',sans-serif;\">Bilindi\u011fi gibi 2010 y\u0131l\u0131 Anayasa de\u011fi\u015fikli\u011fi ile yarg\u0131n\u0131n &ccedil;ok &ouml;nemli iki kurulu, Anayasa Mahkemesi ile H&acirc;kimler ve Savc\u0131lar Y&uuml;ksek Kurulu (HSYK), verilen atama yetkileriyle siyasal iktidara ba\u011fl\u0131 konuma ta\u015f\u0131nm\u0131\u015ft\u0131r. Bug&uuml;nk&uuml; Anayasa de\u011fi\u015fikli\u011fiyle HSYK&rsquo;n\u0131n yap\u0131s\u0131 yeniden d&uuml;zenlenmekte ve &ccedil;ok daha ba\u011f\u0131ml\u0131 hale sokulmaktad\u0131r. Bir kez, neden gerek duyuldu ise HSYK <\/span><\/strong><strong><em><span style=\"font-size: 14pt; font-family: 'Arial',sans-serif;\">&ldquo;Y&uuml;ksek&rdquo;<\/span><\/em><\/strong><strong><span style=\"font-size: 12pt; font-family: 'Arial',sans-serif;\"> stat&uuml;s&uuml;nden &ccedil;\u0131kar\u0131lmaktad\u0131r. Kurulun Ba\u015fkan\u0131 Adalet Bakan\u0131d\u0131r. Geri kalan 11 &uuml;yenin 5&rsquo;ini Cumhurba\u015fkan\u0131, 6&rsquo;s\u0131n\u0131 TBMM se&ccedil;ip atayacakt\u0131r. Yani siyasal iktidar Kurula do\u011frudan sahip olacakt\u0131r. Yani Meclis&rsquo;e de egemen olan Cumhurba\u015fkan\u0131 HSK &uuml;yelerinin t&uuml;m&uuml;n&uuml; atama yetkisiyle donat\u0131lm\u0131\u015f durumdad\u0131r. Se&ccedil;imlerin belli mesleki kontenjanlar i&ccedil;inden yap\u0131lacak olmas\u0131 sonuca etkili de\u011fildir. &Ccedil;&uuml;nk&uuml; &ldquo;isteklere&rdquo; uygun adaylar her zaman bulunabilecektir. &Uuml;lkemiz bu y&ouml;nden olduk&ccedil;a zengin bir kayna\u011fa sahiptir.<\/span><\/strong><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; text-indent: 1cm; line-height: 16pt;\"><strong><span style=\"font-size: 14pt; font-family: 'Arial',sans-serif;\">Y&uuml;r&uuml;tmenin de ba\u015f\u0131 Cumhurba\u015fkan\u0131d\u0131r!<\/span><\/strong><\/p>\n<p style=\"margin-bottom: 0.0001pt; text-align: justify; text-indent: 1cm; line-height: 16pt;\"><strong><span style=\"font-size: 12pt; font-family: 'Arial',sans-serif;\">Cumhurba\u015fkan\u0131 hem Devletin hem de y&uuml;r&uuml;tmenin ba\u015f\u0131d\u0131r.
